A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FREMONT APPROVING THE ENGINEER’S REPORT,
CONFIRMING DIAGRAMS AND ASSESSMENTS, AND APPROVING
THE LEVY OF ASSESSMENT FOR FREMONT LANDSCAPING
ASSESSMENT DISTRICT 88 FOR FISCAL YEAR 2024/25
WHEREAS, pursuant to Chapter 3 of the Landscaping and Lighting Act of 1972, the City Council on April 9, 2024 adopted a resolution directing Harris & Associates, as the Engineer of Work for Fremont Landscaping Assessment District 88, to prepare and file an annual assessment Engineer's Report (hereinafter “the Report”) for Fiscal Year 2024/25; and
WHEREAS, Harris & Associates filed the Report with the City Clerk on April 9, 2024, as directed; and
WHEREAS, the City Council on April 9, 2024, adopted a resolution of intention to levy and collect assessments for annual assessment within Landscaping Assessment District 88 for Fiscal Year 2024/25; and
WHEREAS, the resolution of intention declared the Council’s intent to accept the Report and set a public hearing for June 4, 2024, in the Fremont City Council Chambers, located at 3300 Capitol Avenue, Fremont, California, and notice of the hearing was given in the time and manner required by law; and
WHEREAS, on June 4, 2024, the City Council conducted a duly noticed public hearing that afforded every interested person an opportunity to be heard and to protest the proposed levy of assessments for Fremont Landscaping Assessment District 88 and the Engineer's Report, and the City Council considered public comments and protests.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT RESOLVES AS FOLLOWS:
SECTION 1. The City Council approves the Engineer’s Report, diagrams and assessments for Fremont Landscaping Assessment District 88 as set forth in the Report and approves the levy of assessments set forth therein for Fiscal Year 2024/25.
SECTION 2. By adopting this Resolution, the City Council approves and directs the levy of assessments for Fremont Landscaping Assessment District 88 for Fiscal Year 2024/25.
SECTION 3. The City Council finds the proposed action exempt from review under the California Environment Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15061(b)(3) (general rule that CEQA applies only to projects that will cause a significant environmental effect) and 15301 (existing facilities).
