Executive Summary: The purpose of this report is to adopt an ordinance updating Fremont’s parking regulations to incorporate new state legislation and existing California Vehicle Code regulations. The parking regulation updates will allow for enforcement of parking violations that create traffic safety concerns or issues in the community, relating to visibility at street intersections and the height of parked vehicles.
California Vehicle Code (CVC) Section 22507 allows local authorities to prohibit or restrict the stopping, parking, or standing of vehicles, including but not limited to, vehicles that are six feet or more in height within 100 feet of an intersection, on certain streets or portions thereof, during all or certain hours of the day. In order for the City of Fremont to use the legislative authority enabled by AB 413 (intersection daylighting) and CVC 22507 (vehicle height restrictions), the City must adopt an ordinance to incorporate these regulations into the Fremont Municipal Code.
The ordinance was introduced by the City Council at its April 2, 2024 meeting. The ordinance is now before the Council for adoption.

PROPOSED ANNUAL ASSESSMENT FISCAL YEAR 2024/25 CITY OF FREMONT LANDSCAPING ASSESSMENT DISTRICT NO. 88 - Adopt a Resolution of Intention Declaring the Intent to Levy and Collect Assessment for Fremont Landscaping Assessment District 88 for Fiscal Year 2024/25

Executive Summary: Each year, the City of Fremont (“City”) levies annual assessments within Landscaping Assessment District 88 (“District”) for public landscape maintenance.
This District currently consists of 47 zones. These zones encompass subdivision tracts that were approved by the City without requiring the formation of homeowners associations (HOA).
The District maintains public landscaped areas benefiting these subdivisions. Each of the 47 zones in District 88 has an established maximum assessment. Five years ago, more than half of the zones managed by the City were at maximum assessment or within $2 of the maximum assessment. Presently, 68% of the District 88 zones managed by the City are at maximum assessment or within $2 of the maximum assessment. On pages 16 and 17 of the preliminary 2024-25 Annual Engineers Report the difference between current assessments and maximum assessments are shown for each zone. Maximum assessments are not keeping pace with District 88 service costs. The City is prohibited from assessing District 88 property owners above the established maximum assessments without first gaining property owners’ approval through a Proposition 218 ballot procedure. In spring/summer 2021, the City, along with Harris and Associates, completed a Proposition 218 property owner ballot process to restructure and reassess District 88 to support the on-going cost of services. The Proposition 218 proposal for District 88 was unsuccessful. A renewal of services, via Request for Proposal (RFP), will need to be completed in 2024 to further address the assessment cap and service options with property owners (e.g., another Proposition 218 property owner ballot process, restructuring, service changes) as well as the annual administrative assessment work. The current agreement with Harris and Associates supporting these services ends August 2024. Approved funding to support services beyond the annual administrative assessment work was exhausted after the unsuccessful Proposition 218 ballot property owner process.
State law requires two Council meetings to complete the annual assessment process.
At this first meeting, staff recommends the City Council adopt resolutions ordering the preparation and filing of the enclosed annual Preliminary Engineer’s Report detailing calculations of the annual assessments and declaring intent to levy and collect annual assessments. The resolution sets a public hearing on the proposed levy for June 4, 2024.
If the City Council approves the levy at the June meeting, the approved assessments will

Council Staff Report (ID # 5116) Meeting of April 9, 2024 Updated: 4/4/2024 3:01 PM by Susan Gauthier A Page 2
be forwarded to Alameda County for inclusion on property tax bills in July.
BACKGROUND: Levies of ongoing annual assessments and establishment of new landscaping assessment districts are governed by the Landscaping and Lighting Act of 1972 (the ”LLA”). The LLA allows the City to levy and collect assessments for the purpose of funding installation and maintenance of public landscaping and lighting improvements. The amount of the assessments levied on each parcel of land is calculated based upon the special benefit the parcel receives from the improvements.
The County collects the assessment with property taxes and transfers the funds to the City.
The City Council formed the Fremont Landscaping Assessment District 88 in December 1988. This is a citywide district allowing for the creation of individual landscape maintenance zones within the District as a condition of approval of residential subdivision maps. The assessments ensure ongoing maintenance of public landscaping improvements in or adjacent to the subdivisions which improves the appearance of the subdivisions and the City overall. The District currently consists of 47 Zones of which the City manages 41, encompassing subdivision tracts that were approved by the City and did not require the formation of homeowners’ associations (HOA).
On June 24, 1997, the property owners in District Zones 1 through 37 (except for Zones 18 and 22) authorized maximum assessment amounts to be established. In subsequent years, property owners authorized forming Zones 38 through 47 and authorized maximum assessments for them as well. The current 41 active District 88 Zones are 1 through 17, 19 through 21, and 23 through 47. The current 6 inactive District 88 Zones are 18 and 22 as property owner’s majority protests in 1997 and Zones 2, 6, 12, and 16 which are not assessed because City Council approved the homeowners request to maintain the landscaping. The assessment of these 4 zones can be imposed again if the future if homeowners fail to provide adequate maintenance.
The Zone Budgets and maximum assessments are shown in the Preliminary Annual Engineer’s Report on pages 5 through 9. All proposed assessment amounts for Fiscal Year 2024/25 are at or below the maximum established assessments approved by the property owners.
Presently, 68% of the zones managed by the City are at or within $2.00 of the established maximum assessment to maintain the landscaping. With the unsuccessful passing of the restructure and reassessment of District 88, additional zones will eventuall y reach their maximum assessment, meaning more and more zones will become under-funded and decisions about maintenance service level changes will need to be made to keep costs within the capped or available budgets for each zone if there is no change. Addi tionally, capital improvement projects or replacements will be minimal, as assessment revenue will be used to cover regular maintenance service levels. As costs continue to rise due to inflation, the existing maximum assessments, which have not been changed in many years, will be unable to match costs.
DISCUSSION/ANALYSIS: Annual Assessments for Existing Zones in District 88: To start proceedings for levying the annual assessment of District 88 for Fiscal Year 2024/25, the City Council must adopt two resolutions. The first resolution orders preparation of an Engineer’s Report detailing the calculation of the proposed annual assessments. The second

resolution: (1) accepts and approves the Engineer’s Report, which the City Council has received prior to this meeting and which the City Council may modify before approving; (2) states the City Councils’ intent to levy and collect annual assessments; and (3) sets a public hearing for June 4, 2024, for final approval of the proposed assessment amounts for Fiscal Year 2024/25.
Engineer’s Report: Each year since the inception of Landscaping Assessment District 88, staff has prepared and submitted an Engineer’s Report to the City Council. For each zone, the Engineer’s Report lists the expected costs (including a reasonable contingency) for the new fiscal year and a carryover cost. The carryover cost is sufficient to pay for the first six months of maintenance since assessments are not collected by the County until property tax bills become due. The City’s and County’s administrative costs are also included. The total is shown on the gross assessment line of the District budgets. A credit may be applied to each zone, which consists of the projected zone balance as of the end of the current fiscal year, less a reserve fund. The gross assessment less the credit for each zone is divided among its property owners to establish the annual net assessment (Total Balance to Assessment) for each property. Forty-one zones will be assessed in Fiscal Year 2024/25.
The annual assessments per lot vary considerably among the zones because of the difference in size and character of the landscaped areas, and because of the number of lots in the zone. In previous years, the City Council took special action on Zone 2 (nine lots in Tract 5847), Zone 6 (eight lots in Tract 5950), Zone 12 (nine lots in Tract 5558), and Zone 16 (seven lots in Tract 6121) to allow the homeowners in these zones to take responsibility for the landscape maintenance themselves. This action foregoes assessing these zones as long as the homeowners are properly maintaining the landscaping.
Currently, the homeowners in these four zones are maintaining the landscaping in a satisfactory manner.
Historical Annual Assessments, shown on pages 11 through 15 of the Report, list the assessment amounts for each of the previous years for the 41 Zones being assessed. This table also shows the maximum allowable assessment for each Zone.
The notice of public hearing with a Resolution of Intent must be posted and published in a local newspaper, one time, at least 10 days prior to the public hearing according to the Landscape and Lighting Act. At the public hearing, the Council must consider oral and written protests to the assessment. However, the proposed zone assessments for the existing District do not exceed the maximums established for Zones 1 through 47, so a majority protest will be merely advisory to the City Council and will not automatically defeat the proposed assessments.
New Zones: There are no new Zones proposed for the 2024/25 fiscal year.
LLMD funding reserves were allocated in Fiscal Year 2018/19 to hire a consultant, Harris and Associates, to prepare an updated report and other tasks, including the following:
• Review and update the overall program to ensure it continues to meet the requirements of the Landscape and Lighting Act of 1972 and Proposition 218;
• Review and determine the public and private benefit of each lot in LLMD 88;

• Conduct community outreach to share the results;
• Provide updates to each LLMD zone;
• Support changes to the current assessment process (proposed restructure and reassessment);
• Assist with the mailed ballot process and community outreach for the proposed restructuring; and
• Support the annual assessment and engineering reporting requirements.
The task work with Harris and Associates has concluded and this will be the last year supporting the District’s Annual Administrative Consulting Services (agreement expires August 31, 2024). Staff is preparing to renew this service, via RFP, which will includ e a scope of work to work with property owners to address the assessment cap and service options as well as annual administrative services.
FISCAL IMPACT: The 2024/25 annual LLMD assessments are charged to property owners for the City of Fremont to maintain and administer landscaping services within each zone.
Contract costs will continue to be paid by District funding reserves.
ENVIRONMENTAL REVIEW: The recommended action is exempt from and not subject to review under the California Environmental Quality Act (CEQA) because, without limitation, it is not a “project” as defined in CEQA Guidelines Section 15378(b)(2) and/or 15378(b)(5) and as it can be seen with certainty that there is no possibility that the activity may have significant effect on the environment per CEQA Guidelines Section 15061(b)(3), each as a separate and independent basis for CEQA compliance.

20 PART IV – METHOD OF APPORTIONMENT
Method of Apportionment
Street and Highways Code Section 22573 requires tha t maintenance assessments be levied according to be nefit rather than according to assessed value. This section states:
“The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the improvements.”
The 1972 Act permits the designation of areas of be nefit within any individual assessment district if "by reason of variations in the nature, location, and extent of t he improvements, the various areas will received di fferent degrees of benefit from the improvements." (Sec. 22574). Thus, the 1972 Act requires the levy of a true "assessment" rather than a "special tax."
In November 1996, the voters of California adopted Proposition 218, which has been codified as Articles XIIIC and XIIID of the California Constitution. Proposition 218 imposed a number of substantive and procedural requirements on taxes, assessments, and property-related fees imposed by local governments in California. Since the District Assessments were imposed prior to November 5, 1996, they are “grandfathered” under Article XIIID, Section 5(a) of the Constitution, which permits the continuation of assessments existing pr ior to the effective date of Proposition 218. The A ssessments may continue to be levied annually by the City without additional property-owner approval at the rates tha t existed when Proposition 218 went into effect. Any increase above such rates must be in compliance with Proposition 218 and requires property-owner approval.
The method of apportionment described in this Report, and confirmed by the City Council, utilizes commonly accepted engineering practices which have been established p ursuant to the 1972 Act and the California Constitu tion for the allocation of special benefit assessments. The calculation of assessments is based upon the parcel type and the services and improvements provided to equitably apportion the costs based on the special benefit received by each lot or parcel.
The special benefit received by each lot or parcel is over and above any general benefit conferred upon said lots or parcels or to the public at large.
Special Benefit
The improvements and associated costs have been allocated to the assessable properties within the District based upon the special benefit received by those properties. The improvements for which the properties are asses sed have been identified as necessary, were installed and are bei ng maintained as part of the development plans spec ifically for each tract. As such, the improvements and continuing ma intenance and servicing of those improvements are s trictly the obligation of the properties within the District.

21 General Benefit
Although the improvements may be visible to passers by or to the public at large, the improvements were installed as a requirement of the development of the tract and are for the benefit of properties within the District. It has been determined therefore, any access or use by properties or individuals outside the District is completely incidental and the costs of operating, maintaining and servicing said improvements therefore provides no measurable benef it to outside properties or individuals.
Definition of Special Benefit
The method of apportionment described in this Repor t is based on the premise that each assessable parc el or unit receives distinct and special benefits from the imp rovements and services provided, including the visu al desirability provided by well-maintained landscaping. In accordance with Article XIII D, Section 4 of the California Constitution:
“Special benefit means a particular and distinct be nefit over and above general benefits conferred on real property located in the District or the public at large.” The special benefits associated with local landscaping improvements are specifically:
• Enhanced desirability of properties due to proximity and accessibility of the improvements. • Improved aesthetic appeal provided by a positive representation of the development, neighborhood and the community.
• Improved ingress and egress to property resulting in enhanced traffic flow, reduced traffic accidents and consequent reduction of possible property damage.
• Improved traffic visibility and circulation.
• Improved accessibility for emergency vehicles.
• Reduced vandalism and other criminal activity.
• Enhanced environmental quality provided by adequate green space and other landscaping which helps moderate temperatures, reduce noise pollution and control dust and debris.
The proceeds from the assessments are used to fund enhanced maintenance of improvements, services and activities that provide a special benefit to parcels within the Dis trict that, in absence of the assessment, would not otherwise be provided. The District will continue to receive the same level of general service provided to the public at large under City- funded and administered programs, as determined annually, related to the maintenance and servicing of public facilities and improvements (landscaped medians, streetscapes and right-of-way maintenance).
Consistent with the requirements of Section 4 of Article XIII D of the California Constitution that “only special benefits are assessable”, the City will provide the District with additional maintenance services at $0.088 per square foot of landscaped area along arterial or collector streets. The cost is based on the City’s current landscape maintenance contract for areas outside the District. These cost allocations, revi ewed and adjusted annually by the City, are conside red to be “general benefits” and are equal to or greater than the gene ral benefit related to the services being provided. All other maintenance, operations and administrative costs associated with the District, which exceed the City’s contribution to the public at large, are accordingly considered to be “ special benefits” funded by the District assessment s which provide a special benefit to the parcels within the District.” The assessment levied upon each parcel as presented does not exceed the reasonable costs of the proportional special benefit conferred to the parcel.
The table on the following page shows the general b enefit calculation for each Zone where general bene fit applies and the total amount that should be contributed to the District to pay for the general benefit portion of the Zone costs.

The General Benefit Cost per Zone is based on the estimated percentage of landscaping along arterial or collector streets, multiplied by the $0.088 per square foot of landscaping. The cost per square foot determined and provided by City staff, and represents the costs to provide similar landscaping services in other areas of the City. The General Benefit Costs per Zone have been accounted for by the services provided by the City and are therefore not shown on the budget pages.

23 ASSESSMENT RANGE FORMULA
It is generally recognized that most budgetary items will be impacted by inflation in future years. In an effort to minimize the impact this has on maintenance districts, a for mula for inflationary adjustments is typically included as a part of the maximum assessment to be approved by the property owners during the formation of the District. Prior to the passage of Proposition 218 however, inflationary adjustments were not included as a standard part of the formation and approval process. The District was formed in 1988, prior to the passage of Proposition 218, and does not inclu de an inflationary adjustment for the annual assessments.
To impose a new assessment or increased assessment in excess of the Maximum Assessment Rate, the City must comply with the provisions of the California Constitution, Article XIII D, Section 4c that requires a public hearing and certain protest procedures including mailed notice of the public he aring and property owner protest balloting. Proper ty owners must approve the proposed new or increased assessment via a property owner protest balloting process before any such new or increased assessment can be imposed. A protest occurs when, at the public hearing, the returned assessment ballots opposed to the new or increased assessment outweigh the returned ballots in favor of the new or increased assessment, weighting those returned assessment ballots by the financial obligation of each parcel.
The definition of new or increased assessments includes any assessment which, 1) did not previously exist or, 2) exceeds a previously approved assessment amount or assessment range formula. Any assessment range formula must have been previously adopted by the agency and approved by the property owners.

APPENDIX A – ASSESSMENT ROLL
Appendix A
Parcel Identification for each lot or parcel within the District shall be based on available parcel maps and other property data from the Alameda County Assessor’s office as they existed at the time this Report was prepared and adopted by the City Council.
A listing of parcels assessed within the District for Fiscal Year 2024-2025, along with the corresponding assessment amount is shown on the following pages. If any parcel sub mitted for collection is identified by the County A uditor/Controller to be an invalid parcel number for the current fiscal year, a corrected parcel number and/or new parcel n umbers will be identified and resubmitted to the County Auditor/Controller. The assessment amount to be levied and collected for the resubmitted parcel(s) shall be based on the method of apportionment and assessment rate approved in th is Report.
Therefore, if a single parcel has changed to multiple parcels, the assessment amounts applied to each of the new parcels shall be recalculated and applied according to the approved method of apportionment and assessment rate rather than a proportionate share of the original assessment.
Non-assessable lots or parcels include areas of pub lic streets and other roadways (typically not assig ned an APN by the County); dedicated public easements, open space ar eas and rights-of-way, including public greenbelts and parkways; utility rights-of-way; common areas; landlocked parcels; small parcels vacated by the County, bifurcated lots and any other property that cannot be developed or has specific d evelopment restrictions. These types of parcels ar e considered to receive little or no benefit from the improvements and are therefore, exempted from assessment.

Executive Summary: Fremont Municipal Code Section 2.05.060 (the “Municipal Code”) establishes the salaries of the Councilmembers and Mayor and the process for reviewing and implementing compensation increases.
This report provides information supporting a salary increase for the new City Council that will be seated following the November 5, 2024 election.
BACKGROUND: Section 2.05.060 of the Municipal Code establishes the salaries of the Councilmembers and Mayor and the process for reviewing and implementing compensation increases:
“Compensation increases shall be reviewed during each budget cycle and increases shall be considered commensurate with the Consumer Price Index – All Urban Consumers, San Francisco-Oakland-Hayward in an amount not to exceed 4%. Any increase to the Councilmembers’ salaries shall become effective only upon commencement of a new Council term of office following adoption of an ordinance authorizing the increase. Any increase to the Mayor’s additional compensation (the amount that exceeds the Councilmembers’ salary amount) shall become effective as set forth in the ordinance adopting the increase.”
On September 6, 2022, the City Council adopted an ordinance amending the Municipal Code to increase compensation to the current level of $2,427.76 per month for Councilmembers and $4,313.28 per month for the Mayor. The current salaries for the Councilmembers and Mayor became effective upon seating of the Councilmembers elected on November 8, 2022.
California Senate Bill 329, effective January 1, 2024, amended California Government Code Section 36516 to permit adjustments to city council salaries by an amount not exceeding the greater of either five percent for each calendar year from the operative date of the last adjustment of the salary, or based on inflation as measured by the Consumer Price Index, which shall not exceed 10 percent for each calendar year.
As the City Council will soon be adopting the FY 2024/25 operating budget and a new City Council will be seated following the November 5, 2024 election, it is appropriate at this time to consider adoption of an ordinance amending the Municipal Code to increase salaries for

the Councilmembers and Mayor as authorized under Government Code Section 36516, as amended by Senate Bill 329.
DISCUSSION/ANALYSIS: Based on the most recent information from the U.S. Bureau of Labor Statistics, the Consumer Price Index – All Urban Consumers, San Francisco-Oakland- Hayward, has increased from December 2022 through February 2024 at an annualized rate of 3.60%. This annualized rate is less than the 4% limit specified in th e Municipal Code.
Applying the Consumer Price Index annualized rate of 3.6% over the two-year period from December 2022 to December 2024 would result in the Councilmembers’ salaries increasing from $2,427.76 per month to $2,602.56 per month and the Mayor’s salary increasing from $4,313.28 per month to $4,623.83 per month.
This annualized rate does not exceed the 4% limit specified in the Municipal Code and is consistent with California Government Code section 36516, which provides for salary increases in an amount not to exceed five percent per calendar year since the last adjustment of salary.
FISCAL IMPACT: Salary increases would become effective upon the seating of the newly elected City Council in December 2024. The cost of the increased salaries woul d total approximately $9,515 in FY 2024/25. If approved, staff will incorporate these changes into the proposed FY 2024/25 General Fund operating budget.
ENVIRONMENTAL REVIEW: Action on this item is exempt from the requirements of the California Environmental Quality Act (CEQA), per CEQA Guidelines Section 15378(b), as an administrative and/or fiscal activity that does not involve commitment to a specific project that will result in any significant physical impact on the environment.
