ELECTRIC VEHICLE FAST CHARGING HUBS - Authorize the City Manager or their Designee to Execute a Master Site License Agreement with Ava Community Energy for Electric Vehicle Fast Charging Stations at Multiple Locations and Find that the Action is Exempt from CEQA Review
Contact Persons:
Name: Dan Schoenholz
Title: Community Development Director
Div/Dept: Community Development
Phone: 510-494-4438
E-Mail: [email protected]
Executive Summary: Ava Community Energy (Ava), is a Joint Powers Authority (JPA) that has included the City of Fremont since the JPA’s formation in 2016. Ava (formerly known as East Bay Community Energy, or EBCE), serves as Fremont’s default local clean electricity provider. In support of transportation electrification, Ava seeks to develop, own, and operate a network of publicly available electric vehicle (EV) hubs consisting of direct current fast chargers (DCFCs) throughout its service territory. Ava’s standard design for an EV charging hub includes a minimum of ten dual port DCFCs at each project site. Ava is interested in locating multiple of these EV charging hubs in Fremont, whereby Ava would pay for the installation, operation, maintenance, and electricity costs associated with the charging hubs, and the City would allow Ava to operate the charging hubs on City property for a period of fifteen years. Staff seeks approval from Council to authorize the City to enter into an agreement with Ava that would allow Ava to pursue locating charging hubs at one or more City-owned locations from a list of twenty-two potential project sites.
BACKGROUND: The transportation sector is responsible for the majority of community- scale greenhouse gas (GHG) emissions within the City of Fremont. Transitioning from combustion vehicles that utilize fossil fuels such as gasoline and diesel to zero emissions vehicles such as electric vehicles (EVs) is an important GHG reduction strategy identified within the recently adopted Climate Ready Fremont plan. In fact, installation of EV charging infrastructure (Measure IN-3 of Climate Ready Fremont) is the single greatest GHG reducing measure identified in the plan, with the ability to achieve twenty-eight percent of the potential GHG emission reductions projected by 2030. Partnering with Ava Community Energy (formerly known as East Bay Community Energy) to install fast charging mobility hubs on public-facing City owned property is identified as a priority implementation item in the Climate Ready Fremont “Game Plan,” with a goal of beginning installation in FY 2024/25.
Ava Community Energy is committed to supporting the implementation of Climate Ready Fremont by pursuing the installation of EV fast charging hubs on City properties. This effort aligns with Ava’s Local Development Business Plan, adopted in 2018, which identifies the development and implementation of electric vehicle infrastructure projects as a means of supporting transportation electrification within its service territory. EV infrastructure is also identified within the State of California’s transportation electrification targets, including:
2.D
Packet Pg. 12
Council Staff Report (ID # 5073) Meeting of February 6, 2024 Updated: 1/31/2024 8:58 AM by Susan Gauthier Page 2
• Achieving 1.5 million Zero-Emission Vehicles (ZEVs) on the road and 250,000 public and shared EV chargers in operation by 2025, and
• Achieving 7.5 million ZEVs on the road approximately and 1.2 million public and shared EV chargers by 2030.
In support of the above goals, on August 25, 2022, the California Air Resources Board (CARB) approved a rule requiring 100 percent of new car sales in California to be ZEVs by 2035. The rule also includes ZEV sales targets for 2026 (35 percent) and 2030 (68 percent).
DISCUSSION/ANALYSIS: Over the next several years, Ava aims to deploy forty to fifty fast charging hubs throughout its entire service area. Each hub is planned to have at least ten Direct Current Fast Chargers (DCFCs). In order to accommodate van-accessible parking spaces as well as supporting electrical equipment, each hub may occupy twelve or more existing parking spaces.
Ava aims to locate DCFC hubs near multi-family properties. Because 47% of the population across Alameda County are renters, Ava is interested in providing publicly accessible charging facilities for renters who may not be able to install charging equipment at home.
Additionally, an analysis by Ava found that 90% of multi-family properties in Alameda County are 50 years old or older and that most lack the infrastructure needed to support EV charging. Multi-family residents could therefore be served by publicly accessible fast charging hubs if located in high-density areas.
In partnership with the City of Fremont, Ava plans to pursue at least one DCFC charging hub at a City property within a high-density area, and likely more depending on feasibility. There are a total of twenty-two potential locations that have been identified by Ava and staff for potential DCFC hubs in Fremont. These locations have been selected because they are under City ownership, are large enough to accommodate the parking spaces needed, and are within proximity of multi-family residents. The twenty-two potential locations identified include:
1. Centerville Community Park: 3375 Country Ln
2. Fremont Main Library: 2400 Stevenson Blvd
3. Bay Street Parking Lot: 4120 Bay St
4. Centerville Train Station: 37260 Fremont Blvd
5. Bill Ball Plaza: 37292 Fremont Blvd
6. Tri-City Volunteers: 37354 Joseph St
7. City Hall: 3300 Capitol Ave
8. Development Services Center: 39550 Liberty St

21. City Government Building: 39701 Civic Center Dr

Once a master site license agreement has been executed between Ava and the City, Ava would begin conducting engineering analysis and coordinate with PG&E to identify which location(s) might be most feasible in terms of electrical capacity and space for new transformers and related equipment. In collaboration with City staff, Ava would then scope one or more projects with the goal of deploying a minimum of ten dual-port 150 kilowatt (kW) DCFCs at each location. At least two, and possibly more, of the charging stalls would be designed as accessible to accommodate vehicles used by those with disabilities, in conformance with the Americans with Disabilities Act (ADA).
FISCAL IMPACT: This project would result in no out-of-pocket cost to the City. In exchange for access to the property and parking spaces, Ava will install all necessary infrastructure and complete site improvements as necessary to enable the operation of each EV fast charging hub. The services provided by Ava would offer a net benefit to the community in terms of additional publicly accessible EV charging infrastructure to service areas where on-site installations at places of residence may prove to be infeasible due to cost, complexity of ownership structure, and/or insufficient electrical capacity.
ENVIRONMENTAL REVIEW: The proposed agreement is statutorily exempt from environmental review pursuant California Environmental Quality Act (CEQA) Guidelines Section 15262 (Feasibility and Planning Studies). Charging hubs to be developed within existing parking areas at sites yet to be determined will likely be categorically exempt from environmental review pursuant to CEQA Guidelines Section 15301, Class 1 (Minor Alteration of Existing Facilities), Section 15303 (New Construction or Conversion of Small Structures), Section 15304 (Minor Alterations to Land), and Section 15311 (Accessory Structures).
ATTACHMENTS: None.
RECOMMENDATION: Authorize the City Manager or their designee to execute a master site license agreement with Ava Community Energy for electric vehicle fast charging hubs and find that the action is exempt from CEQA review.

Executive Summary: The purpose of this report is to initiate the construction of a project to seal cracks in the roadway pavement at various locations citywide, consisting of 13 street segments and totaling 4 miles in length.
BACKGROUND: The City’s Engineering and Street Maintenance divisions jointly monitor the pavement condition of all streets and annually perform two types of pavement treatments:
• Preventive maintenance treatments – Treatments include cape seals, slurry seals, and crack seals, which involve the application of sealant materials over pavements to extend the pavement life at a relatively low cost.
• Rehabilitation treatments – Treatments include pavement overlays and pavement base repairs, which involve the replacement of all or portions of pavements at a relatively high cost. Rehabilitation treatments are typically implemented at the end of the pavement’s useful life.
Sealing cracks is the first step in the City’s pavement preventive maintenance program.
Crack sealing extends the life of asphalt pavement by filling in cracks greater than ¼” in width with a modified asphalt material, which prevents water intrusion into the pavement structure.
DISCUSSION/ANALYSIS: This project will seal pavement cracks along 13 street segments consisting of 4 centerline miles of roadway. The streets included in this crack seal project are also planned to be included in subsequent pavement improvement projects.
Bid Results: Bids were received on December 19, 2023. The bidders with their respective bid amounts are shown below. The Engineer’s Estimate is $130,000.
Bidder Bid
1. Global Road Sealing, Inc. $129,000
2. Pavement Coatings Co. $142,840
3. Bond Blacktop, Inc. $180,530
4. Graham Contractors, Inc. $244,000

Council Staff Report (ID # 5075) Meeting of February 6, 2024 Updated: 2/2/2024 9:29 AM by Susan Gauthier Page 2
The low bidder, Global Road Sealing, Inc., submitted a responsive bid and all documents are in order. The contractor is experienced in this type of work and has satisfactorily completed contracts of similar nature with the City and other public agencies.
Project Costs and Funding:
Estimated Project Costs:
Construction Contract – Low Bid $129,000
Construction Contract Contingency 26,000
Construction Inspection and Administration 19,000
TOTAL ESTIMATED PROJECT COSTS $174,000
Source of Funding:
PWC8195-501 Capital Improvements Fund $5,872,122
TOTAL FUNDS AVAILABLE $5,872,122
Based on the contract amount and project cost estimates, there are sufficient funds budgeted for this project. The budget appropriation used for the Pavement Crack Seal Project will also support other upcoming pavement maintenance projects.
Traffic Control: During implementation of the Pavement Crack Seal Project, City residents and the traveling public will experience some inconvenience during construction. To minimize exposure of vehicles to the pavement work, staff and the contractor will need to limit access and use of the roadways during construction. Individual traffic lanes and, if necessary, project street sections will be closed to traffic briefly in order to perform the pavement work. To mitigate the impact of traffic delays on the public, any lane or street closures will only be allowed during specified hours outside of the morning and evening peak commute hours. The contractor is required to prepare traffic control plans. City staff will review and approve all traffic control plans prior to construction and will monitor traffic control work during construction to minimize the impact to the public. Nearby businesses and residences will also receive notices informing them of the work and any parking restrictions that may be implemented. The contractor will be required to post signs for parking restrictions on project streets no less than 72 hours before the start of work. For locations near schools the contractor will be required to perform the work when school is either not in session or during periods outside of the peak hours when the school pick up or drop off is occurring.
Weed Abatement: This project includes work activities to remove weed growth from pavement cracks prior to the application of crack sealants. In 2023, Public Works updated its construction specification to address best practices for weed abatement within public streets. The project specifications include provisions requiring the contractor to comply with all applicable State laws if chemical herbicides are used. The product is required to be applied at rates recommended by the manufacturer to ensure the efficacy of weed removal while adopting the lowest feasible nozzle pressures and the lowest feasible concentration of chemical herbicide to be used. The spraying of the product is required to be targeted to the locations of existing weed growth. The practice of broadly spraying over entire pavement surfaces will be strictly prohibited. Spraying activities will only be allowed with the direct oversight of qualified City personnel in coordination with the City’s Environmental Services Division. The daily usage of chemical herbicide is required to be reported in conformance to the Regional Water Quality Control Board’s requirements. The specifications also allow the

contractor to use mechanical means to remove weeds, which would avoid or further minimize the need for chemical herbicides.
FISCAL IMPACT: This project will be funded through the Pavement Maintenance account (PWC8195) appropriated for this purpose through the Capital Improvement Program process.
ENVIRONMENTAL REVIEW: This project is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15301 as the repair, maintenance or minor alteration of existing facilities involving no or negligible expansion of use beyond that presently exists.
ATTACHMENTS: None.
RECOMMENDATION: Approval of the following actions related to the 2024 Citywide Pavement Crack Seal Project (PWC8195-W1):
1. Approve the specifications for the project.
2. Accept the bid and award the construction contract to the lowest responsive and responsible bidder, Global Road Sealing, Inc. in the amount of $129,000 and allocate a 20% construction contingency in the amount of $26,000 for a total construction contract amount of $155,000 and authorize the City Manager or designee to execute the contract.
3. Find the project is exempt from review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15301 as the maintenance, repair or minor alteration of existing facilities involving negligible or no expansion of use beyond that presently exists.

STORMWATER CONSULTING SERVICES - Approval of Agreements for On-Call Qualified Stormwater Developer - Qualified Stormwater Practitioner (QSD-QSP) Consulting Services in the Amount of $1,250,000 per Agreement with Keish Environmental, Millennium Consulting Associates, and Surf to Snow Environmental Resource Management, Inc.

E-Mail: [email protected] [email protected]
Executive Summary: The purpose of this report is to facilitate the procurement of stormwater consulting services as needed to support the timely development of projects funded through the City’s Capital Improvement Program (CIP).
BACKGROUND: On-call consultant services agreements are used for services requiring expertise that City staff does not have and/or to supplement City staff during periods of peak work demand. The work performed under these agreements will address Capital Improvement Program (CIP) projects, such as parks and public works projects, to be undertaken in the next five years, many of which will require Qualified SWPPP Practitioner (QSP) and/or Qualified SWPPP Developer (QSD) consulting work. These agreements will allow the City to expediently develop plans, specifications, and budgets without delay to project schedules.
DISCUSSION/ANALYSIS: In October 2023, the City solicited proposals for On-Call QSD- QSP Consulting Services. The selected consultants will work under a five-year Master Service Agreement.
Eleven proposals were received from stormwater consulting firms, listed alphabetically:
BKF Engineers; Diablo Consulting; ENGEO; Hartz Environmental; Kaz and Associates; Keish Environmental; Millennium Consulting Associates; S Kwok Engineers; Surf to Snow Environmental Resource Management (S2S ERM), Inc.; Sandis Engineers; and TRC Engineers, Inc.
An evaluation panel comprised of City staff evaluated all of the proposals based on the completeness of the proposal, project scope and understanding, overall and local experience to perform the required services, evaluation of assigned personnel and their experience, billing rates, and the Consultant’s overall approach.
Based on the results of the evaluation process, staff recommends authorizing the approval of master agreements with Keish Environmental, Millennium Consulting Associates, and S2S ERM, Inc. for professional QSD-QSP consulting services, in the not-to-exceed amount of $1,250,000 each over a period of five years.

Council Staff Report (ID # 5077) Meeting of February 6, 2024 Updated: 2/2/2024 9:35 AM by Susan Gauthier Page 2
FISCAL IMPACT: All task order work issued and work performed by consultants under the on-call Master Service Agreements will be restricted to the funds appropriated and available for the specific project for which the work is required.
ENVIRONMENTAL REVIEW: Environmental review is not required because award of this agreement is not a project within the meaning of California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15061 (b)(3) and 15378(b) as it can be seen with certainty that there is no possibility that award of the contract will have a significant effect on the environment and the award is an administrative activity that will not result in an effect on the physical environment. The projects for which the consultant will provide services will be subject to appropriate environmental review.
ATTACHMENTS: None.
RECOMMENDATIONS: Approve and authorize the City Manager or designee to execute a Master Service Agreement with the following three consultants:
1. Keish Environmental for on-call QSD-QSP consulting services for a total not-to-exceed compensation of $1,250,000 for five years.
2. Millennium Consulting Associates for on-call QSD-QSP consulting services for a total not-to-exceed compensation of $1,250,000 for five years.
3. S2S ERM, Inc. for on-call QSD-QSP consulting services for a total not-to-exceed compensation of $1,250,000 for five years.
4. Find that the actions are exempt from environmental review as a separate and independent base for CEQA compliance, under CEQA Guidelines, Section 15378 (administrative and funding activity not a “project” under CEQA) and Section 15061 (no possibility the activity may have significant effect on the environment).
Environmental review will be conducted as part of the project environmental clearance process, as appropriate.

HUMAN SERVICES DEPARTMENT MASTER FEE SCHEDULE UPDATE - Public Hearing (Published Notice) to Consider Adopting a Resolution Amending the Master Fee Schedule to Update Fremont Family Resource Center Fees.

Name: Alina Kwak Suzanne Shenfil
Title: Family Resource Center
Administrator
Director
Div/Dept: Human Services Department Human Services Department Phone: 510-574-2004 510-574-2051
E-Mail: [email protected] [email protected]
Executive Summary: The purpose of this item is to recommend the City Council amend the City of Fremont Master Fee schedule to adjust room rental fees for the Fremont Family Resource Center in Section V. Human Services, F. Facilities Rental Schedule, Fremont Family Resource Center.
BACKGROUND: The City owns two buildings located at 39155 Liberty Street that house the Fremont Family Resource Center (FRC), and leases space to 24 non-profit, City, County and State programs. These programs provide a variety of integrated services including employment, behavioral health, family economic success services (SparkPoint Fremont FRC), housing, child care, benefit support, health education and social support.
As part of its financial sustainability model, the City rents FRC conference rooms for public and private events. On April 17, 2012, City Council adopted Resolution 2012-22 updating Master Fee Schedule user fees for the Human Services Department, Fremont Family Resource Center (FRC) division.
DISCUSSION/ANALYSIS: During the Covid-19 pandemic, the FRC conference rooms and meeting spaces were upgraded to include new televisions and video conference equipment.
These upgrades allow renters to fully utilize video conference software, such as Zoom and Teams, that have become essential productivity tools for many agencies.
Staff is recommending room rental fees that are consistent with other conference rooms available in the city, including the community centers managed by the Community Services Department (CSD). Accounting for setting, amenities and maximum capacity, the proposed FRC rental fees are comparable to rental fees at various community centers. This ensures internal consistency in rental rates.
Considering these recent amenity upgrades and the review of comparable rental spaces, staff recommends a minimum of $5 per hour increase for each group classification , excluding Group I (City of Fremont) and Group II (Other governmental agencies). Other Governmental Agencies who rent from the FRC outside of normal business hours will be charged actual costs to the City (ACC), typically the costs of the hourly rate of a City of Fremont Building Attendant.

2. Fremont non-profits (Group III) can use the facility four times per calendar year at no cost.
3. Newark and Union City non-profits (Group IV) can use the facility two times per calendar year at no cost.
FISCAL IMPACT: The proposed action would have no impact on the General Fund. The fee schedule modifications outlined in this report allow the City to recover costs associated with use of space, thus offsetting direct and administrative costs.
ENVIRONMENTAL REVIEW: This action is exempt from the requirements of the California Environmental Quality Act pursuant to, without limitation, CEQA Guideline s Section 15378(b)(2), (4) and/or (5), in that it is a government funding mechanism, fiscal or other governmental/administrative activity that has no potential to cause a significant effect on the environment. Background Information:
Why do you wi sh to serve as a member of this Bo ard or C ommission:
I am driven by a deep commitment to fostering inclusivity, equality, and social justice within our community. Joining the Human Rel ations Commission presents an opportunity to advocate for the rights of all individuals, irrespective of their background.
My diverse background as a technology professional, yoga educator, a nd community builder has equipped me with the necessary tools to analyze complex situations, communicate effectively, and propose solutions that prioritize fairness and inclusivity.
I believe a thriving community hinges on respect, understanding, and empathy. Through my involvement in the Human Relations Commission, I aim to actively promote these values by working collaboratively with fellow commissioners, city officials, community leaders, and residents to address issues of discrimination, prejudice, and inequality.
I am excited about the opportunity to serve on the Human Relations Commission and am eager to contribute my time, energy, and dedication to advancing its objectives. Thank you for considering my candidacy, and I look forward to the possibility of working togeth er towards a more just and inclusive Fremont for everyone.
What would you bring by way of perspective or experience to this Board or Commission:
I grew up in India, surrounded by diverse cultures a nd socio -economic backgrounds. This upbringing instilled in me a deep appreciation for inclusivity and respect for all individuals.
Moving to the United States for graduate school amplified my admiration for the country's diversity and equal opportunities.
Choosing Fremont was a deliberate decision due to its diverse population, aligning with my values. As a climate activist and community enthusiast, I founded Buy Nothing Glenmoor in 2017, a thriving community of over 900 members dedicated to sustainability and fo stering neighborly connections through resource-sharing.
Additionally, my role as a yoga and mindfulness educator allowed me to introduce these practices to families in partnership with local libraries. I firmly believe in nurturing compassionate communities through these teachings.
