Executive Summary: As provided for by the City Attorney’s employment contract, the City Council has requested that the City Attorney receive a four percent salary adjustment equal to the percentage increase being provided to the Fremont Association of Management Employees.
BACKGROUND: City Attorney Rafael E. Alvarado, Jr. has been employed by the City of Fremont as City Attorney since February 2022. The City entered into an employment agreement with Mr. Alvarado on January 12, 2022, and that agreement provides that the City Council may grant Mr. Alvarado periodic general wage increases. The City Council now desires to provide Mr. Alvarado with a four percent salary adjustment commensurate with the negotiated wage increase provided to the Fremont Association of Management Employees in association with the City’s concluded labor negotiations during 2022.
Mr. Alvarado currently receives an annual salary of $341,499 and a bi-weekly salary of $13,134. If this recommended general wage increase is approved, Mr. Alvarado’s new annual salary will be $355,159 or $13,659 bi-weekly.
FISCAL IMPACT: The annual cost of the recommended four percent salary adjustment will be $13,659, which will be absorbed primarily by the General Fund with smaller amounts being absorbed by the Integrated Waste Management Fund and the Risk Management Fund.
ENVIRONMENTAL REVIEW: This action is not a project as defined by Pub. Res. Code Section 21065 and CEQA Guidelines Section 15378(b)(2), as an administrative, fiscal, personnel and policy action. The action is further exempt under CEQA Guidelines Section 15378(b)(4), as the creation of a government funding mechanism or other government fiscal activity that does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment.
