Executive Summary: The purpose of this report is to request authorization for the City Manager to execute two Task Orders for FY 2023/24 to the Joint Powers Agreement with the City of Newark. The Task Orders are for services to be provided by the Human Services Department to City of Newark residents.
Task Order No. 28 is for case management services for Newark seniors in the amount of $5,000. Task Order No. 29 is for paratransit service delivery to Newark residents in the amount of $300,000.
BACKGROUND: For many years, the Human Services Department has provided case management services to older adults residing in Newark under a Joint Powers Agreement (JPA) between the City of Fremont and the City of Newark. Case managers, who specialize in assisting older adults, provide needed support and services to seniors and their families in their home. This enables the older adult to continue living independently in their own home and community.
In 2013, the JPA with the City of Newark was amended to include the provision of paratransit services to Newark residents.
The existing JPA between the City of Fremont and the City of Newark outlines these services and has been flexibly structured so that new task orders may be executed as needed, such as on an annual basis, to allow for changes in service needs, costs and funding availability.
The existing JPA with Newark is made pursuant to State law and does not create a separate legal entity. Rather, the JPA allows City staff to provide services to Newark residents while retaining the legal protections available when providing municipal services within the City’s jurisdiction.
DISCUSSION/ANALYSIS: The City of Newark will reimburse the City of Fremont for case management services provided under Task Order No. 28. Case managers meet with each elderly Newark resident and their family in their home and together develop a plan of care that is unique to the client’s needs. The case manager will contact clients on a regular basis and assist them with obtaining services and information. This specialized support has been shown to increase the ability of older adults to remain living safely in their home as they age.

The City of Newark will also use its Measure BB direct local distribution revenues to pay the City of Fremont for paratransit service delivery provided under Task Order No. 29. The Alameda County Transportation Commission administers the Measure BB sales tax revenues for cities to provide special transportation for seniors and people with disabilities.
The City of Fremont has worked with the Cities of Newark and Union City to develop and implement regional transportation services that allow elderly and disabled Tri -City residents to access needed health care, social and recreational opportunities and to take care of shopping and other day-to-day needs more easily. These services are provided through Ride-On Tri-City!, a program of the City’s Human Services Department. The City has an existing Joint Powers Agreement with the City of Union City and the City of Newark to provide paratransit services to their respective residents. These existing Joint Powers Agreements enable the City of Fremont and its neighboring cities to benefit from economies of scale by streamlining community outreach and education efforts, consolidating staff functions, leveraging funding and providing cost-effective services to Tri-City residents.
In FY 2023/24, paratransit services to Newark residents will include Wheelchair Accessible Van Services, Taxi Services and Ride-Hailing Services. Taxi Services and Ride-Hailing Services are provided through the City’s existing service agreements with Lyft, Inc., GoGo Technologies, Inc., and Siddiq, Inc. Wheelchair Accessible Van services will be provided by Union City’s paratransit service provider; a request for authorization to execute Task Order No. 12 to the Joint Powers Agreement with Union City is also before the Council today under a separate agenda item.
FISCAL IMPACT: Under proposed Task Order No. 28 for FY 2023/24, Newark will reimburse Fremont in an amount up to $5,000 for case management service costs. Under proposed Task Order No. 29 for FY 2023/24, Newark will reimburse Fremont in an amount up to $300,000 for all Newark paratransit service delivery costs.
The City’s approved FY 2023/24 Operating Budget includes an appropriation of $293,052 in funds for paratransit service delivery and $5,000 in funds for case management services for Newark residents. In order to match the amount that the City of Newark has appropriated for paratransit service delivery ($300,000) under Task Order No. 29, staff is requesting a total of $6,948 in additional appropriations to Fund 176.
ENVIRONMENTAL REVIEW: The action is exempt from CEQA pursuant to, without limitation, CEQA Guidelines Section 15378(b)(2), (4) and/or (5), and/or 15061(b)(3) as an administrative or fiscal activity that has no potential to cause a significant effect on the environment, directly or indirectly, each of the foregoing providing a separate and independent basis for CEQA exemption.
ATTACHMENTS: None.
