RESOLUTION NO. 2024-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FREMONT AUTHORIZING THE CITY ATTORNEY TO EXECUTE A
CERTIFICATION AND INDEMNIFICATION AGREEMENT WITH
THE COUNTY OF ALAMEDA FOR THE COLLECTION OF TAXES
AND ASSESSMENTS FOR FISCAL YEAR 2024/25
WHEREAS, the County of Alameda (“County”), on behalf of the City of Fremont (“City”), collects various property assessments, fees and taxes (collectively referred to as “Assessments”) through the County’s Secured Property Tax Roll; and
WHEREAS, the City’s Assessments that will be placed on the County’s property tax bill for Fiscal Year 2024/25 will include the community facilities districts special taxes, the landscape maintenance district assessments, the clean water protection fee, the paramedic tax, and the Fire Safety General Obligation Bond special tax; and
WHEREAS, Proposition 218, codified in Articles XIIIC and XIIID of the State Constitution, requires the City to comply with requirements regarding Assessments used to finance public facilities and services; and
WHEREAS, in order for the County to collect the City’s Assessments, the County requires the City to sign a Certification and Indemnification Agreement each fiscal year and submit it to the Alameda County Auditor-Controller. A copy of the Agreement is attached to this Resolution as Exhibit A.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT RESOLVES AS FOLLOWS:
SECTION 1. The City Council directs the City Manager or designee to instruct respective City departments overseeing the assessment programs to provide letters to the City Attorney certifying compliance with Proposition 218 prior to execution of the Certification and Indemnification Agreement. The letters will be kept on file with the City Clerk as part of the County Agreement.
SECTION 2. The City Council authorizes the City Attorney to execute, on behalf of the City, the Certification and Indemnification Agreement with Alameda County for the collection of property assessments, fees and taxes for Fiscal Year 2024/25.
