Executive Summary: The City’s Safe Software Local Government Subscription Agreement, expires on April 22, 2024. Staff is recommending that the City Council authorize the City Manager, or her designee, to issue a purchase order and to execute implementing and amending documents with Safe Software Inc., for the Annual Software License of the FME Geospatial Extract, Transform, and Load Software Solution in the amount not-to-exceed $160,000 for a 5-year term.
BACKGROUND: The City of Fremont entered into a 3-year Safe Software Local Government Subscription Agreement in 2021. Before 2021, FME tools have been in use by the City since 2006. The amendment to the agreement for a 5-year term extension exceeds $100,000 and requires City Council approval.
DISCUSSION/ANALYSIS: With the Safe Software Local Government Subscription Agreement, the City has gained access to products called Feature Manipulation Engine (FME) Form and FME Flow. FME is primarily a Geospatial Extract, Transform, and Load (ETL) tool. FME is extensively used in department applications for Public Safety (Fire and Police), Community Development, Human Services, Information Technology Services, Community Services, and Public Works.
Software license renewal is exempt from competitive purchasing requirements pursuant to Fremont Municipal Code section 3.20.280(c).
FISCAL IMPACT: Funds are appropriated for the Annual Software License of the FME Geospatial Extract, Transform, and Load Software Solution in the Information Technology Services Department Operating Fund FY 2023/24 operating budget (Fund 620). Funding for subsequent years will be requested as part of the City’s annual budget process.
ENVIRONMENTAL REVIEW: The renewal of computer software licenses is exempt from and not subject to review under the California Environmental Quality Act (CEQA) because, without limitation, it is not a “project” as defined in CEQA Guidelines Section 15378(b)(2) and/or 15378(b)(5) and as it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment per CEQA Guidelines Section 15061(b)(3), each as a separate and independent basis for CEQA compliance.
