Executive Summary: Staff recommends the City Council authorize the City Manager or her designee to execute Amendment No. 2 to Agreement No. 23-0015 to extend the Expanded Learning Opportunities Program Agreement for Transitional Kindergarten/Kindergarten for an additional academic year through 2025, including summer Extended Learning Opportunity Program (ELO-P) camps for summer 2025 at three Fremont Unified School District elementary schools – Brier, Cabrillo, and Grimmer – on a fee for service basis.
BACKGROUND: On January 18, 2023, District retained the services of the City to coordinate and administer the District’s Expanded Learning Opportunities Program (“ELO-P”) expanded after-school program to include transitional kindergarten and kindergarten (TK/K) students as part of the District ELO-P and entered into a Services Agreement No. 23-0015 (hereafter “Agreement”) for a 6-month period.
On May 2, 2023, the District and the City opted to extend the Agreement for an additional one-year academic period, 2023/24, including summer intersessions for ELO-P programming in summer 2023 and 2024.
The ELO-P program provides a structured, safe, and supportive environment for Fremont students that meets their developmental, physical, and social-emotional needs. The City will continue to work closely with FUSD staff to provide pupil-centered, results driven, learning activities that clearly align procedures with that of FUSD. The City will continue to work collaboratively with FUSD in updating the ELO-P Plan reflecting the needs of the community and providing continuous improvement in the ELO-P.
DISCUSSION/ANALYSIS: The City and FUSD intend to continue this partnership and extend the agreement for an additional one-year academic period through school year 2024/25 and include 7 weeks of summer ELO-P programming in summer 2025.
Under the extended agreement, the City will continue to operate after school programming to meet the needs of TK/K students through the ELO-P at the three current ASES sites – Brier, Cabrillo, and Grimmer Elementary Schools.

For the ELO-P summer program, FUSD will reimburse the City in an amount of $152,474 for three sites for supplies and staffing for a 7-week program for initial staffing for 20 students at a ratio of 1 staff member to 10 students and additional compensation per site of approximately $9,686 for each additional staff based on a ratio of 1 staff member to 10 students for over 20 students, and $291.00 per child for supplies.

ENVIRONMENTAL REVIEW: The proposed agreement amendment is not subject to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Providing after school services to children in existing facilities will clearly not have a significant effect on the environment and, thus, CEQA does not apply, and no further environmental review is necessary.
ATTACHMENTS: None.
RECOMMENDATION: Authorize the City Manager or her designee to execute Amendment No. 2 to Agreement No. 23-0015 with the Fremont Unified School District for partnership and services to extend the Expanded Learning Opportunity Program (ELO-P) for Transitional Kindergarten/Kindergarten for an additional academic year through 2025 and intersession ELO-P programming for summer 2025.
