Executive Summary: Staff recommends that the City Council approve the plans and specifications for Central Park Exercise Equipment and Pathway at East Meadow Project; accept the bid of and award the construction contract to Guerra Construction Group for the Base Bid amount of $1,697,847, with 15% Construction Contingency amount of $254,677, for a total Contract amount of $1,952,524; and find the project is exempt from review under California Environmental Quality Act (CEQA) .

BACKGROUND: The proposed project will add a new amenity to Central Park consisting of an outdoor exercise equipment area located between Central Park’s Baseball Sports Complex and Lake Elizabeth. The existing site, Central Park’s East Meadow, is fallow land with several vehicular/pedestrian pathways that are in poor condition. The exercise equipment area will include a fitness rig, individual exercise stations, safety surfacing, synthetic turf exercise area, shade structures, site furnishings, trees, and planting area with new irrigation. The project scope will also include demolition, minor grading and conversion of the existing asphalt and gravel pathways surrounding the proposed exercise equipment area, to a vehicular rated and pedestrian friendly 12’ wide concrete pathways, improving the pedestrian experience, ADA access and connectively within Central Park.

DISCUSSION/ANALYSIS: The proposed addition of exercise equipment station will add a new amenity to Central Park which does not have a dedicated outdoor gym-grade exercise fitness area. Placement of the improved area at the west end of East Meadow positively activates and upgrades the unused portion of the park by turning fallow land into a usable fitness site with planting areas and trees. Pathway improvements adjacent to the exercise area support maintenance of the new site and provide for a vehicle rated surface that requires less maintenance and is durable and improves connectivity to the rest of the park.

ENVIRONMENTAL REVIEW: This project is exempt from the California Environmental Quality Act (CEQA), without limitation, pursuant to CEQA Guidelines Section 15301, Existing Facilities, as the project occurs within an existing area of an established park. The rough and fine grading of the site, installation of sanitary sewer and potable water line, development and paving of pedestrian walkways, and placement of exercise equipment do not expand the park’s boundaries and are typical upgrades to a park use. The area is regularly maintained as a park, which includes discing of the groundcover to maintain soil aeration and prevent habitat development for sensitive or invasive species.

Additionally, the grading and pedestrian pathway improvements qualify for a categorical exemption per CEQA Guidelines Section 15304, Minor Alterations to Land, as no grading is proposed on slopes greater than 10 percent and the proposed landscaping changes do not result in the removal of healthy, mature, scenic trees. Under CEQA Guidelines Section 15303, New Construction or Conversion of Small Structures, the utility extensions are minor modifications and are limited to supporting a new drinking fountain. Lastly, the exercise equipment installation is specifically exempt under CEQA Guidelines Section 15311 as a minor accessory structure appurtenant to an existing institutional facility.

Furthermore, the project is exempt under CEQA Guidelines 15183, Projects Consistent with a Community Plan or Zoning, as the project is consistent with the land use envisioned for the site as established by the General Plan for which an Environmental Impact Report (SCH#2010082060) was previously prepared and certified, and CEQA Guidelines Sections 15162 and 15163, as none of the circumstances requiring preparation of a subsequent or supplemental EIR have occurred. Each of the foregoing provides a separate and independent basis for exemption.
