Executive Summary: On September 10, 2024, the City Council will interview one candidate to fill a vacant District 3 City Council seat created by Councilmember Kassan’s resignation. Following the public interview, the City Council may choose to appoint the candidate or may direct staff to continue the candidate selection and vetting process.

BACKGROUND: On August 22, 2024, Councilmember Jenny Kassan announced her resignation from the Fremont City Council effective upon the appointment of a successor to her Council seat. The Council must take action to fill the vacant seat consistent with the rules/law outlined in California Government Code 36512 and City of Fremont Municipal Code section 2.05.090.

On September 3, 2024, after reviewing several options to fill the vacant seat, the City Council determined that it would interview the candidate that received the second highest number of votes during the 2022 District 3 election. The candidate that received the second most votes in the 2022 election was Kathy Kimberlin.

DISCUSSION/ANALYSIS: In the event that a selection is made on September 10, 2024, and confirmed via Council vote, the appointed Councilmember may be sworn into office and be seated at that same City Council Meeting if that is the direction of the City Council and the candidate is amenable, or they may be seated at the next regularly scheduled meeting.

• Candidate Biographical Material

RECOMMENDATION: Conduct a public interview of the 2022 candidate for District 3 that received the second most votes during that election year and direct staff regarding the Council’s desire for an appointment or additional candidate vetting/selection activity.
