FREMONT AMENDING FREMONT MUNICIPAL CODE SECTION
10.05.1000 "DECLARED PRIMA FACIE SPEED LIMITS"
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT DOES ORDAIN AS FOLLOWS:
SECTION 1. LEGISLATIVE FINDINGS AND DECLARATIONS.
The City Council hereby adopts the following findings and declarations in support of this ordinance:
A. The City, as authorized by and in accordance with, provisions of the California Vehicle Code previously declared prima facie speed limits for certain street segments within the City as set forth in Fremont Municipal Code ("FMC) Section 10.05.1000.
B. The California Vehicle Code requires engineering and traffic surveys to be conducted periodically in order to change any previously adopted prima facie speed limit and to justify and validate the prima facie speed limits so that they can be posted and enforced through the use of radar or other electronic devices.
C. The City has completed an updated Engineering and Traffic Survey for establishing Speed Limits (the "Survey") for the street segments identified in this ordinance in accordance with the methods and procedures set forth in the California Vehicle Code and the California Manual on Uniform Traffic Control Devices.
D. The updated Survey was conducted by Kimley-Horn and Associates, as set forth in the report entitled "Engineering and Traffic Survey for Speed Limits, dated December 2023. The Survey is included with the council report for this item and a copy is on file with the City Clerk.
E. The Council has considered all relevant information, including the Survey, the council report, oral testimony, and all other information presented during the public hearing, and finds and determines that: (1) the Survey identifies the engineering basis for determining the prima facie speed limits set forth in this ordinance; and (2) the prima facie speed limits as set forth in this ordinance are based upon the speed at which each street segment will facilitate the orderly movement of vehicular traffic and will be reasonable and safe.
