Executive Summary: Section 1.8.8 of the 2022 California Building Code and California Health and Safety Code Sections 17920.5 and 17920.6 allow for the creation of a local building appeals board. The proposed ordinance would create a three-member Building Appeals Board to hear and decide appeals of orders, decisions, and determinations by the Building Official and Fire Chief/Fire Marshall. Staff recommends amending Title 15 (Buildings and Construction) and Title 2 (Administration and Finance) to adopt an Ordinance to create a Building Appeals Board to hear appeals related to the Building and Fire Codes. The ordinance would also establish the Planning Commission as the hearing body for post entitlement appeals pursuant to the Housing Accountability Act.
The ordinance was introduced by the City Council at its September 17, 2024 meeting. The ordinance is now before the Council for adoption.

CITY OF FREMONT SALARY SCHEDULE ADOPTION - Consideration of a Resolution Adopting the City of Fremont's Salary Schedule Contact Persons:

Executive Summary: In order to ensure that the California Public Employees’ Retirement System (CalPERS) will appropriately consider City of Fremont employee compensation earnable (classic members) and pensionable compensation (new members) when calculating retirement benefits, the City of Fremont’s Employee Salary Schedule (or Pay Plan) is required to be identified on a publicly available pay schedule formally adopted by the City Council at a public meeting.
BACKGROUND: Fremont Municipal Code Section 2.25.210 (Salary Entitlement) outlines and codifies the City Manager’s authority to set, approve and amend employee pay ranges as part of a City-wide Salary Schedule. This authority is further outlined and defined in the City of Fremont’s Personnel Rules: Article VI (Compensation). Per this authority, staff requests City Council approval to amend the current salary schedule consistent with classification and compensation changes and local minimum wage requirements. The City currently publishes its salary schedule on its publicly accessible website and the schedule is adjusted and reposted after each amendment.
DISCUSSION/ANALYSIS: The Public Employees’ Retirement Law (PERL) defines compensation earnable for classic members, and the Public Employees’ Pension Reform Act of 2013 (PEPRA) defines pensionable compensation for new members and in doing so require that pay rates be identified in publicly available pay schedules. (Gov. Code § 20636; Gov. Code § 7522.34.)
For a pay schedule to be considered publicly available, California Code of Regulations (CCR) Section 570.5 requires the City’s pay plan meet the following eight criteria:
(1) Be duly approved and adopted by the employer’s governing body in accordance with requirements of applicable public meeting laws;
(2) Identify the position title for every employee position; (3) Show the pay rate for each identified position, which may be stated as a single amount or as multiple amounts within a range;
(4) Indicate the time base, including, but not limited to, whether the time base is hourly, daily, bi-weekly, monthly, bi-monthly, or annually;
(5) Be posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer’s internet website;
2.D
Packet Pg. 18
Council Staff Report (ID # 5237) Meeting of October 1, 2024 Updated: 9/27/2024 7:33 AM by Dina Lewis Page 2
(6) Indicate an effective date and date of any revisions; (7) Be retained by the employer and available for public inspection for not less than five years; and
(8) Does not reference another document in lieu of disclosing the pay rate.
The City’s Human Resources Department is responsible for ongoing compliance with CCR 570.5’s criteria (2) through (8). The City Council’s formal adoption of the pay plan will finalize compliance and further verify that City of Fremont employee salaries are to be considered “earned compensation” for the purposes of retirement/CalPERS reporting.
Human Resources staff will seek Council adoption of the City’s salary schedule from time to time when substantial changes to the salary schedule are being implemented. Each adoption of the salary schedule will incorporate salary changes resulting from any changes implemented by the City Manager consistent with her authorities and responsibilities outlined in Municipal Code Section 2.25.210. The attached salary schedule reflects the following changes:
1) Implementation of the local required minimum wage increase; 2) Implementation of salary increases associated with successor Memorandums of Understanding (MOUs) approved in July 2022;
3) Implementation of salary increases for Unrepresented Fremont Officials (UFO), Unrepresented Management Employees (UME) and Confidential Employees; 4) Classification and compensation changes resulting from organizational and/or market studies.
FISCAL IMPACT: This action is not seeking any specific change to employee compensation, as such changes have already been approved and implemented through bargaining and/or City Manager budgetary authority.
ENVIRONMENTAL REVIEW: City administrative and personnel-related actions, and general policy and procedure making are not a “project” under CEQA, per CEQA Guidelines Section 15378(b)(2).

Executive Summary: The purpose of this report is to approve and authorize the City Manager or her designee to execute a service agreement with Partners in Communication, LLC for American Sign Language interpretive services for the City of Fremont Community Services Department in an amount not to exceed $300,000 through June 30, 2029.
BACKGROUND: The Recreation Services Division of the Community Services Department offers a variety of activities, programs, and events for the community. Providing access to these programs and events to all is required under the Americans with Disabilities Act. This includes but is not limited to providing American Sign Language interpreters to participants who require and request that accommodation.
DISCUSSION/ANALYSIS: A request for proposals (RFP #25-001) was publicly released in July 2024 to provide in-person American Sign Language interpretation services. Three vendors provided proposals -- Interpreters Unlimited, Linguabee, and Partners in Communication -- all three of which met the requirements of the RFP for as-needed interpretation services. The following are price submissions for all three companies:
Interpreters
Unlimited Linguabee Partners In
Communication
Price per hour $135 $156 $125
Minimum hours 2 2 2
Total for 2 hours $270 $312 $250
2 interpreters $540 $624 $500
Cancellation 24hrs+ 48hrs+ 48hrs
The Recreation Services Division recommends entering into an agreement with Partners in Communication as they proposed the best pricing and have familiarity with the City’s Recreation programming and events. Since all three vendors met the requirements of the RFP, other City departments may choose to enter into a separate agreement with any of the three vendors based on their own ASL interpretation needs.

Executive Summary: The City standardizes with Cisco equipment for computer network infrastructure and needs to replace certain components due to aging equipment and /or because the vendor no longer supports the equipment or has issued notice of end of support. The City issued a Request for Bid on August 14, 2024, and received twelve responses.
Staff is recommending that the City Council authorize the City Manager, or her designee, to issue a purchase order and to execute implementing documents with Saitech Inc., for the purchase of Cisco FirePower 3140 and Catalyst 9300 network equipment in the amount of $197,699.77.
BACKGROUND: The City has standardized on Cisco equipment for its computer network consisting of switches, firewalls, and wireless access points. Several components of the network are outdated and require replacement.
DISCUSSION/ANALYSIS: The Information Technology Services Department is responsible for providing computer network infrastructure that departments use to access software applications and systems for conducting City business and communication, and to support free Wi-Fi planned in the six commercial districts infrastructure. The typical useful life of network equipment components ranges from 5 to 10 years. The equipment being replaced at this time includes a switch and firewalls that protect the City’s system from outside threats such as cyber-attacks, switches for the City’s primary data center, and wireless access points. The current equipment can no longer effectively and efficiently provides network connectivity needed for City services or the planned free Wi-Fi in commercial districts.
The existing firewall continues to effectively block illegitimate traffic from the network; however, Cisco has announced that it will no longer support the current firewall after September 2025. The replacement network switches will increase the speed to transmit data between computers, servers, and switches from 1 gigabit per second to 10 gigabits per second to accommodate the increasing use of electronic data and online web applications to conduct City business, deliver services, and free internet access for constituents.

HOMELESS ENCAMPMENT AND ILLEGAL DUMPING ABATEMENT CONTRACT - Approve a 3-year, not-to-exceed $2,500,000 contract for Homeless Encampment and Illegal Dumping Abatement Services with Art Cuevas Landscaping and find that the project is exempt from review under the California Environmental Quality Act (CEQA) per CEQA Guidelines 15304 (Minor Alterations to Land) and 15307 (Actions by Regulatory Agencies for Protection of Natural Resources) Contact Persons:
Name: Kathleen Cote-Guarnieri Dan Schoenholz

E-Mail: [email protected] [email protected]
Executive Summary: Homeless encampment abatement services are necessary to preserve public health and safety, and to comply with obligations the City has under its stormwater permit. Staff conducted an RFP to continue abatements after the City’s existing contract with Art Cuevas Landscaping Services expires on September 30, 2024. Six service providers responded, with Art Cuevas Landscaping Services being the highest rated proposer based on the RFP criteria. Staff is recommending executing a contract with Art Cuevas Landscaping Services for encampment abatement services from October 1, 2024 through June 30, 2027.
The recommended contract is $2,500,000. The contract includes an option to extend for two additional years, but the proposed contract amount is for the base term only. If extended, staff would return to the City Council for authorization to exercise the option and recommend a contract payment reflecting the City’s service needs at that time.
The proposed contract amount reflects City staff’s determination on the applicable prevailing wage rate. The Department of Labor Relations does not publish a prevailing wage rate for encampment abatement workers, so staff has selected the most applicable rate category from the published wage schedules. The City received a protest letter to its notification of intent to award the contract to Art Cuevas Landscaping Services, on the grounds that the existing contract, and presumably the new contract, did not use the correct prevailing wage rate. The City investigated and based upon recent law, revised the prevailing wage reflected in the contract to include loaded benefits. Staff is recommending denial of this bid protest.
Staff is recommending an additional appropriation of $160,000 in the Integrated Waste Management (IWM) Fund (Fund 115) to cover the additional costs. There will be no General Fund Impact.
BACKGROUND: Fremont’s storm drain system, like most Bay Area cities and counties, is regulated by a National Pollutant Discharge Elimination System (NPDES) Permit, issued by the San Francisco Regional Water Quality Control Board. This permit, commonly referred to as the Municipal Regional Permit (MRP), imposes requirements intended to reduce impacts to water quality from urban runoff. The MRP includes obligations to implement actions to

Packet Pg. 57

prevent trash and debris from entering the City’s waterways and meet trash reduction targets specified in the permit. The permit also includes requirements to prevent adverse water quality impacts from illegal dumping and homeless encampments.
To preserve the public health and safety and comply with obligations the City has under the MRP, City staff monitor approximately 200 previously or currently active homeless encampment sites throughout Fremont. Approximately 25-30% of sites are active at any given time. Staff also monitors sites prone to illegal dumping. These sites are assessed and included in the weekly abatement schedule as needed.
Homeless encampment and illegal dumping abatements were initially conducted one to two days every two weeks but have increased as the City’s homeless population and need for additional abatement services has expanded. Currently, the City conducts abatements three days per week with enhanced cleanups often including burned vehicle or illegal structure dismantling, occurring approximately every six weeks.
DISCUSSION/ANALYSIS: The recommended contract will continue the City’s homeless encampment abatement activities at existing levels. This includes approximately 153 abatement days, 7,900 abatement manhours, $80,000 estimated disposal costs and anticipated use of specialized equipment, such as a dump truck and skip loader.
The proposal evaluation consisted of a pass/fail assessment on seven components of proposal content requirements plus a numerical score for five components including qualifications, proposal feasibility, hourly billing rate, proposer’s understanding of the work and exceptions taken to the City’s standard services agreement.
Art Cuevas Landscaping Services was the respondent with the highest score based on the evaluation criteria and staff released an Intent to Award Notification for RFP #24-030 Homeless Encampment and Illegal Dumping Abatement to Art Cuevas Landscaping.
Sharjo LLC, dba ServiceMaster Restoration Services, submitted a formal protest letter under FMC section 3.20.330, claiming that Art Cuevas Landscaping was non-compliant with prevailing wage law.
Staff investigated the protest and determined that the prevailing wage rate for Group 3A (Determination NC-23-102-1-2024-1A) with a rate of $70.41 per hour (including benefits) effective July 1, 2024, is applicable to the work solicited. Staff clarified that the financial proposal submitted by Art Cuevas Landscaping Services complies with that prevailing wage determination. Therefore, staff is recommending denial of the protest and awarding the contract to Art Cuevas Landscaping Services.
Under the proposed contract, the contractor duties and responsibilities would continue to include the following services on a weekly schedule:
• Clean-up duties of trash removal, dismantling of makeshift structures, and removal of inhibiting vegetation.
• Providing labor, materials, tools, equipment, personnel, transportation, and supervision of workers.
• Coordination with City on a site-by-site basis to determine work order for each encampment clean-up.
• Removal of debris and self-hauled materials for disposal to the Fremont Recycling and Transfer facility.

Council Staff Report (ID # 5243) Meeting of October 1, 2024 Updated: 9/13/2024 7:55 AM by Dina Lewis Page 3
• Work to be performed under the Agreement is subject to State prevailing wage and labor law and contractor must be registered with the California Department of Industrial Relations to perform public work under Labor Code section 1725.5.
The City’s responsibilities would continue to include:
• Surveying homeless encampment sites and illegal dumping sites to determine site conditions and schedule sites for clean-up.
• Tagging and posting at homeless encampment sites with the “Notice of Cleanup” notice placards that provides a minimum of a 72-hour notice. • Police MET team assistance at some locations during both postings and abatements. • Notifying contractor with clean-up project notifications that include detail and relevant information.
• Photographing posted notices, and before and after the clean-ups. • Providing and coordinating any safety requirements for road closures in accordance with OSHA safety regulations on an as-needed basis to safely remove debris at sites. • Inspecting the homeless encampment sites on public property to determine personal property observed and removed, and follow the “Policy on Unattended Property located on Public Property or R-O-W.”
In summary, the proposed contract will ensure the continuation of homeless encampment and illegal dumping debris abatement at current levels through June 30, 2027.
FISCAL IMPACT: Homeless encampment abatement work is funded from the IWM Disposal Differential in the IWM Fund (Fund 115). $612,000 was included in the approved FY 2024/25 operating budget. Staff is recommending an additional appropriation of $160,000 from the IWM Disposal Differential fund balance to cover the additional costs.
There will be no General Fund Impact.
ENVIRONMENTAL REVIEW: The proposed abatement of homeless encampment and illegal dumping waste is exempt from further environmental review under the California Environmental Quality Act (CEQA) Guidelines Section 15304 as the project consists of trash removal with possible minor alterations to land or vegetation that will result in improvement of habitat for fish and wildlife resources and Guideline 15307 as the cleanups will protect the City’s waterways from trash and other discharges in to the waterways and other water resources.
ATTACHMENTS: None.
RECOMMENDATIONS:
1. Find that the project is exempt from review under the California Environmental Quality Act (CEQA) per CEQA Guidelines Section 15304 (Minor Alterations to Land) and Guidelines Section 15307 (Actions by Regulatory Agencies for Protection of Natural Resources).
2. Deny the bid protest submitted by Sharjo, LLC dba ServiceMaster Restoration Services regarding the non-compliance of Art Cuevas Landscaping with prevailing wage law.
3. Authorize the City Manager, or her designee, to execute a contract with Art Cuevas Landscaping for homeless encampment and illegal dumping abatement services from October 1, 2024, through June 30, 2025 in an amount not-to-exceed $2,500,000.

Executive Summary: Staff is recommending that the City Council authorize the City Manager, or her designee, to enter into an Agreement, and to execute implementing documents with Granicus, LLC, for the RESPOND Constituent Relationship Management (CRM) Solution Renewal in an amount not to exceed $240,410.73 for a three-year term.
BACKGROUND: In Fiscal Year 2019/20, the ITS Department implemented RESPOND CRM, a Constituent Relationship Management solution for the City. This system serves as a virtual City Hall, centralizing constituent interactions and enhancing civic engagement. Residents can submit inquiries or service requests via a mobile app, a self-service portal, or a website, utilizing features like geo-tagging and photo attachments to enable more precise issue reporting. Integrated with Esri GIS, the system improves request tracking and resolution.
City staff benefit from streamlined workflows, and a knowledge base, which improve transparency and service delivery, making city services more accessible and responsive. The total amount for the RESPOND CRM software license renewal exceeds $100,000 and requires City Council approval.
DISCUSSION/ANALYSIS: The City’s CRM RESPOND system serves as a virtual City Hall, improving service delivery to the public. This web-based platform is a centralized hub for managing constituent interactions, functioning as a 24/7 digital front desk. By consolidating constituent information into one accessible database, City staff can manage inquiries and service requests. The system’s workflow automation assigns cases to the appropriate departments based on the nature of the request, ensuring the right teams handle tasks.
Residents are able to submit inquiries from anywhere, anytime, using various channels such as the City-branded mobile app, self-service portal, or website. These digital options enable constituents to connect with the City in their preferred way. The mobile app, with features like real-time reporting, photo uploads, and geo-tagging using the City’s Esri GIS system, help provide more precise and reliable issue reporting. Additionally, the CRM's knowledge base equips City staff with quick access to solutions for everyday inquiries, speeding up issue resolution. The CRM software system is scalable, thus allowing the system to grow with the City’s changing needs as the population and demand for services increase.

Executive Summary: The purpose of this report is to facilitate the replacement of the sewer pipe system at the Aqua Adventure Water Park concession stand. This project also includes the upgrading of the Concession Stand light fixtures with LED fixtures to meet Title 24 – Building Energy Efficiency Standards.
BACKGROUND: The Aqua Adventure Water Park is a 3-acre family-oriented waterpark, located in Central Park constructed in 2009. Aqua Adventure operates annually from late May through September and hosts corporate and group outings as well as birthdays, parties, family reunions, and special events.
DISCUSSION/ANALYSIS: The Concession Stand Building at the Water Park consists of a kitchen, locker, storage, janitorial and food prep rooms, all of which have floor drains connected to an existing sanitary sewer system. Maintenance staff recently received a report of flooding in the building. Upon investigation, it was noted that the cast iron sewer line has corroded /deteriorated to a point where floor drains can no longer drain to the sewer pipe. The project will include demolition of existing flooring as needed to replace all existing sanitary piping in the concession stand area. The new polyvinyl chloride (PVC) piping system to be installed will be better suited for a water park environment with heavy use of chlorine. In addition, existing lights throughout the concession stand will be replaced with LED light fixtures. Construction is anticipated to begin in October 2024 with completion scheduled for January 2025.
Bid Results: Bids for this project were opened on August 27, 2024. The bidders with their respective bid amount are shown below. The Engineer’s Estimate is $85,000.

Bid Protest: James Day Construction, Inc. dba Coastal Mountain Electric, the second apparent low bidder, has submitted a bid protest within the applicable time period (see attached letter). Staff has reviewed the bid protest and as discussed below and finds it without merit. Therefore, staff recommends rejecting the bid protest and awarding the contract to Smelly Mel’s.
The James Day Construction, Inc. protest letter states Smelly Mel’s bid failed to acknowledge the addendum and didn’t list any subcontractors for electrical and epoxy flooring work. A physical signed copy of the addendum was included on the ninth page of Smelly Mel’s submitted bid. Regarding the subcontractors list, Smelly Mel’s carries the required contractor’s licenses to self-perform the included trades. Staff’s response to the bid protest is attached to this report.
For the reasons set forth above, staff recommends that the City Council reject James Day Construction, Inc.’s bid protest as without merit, and award the contract to Smelly Mel’s Plumbing, Inc. as the lowest responsive and responsible bidder.
FISCAL IMPACT: This project is to be jointly funded from the Capital Replacement for Parks project (PWC8501) and from the Recreation Cost Center Operating Improvement Reserve (Fund 189). The Operating Improvement Reserve supports improvements to revenue generating park facilities. With the recommended use of both funding sources, there will be sufficient funds available for the estimated project cost.
ENVIRONMENTAL REVIEW: Action on this item is exempt from environmental review.
The project is categorically exempt from environmental review based on, without limitation, CEQA Guidelines Section 15301, and 15301(a). The replacement of the corroded sewer line involves negligible or no expansion of use or capacity, which does not involve significant new environmental effects or changed circumstances.

NOTICE OF FORMAL BID PROTEST PROJECT PWC 8501 WATER PARK CONCESSION
STAND SEWER AND LIGHTING REPLACEMENT
Dear Sirs,
On August 27 2024 a bid opening was held for the above referenced project. There were a total of three bidders. James Day Construction placed second in this effort. We wish to protest the bid on the following issues.
1. The low bidder Smelly Mel’s Plumbing did not recognize addendum one on his bid. The addendum clearly says that it must be acknowledged on the bid proposal. This makes Smelly Mel’s bid non responsive.
2. Smelly Mel wrote N/A on the subcontractors list. This job contained numerous trades and some specialty trades. Included in this job were drywall, epoxy flooring, painting, concrete and electrical. California state law requires bidders to list a subcontractor if the subcontract amount is above ½ of 1 percent of the overall bid. We find it unlikely that Smelly Mel can perform all these trades in house and call your attention to the following.
A. The project is approximately 20% electrical work. State law requires that this work be done by a licensed electrical contractor. Smelly Mel does not hold a C-10 license and did not list an electrical subcontractor.
B. The epoxy flooring is a specialized trade and most product require a certified installer. It is unlikely that Smelly Mel holds these qualifications.
Based on the above factors we request that Smelly Mel’s Plumbing’s bid be considered as non responsive.
Best regards,
Bryan Mann

Re: PWC 8501 Water Park Concession Stand Sewer and Lighting Replacement Bid Protest
Dear Mr. Mann:
The City of Fremont received your September 3, 2024, letter, submitted on behalf of James Day Construction, Inc., protesting the City’s intent to award the above-referenced contract to Smelly Mel’s Plumbing, Inc. (Smelly Mel’s). Your letter states that Smelly Mel’s bid failed to recognize the addendum and failed to list any subcontractors, in particular electrical and epoxy flooring.
A physically signed copy of the addendum was included on the ninth page of Smelly Mel’s submitted bid.
Smelly Mel’s carries the following license classifications: A, B, C16, and C36. Per the California Business & Professions Code Division 3, Chapter 9, Article 4, Section 7057.c, the only specialty licenses that a contractor holding a general B license cannot perform are C16 and C57. Smelly Mel carries A & B licenses, which allows him to self-perform electrical work without the need to have a C-10 license. Epoxy flooring does not require specific contractor’s license, and a certification can be obtained prior to installation.
Therefore, the City will proceed with its determination that Smelly Mel’s bid is responsive. The City staff will recommend to City Council to award the contract to Smelly Mel’s as they are the lowest responsive and responsible bidder.
Sincerely,
Jimmy Y. Chen

VACATION OF EASEMENT AT 49000, 49036 AND 49086 MILMONT DRIVE - Adopt a Resolution Summarily Vacating Public Utility Easements, Emergency Vehicle Access Easements, and Slope Easement at 49000, 49036 and 49086 Milmont Drive in the Bayside Industrial Community Plan Area (PLN2023-00190) and Make Findings of CEQA Exemption

Executive Summary: The purpose of this report is to facilitate the development of an industrial building project by vacating various easements that are no longer needed.
BACKGROUND: On November 16, 2022, the Zoning Administrator approved a Ministerial Design Review to allow the construction of a 267,098 square foot industrial shell building at 49000 – 49090 Milmont Drive. To fulfill conditions of approval of the Ministerial Design Review, Milmont Owner LLC, the property owner and developer of the project, commonly known as Milmont Landing, has submitted an application for the vacation of two Public Utility Easements (PUE), two Emergency Vehicle Access Easements (EVAE), and a Slope Easement (see Exhibits A, B, C, D, and E) on their property. The PUEs and EVAEs proposed for vacation were dedicated to the City by Grant of Easements recorded March 11, 2022 and by Parcel Map 3942 recorded on April 25, 1984. The Slope Easement was dedicated to the City by Grant of Easement recorded August 27, 1970. In order to facilitate the vacation of the PUEs, EVAEs, and Slope Easement, Milmont Owners LLC has agreed to grant a new EVAE, which meets City requirements and accommodates the site design of the project. The resolution of vacation shall be recorded only after Milmont Owners LLC dedicates a new EVAE to the City (Exhibit F). The vacation shall be effective immediately with the recordation of the resolution of vacation.
DISCUSSION/ANALYSIS: California Streets and Highways Code Section 8330 – 8334.5 allows the City to summarily vacate a public service easement when it is “superseded by relocation, or determined to be excess by the easement holder, and there are no other public facilities located within the easement.” City staff have determined that the PUEs are no longer needed and there are no other public facilities located within the easement, the Slope Easement is no longer necessary for construction and maintenance of cut and fill slopes at the property, and that owner will dedicate a new EVAE to supersede the two EVAEs to be vacated.
Notification to Utility Companies: All concerned utility companies have been notified and consented to the proposed vacation of the Public Utility Easements per Exhibit A and B.
FISCAL IMPACT: None.

DRAFT
RESOLUTION NO. 2024-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FREMONT SUMMARILY VACATING PUBLIC UTILITY
EASEMENTS, EMERGENCY VEHICLE ACCESS EASEMENTS,
AND SLOPE EASEMENT AT 49000 – 49090 MILMONT DRIVE, IN
THE BAYSIDE INDUSTRIAL COMMUNITY PLAN AREA
(PLN2023-00190), AND MAKING A FINDING OF CEQA
EXEMPTION
WHEREAS, the Owner/Applicant of the property located at 49000 – 49090 Milmont Drive is requesting approval of a summary vacation of the Public Utility Easements, Emergency Vehicle Access Easements, and Slope Easement described and depicted in Exhibits A, B, C, D, and E, attached and incorporated herein by this reference; and
WHEREAS, pursuant to California Streets and Highways Code Section 8333(c), the legislative body of a local agency may summarily vacate a public service easement when it is superseded by relocation, or determined to be excess by the easement holder, and there are no other public facilities located within the easement; and
WHEREAS, the Emergency Vehicle Access Easements being vacated will be reestablished at another location (see Exhibit F) prior to the recordation of the resolution of vacation.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT RESOLVES AS FOLLOWS:
Section 1. The City Council approves the summary vacation of the Public Utility Easements, Emergency Vehicle Access Easements, and Slope Easement described and depicted in Exhibits A, B, C, D, and E, which are hereby vacated in accordance with Public Streets, Highways and Service Easements Vacation Law, Chapter 4, Part 3, Division 9 of the California Streets and Highways Code (Section 8300 et seq.), based upon the following findings and conditions:
A. The City Council finds, based on the information contained in the council report and presented by staff, that the Public Utility Easements, Emergency Vehicles Access Easements, and Slope Easement being vacated are no longer needed, have been superseded by relocation, constitute excess land, and there are no other public facilities located within the easements.
B. The vacation shall conform to Exhibits A thru E (Legal Description and Plat for Public Utility Easements, Emergency Vehicle Access Easements, and Slope Easement Vacations).
C. Prior to the recordation of the current Emergency Vehicle Access Easement vacation, the Owner/Applicant shall dedicate a new Emergency Vehicle Access Easement as described in Exhibit F, which shall supersede by relocation the vacated easement.

Section 2. The City Council finds that the vacation of the easements is not a “project” as defined under CEQA Guidelines section 15060(c) (action will not result in physical change in the environment or increase the use of the site). Even if determined to be a project under CEQA, the action is exempt from environmental review, each as a separate and independent basis for purposes of CEQA compliance, under CEQA Guidelines, Section 15305 (minor land alterations), and Section 15061(b)(3) (common sense exemption for actions where there is no possibility that they may have a significant effect on the environment).
Section 3. The City Clerk is directed to cause a certified copy of this resolution, attested by her under seal, to be recorded in the office of the County Recorder of Alameda County after the above conditions are met.

Executive Summary: This is a recurring report regarding emergency repairs currently underway to address major water leaks in the men’s shower room of the Fremont Police Center building. The City Manager authorized emergency action and approved award of an emergency contract that was solicited through a streamlined procurement process. In accordance with law, the City Council must make regular findings, by a four fifths vote, that the emergency continues until the work is completed and the emergency is terminated by the Council.
BACKGROUND: In June 2024, the City’s Building Maintenance staff received a report of water leaks and flooding in the men’s shower room of the Police Center. The showers when in use were flooding the area creating a slipping hazard and limiting the use of the showers and nearby police lockers. The leaks were coming from within the floor and foundation of the building and risked further damage, costly repairs, and more service disruption to a critical building in charge of public safety operations.
Immediate action was necessary to investigate and repair the leaks. Public Works received approval from the City Manager to proceed with an emergency contract and waive compliance with formal bidding requirements for non-emergency public works projects, which generally take approximately three months to complete. Staff subsequently issued an informal Request for Quotations for the Police Department Shower Repair Project (Project).
SDM Construction, Inc. submitted the only bid and immediately started work on the Project.
The work began in July 2024 and is scheduled for completion in October 2024. All the showers had to be demolished, and the contractor had to excavate to approximately six feet below the existing concrete to find the leaks caused by deteriorated sewer pipes. The leaks have been resolved and the old sewer pipes have been replaced with new sewer resilient PVC piping. The remaining work consists of rebuilding the showers and replacing the damaged flooring of the corridor leading to the police officers’ lockers. The work will be completed when the impacted part of the facility is restored back to its functional state. The total project cost is estimated at $300,000.
DISCUSSION/ANALYSIS: In accordance with the Public Contract Code Section 22050 and Fremont Municipal Code Section 3.20.290, the Fremont City Council has delegated authority to the City Manager to order emergency action to protect city interests and to waive formal bidding requirements for emergency contracts. A written determination must be made supported by substantial evidence that an emergency exists, that immediate action must be

taken to resolve the emergency, and that the action to be taken is directly related to resolving the emergency. Applicable law defines an emergency as a “sudden, unexpected occurrence that poses a clear and imminent danger, requiring action to prevent or mitigate the loss or impairment of life, health, property, or essential public services.”
On June 14, 2024, the City Manager made the emergency determinations required based on facts and information provided by staff and included in this report, and authorized award of an emergency contract to immediately address the emergency.
When the City Manager approves an emergency action, the law requires that the City Council take action to review the emergency and make a finding, by a four-fifths vote, that the emergency continues until it has been resolved. The Council must continually review the emergency at every regularly scheduled meeting and terminate the emergency when appropriate. Accordingly, this item will remain on the council agenda until such time the emergency action can be terminated.
Staff recommends that the Council review the emergency action authorized by the City Manager, and find that the emergency continues until the work on the project has been completed and the Police Department facilities have been restored to full use.
FISCAL IMPACT: The total estimated project cost of $300,000 was funded through the Capital Budget appropriation for major building facility maintenance projects (PWC8393).
Staff will provide an update on the cost of the repairs at a future City Council meeting once all repairs have been completed.
ENVIRONMENTAL REVIEW: The project is Exempt from review under the California Environmental Quality Act (CEQA) pursuant to CEQA guidelines section 15269(b), related to emergency repairs needed to maintain essential services.
ATTACHMENTS: None.
RECOMMENDATIONS:
1. Accept the staff report.
2. Review the conditions of the emergency and make a finding, by a four-fifths vote, that the emergency continues until the work on the Emergency Plumbing Repair at Police Center Project has been completed.
3. Find that the action is exempt from CEQA review pursuant to CEQA Guidelines Section 15269(b), as emergency repairs needed to maintain essential services.

FIELDTURF CLASS ACTION LITIGATION SETTLEMENT - Authorize the Submission of a Claim Form for $120,000 in Credit for FieldTurf Artificial Turf Marketing and Sales Practices Class Action Litigation

E-Mail: [email protected] [email protected]
Executive Summary: Authorization is sought for the submission of a claim form for $120,000 in credit for the FieldTurf Artificial Turf Marketing and Sales Practices Class Action Litigation.
BACKGROUND: The City purchased and installed FieldTurf, a synthetic turf system, from FieldTurf Inc. at Irvington Community Park in 2007; Centerville Community Park in 2011; and Karl Nordvik Community Park in 2014. Although the products were advertised as durable, with an expected life of at least ten years, the turf showed signs of excessive wear after only three years. In 2017, the City joined a class action lawsuit as a named plaintiff and alleged FieldTurf knowingly misrepresented the durability of their products for years as they sold synthetic turf to the City of Fremont and other customers. The class action lawsuit has recently moved towards resolution in a settlement.
DISCUSSION/ANALYSIS: The parties recently reached a settlement that was approved by the U.S. District Court, District of New Jersey, which offered two tiers for claims. Tier 1, which requires the claimant to have made a complaint regarding the wear on the turf to FieldTurf, offers a settlement of $7,500 cash payment or $50,000 credit with FieldTurf. Tier 2, which addresses fields that have not been fully replaced and the claimant did not make a complaint about wear to the turf to FieldTurf, offers a settlement of $2,000 cash payment or $20,000 credit with FieldTurf.
The City has two Tier 1 claims and one Tier 2 claim. Staff recommends taking the credit for all claims, for a total of $120,000 credit with FieldTurf, to be spent on future synthetic turf replacements or maintenance of the turf fields at Irvington, Centerville, Karl Nordvik, or Central Park Fields 9 & 10.
FISCAL IMPACT: A total credit of $120,000 would offset future costs of purchasing replacement or maintenance of synthetic turf carpet that would otherwise be paid for by park facilities funds or the general fund depending on the item or service contracted.
ENVIRONMENTAL REVIEW: The requested action is not subject to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15378 and pursuant to CEQA Guidelines section 15061(b)(3) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Since it can be seen with certainty that there is no

possibility that the proposed action may have a significant effect on the environment, the activity is not subject to CEQA.

RECOMMENDATION: Authorize the City Manager or her designee to submit a claim form for $120,000 in credit for settlement of the FieldTurf Artificial Turf Marketing and Sales Practices Class Action Litigation.
