Executive Summary: The purpose of this report is to request authority to amend the Service Agreement with Partners in Communication LLC to increase the not-to-exceed amount to $130,000 and extend the contract through August 31, 2024.

BACKGROUND: The Recreation Services Division of the Community Services Department offers a variety of activities, programs, and events for the community. Providing access to these programs and events to all is required under the Americans with Disabilities Act. This includes but is not limited to providing American Sign Language interpreters to participants who require and request that accommodation. In 2019, Recreation Services posted a Request for Proposals requesting companies to provide this service. Partners in Communication LLC was awarded as the service provider and entered into a 5-year agreement with the City to provide this service based on their proposal.

DISCUSSION/ANALYSIS: The current not to exceed amount for the current 5-year agreement is $90,000. When this agreement was executed, demand for American Sign Language interpretation was low, and $90,000 was anticipated to be sufficient to cover the demand at that time. However, over the last couple of years, demand for this service has increased resulting in the near exhaustion of the current not-to-exceed amount of $90,000.

Based on the increased demand and higher level of camp offerings during the summer season, staff recommends that the City Council authorize the City Manager or her designee to execute an amendment to the Service Agreement with Partners in Communication LLC to increase the total not-to-exceed compensation from $90,000 to $130,000 and extend the agreement through August 31, 2024. A new Request for Proposals has been posted to secure a new multi-year agreement upon expiration of the current Service Agreement.

FISCAL IMPACT: American Sign Language Interpretation services are offered and paid for through the Recreation Services Cost Center and there is no impact to the General Fund.

ENVIRONMENTAL REVIEW: The proposed action is exempt from and not subject to review under the California Environmental Quality Act (CEQA) because, without limitation, it is not a “project” as defined in CEQA Guidelines Section 15378(b)(2) and/or 15378(b)(5) and it has no possibility of a significant effect on the environment, as specified in CEQA Council Staff Report (ID # 5211) Meeting of July 16, 2024 Updated: 7/11/2024 3:04 AM by Dina Lewis Page 2
Guidelines Section 15061(b)(3), each as a separate and independent basis for CEQA compliance.

ATTACHMENTS: None.

RECOMMENDATION: Authorize the City Manager or her designee to execute Amendment No. 1 to Service Agreement 19-0248 with Partners in Communication LLC to increase the not-to-exceed compensation amount to $130,000 and extend the agreement through August 31, 2024.
