CONCRETE REPAIRS AND INTERSECTION RAMPS PROJECT - Approval of the Plans and Specifications and Award of Contract to Terocons, Inc. in the Amount of $2,828,653 (Including 12% Contingency) for the 2025 Citywide Concrete Repairs and Intersection Ramps Project (PWC8483-I); Make Findings of CEQA Exemption.

Executive Summary: The purpose of this report is to initiate the construction of a project to: perform concrete repairs to damaged curbs, gutters, sidewalks, and driveways; and install curb ramps at various locations citywide.
BACKGROUND: The five-year Capital Improvement Plan (CIP) includes funds for concrete repairs in the City. Typically, these repairs have included replacement of sidewalk, curb, gutter, and driveway approaches as well as tree root pruning and tree replacements (as needed).
Under the current program, the Maintenance Operations Department receives and addresses citizen requests for sidewalk area repairs. When the issue is deemed to be a significant safety concern, the Maintenance Operations Department can then make temporary repairs with either an asphalt patch or by concrete grinding, or in select cases, make permanent repairs by replacing the sidewalk. Property owners have the option of performing sidewalk repairs at their own cost with permits from the City and can benefit from incentives offered by the City’s 50-50 reimbursement programs. As enabled by State law, the City’s Municipal Code designates responsibility for sidewalk and street tree conditions to the adjoining property owner. The areas with the most serious or highest concentration of problems, which demand more resources to address, become candidates for contractual concrete repair projects, implemented by the Public Works Department.
The City of Fremont Capital Improvement Program also includes funds to construct intersection curb ramps in compliance with the Americans with Disabilities Act (ADA). Ramp locations are determined from a combination of citizen requests, pavement work that requires new ramps to be installed, and safety needs identified by the Safe Routes to School program.
DISCUSSION/ANALYSIS: The project scope includes:
• Concrete repairs to 136 locations consisting of street segments where concrete damage is highly concentrated and individual citywide locations where damage is especially severe.
• Construction of 200 ramps at 97 locations throughout the City. The project will install ramps at intersections where none currently exist or where existing ramps, built

COUNTY LEASE AMENDMENT AT FRC - Approval of a Four-Year Lease Amendment with the County of Alameda for a Total of 4,867 Square Feet of Office and Common Area Space at the Family Resource Center; Exempt from CEQA Review per CEQA Guidelines Section 15301.

Executive Summary: The purpose of this report is to support the continued occupancy of the Alameda County Social Services Agency at the Fremont Family Resource Center (FRC).
BACKGROUND: The Fremont Family Resource Center (FRC) is an innovative project comprised of non-profit, city, county and state agencies that provide a variety of integrated services including employment, housing, childcare, health education and social support. The City owns two buildings located at 39155 Liberty Street that house the FRC and leases to, among other tenants, the Alameda County Social Services Agency (County). The County has been a tenant at the FRC providing essential social services to local residents since 1999 , and the current lease with the Alameda County Social Services Agency has been on a month-to-month basis since September 1, 2023. The County has now requested a lease extension. The County occupies 4,867 square feet under the lease, including 3,863 square feet of exclusive office space and 1,004 square feet of shared common area space.
DISCUSSION/ANALYSIS: As the County provides essential services to local residents, its continued tenancy at the FRC is highly desired. Through the Alameda County Social Services Agency, the County provides cash assistance to the local economy through benefits programs such as CalWORKS and CalFresh; makes health insurance available to more than 78,000 people through the Medi-Cal program; provides in-home care to seniors through the Area Agency on Aging Program and foster care to thousands of children; handles child abuse and neglection cases; and provides emergency shelters to people who are in need. In addition, the County is considered an anchor tenant because it is the FRC’s largest tenant, leasing approximately 36% of the FRC’s total square footage.
The proposed lease amendment with the Alameda County Social Services Agency is a four-year lease at an initial rate of $2.99 per square foot per month, for approximately 4,867 square feet of office and common area space, for total rent of $14,552.33 per month ending August 31, 2027. In addition to the monthly rent, the County will pay approximately $612.54 per month to cover their pro rata share of the cost of a security guard. The County is proposing that all other current lease terms remain in effect during the four-year extension. This includes yearly lease rate adjustments based upon changes in the Consumer Price Index (CPI). The amendment also keeps in place provisions which allow the County and City to terminate the lease upon six-month prior written notice.

Executive Summary: Since 2019, the Alameda County Probation Department (ACPD) has contracted with the City to provide services funded by the Juvenile Justice Crime Prevention Act (JJCPA) for youth in ACPD’s Community Supervision Program (Program). This Program serves at-promise (at-risk) youth who are on formal Probation and under Community Supervision, as well as the parents of these youth. The City partners with Seneca Family of Agencies (Seneca) to provide Trauma Focused Cognitive Behavioral (TF-CBT) Groups and Parenting Classes in the South County service area (Fremont, Union City, Newark, and San Leandro) to youth in the Program. ACPD has requested to extend its current agreement with the City through June 30, 2025.
The purpose of this report is to recommend that the City Council:
1. Authorize the City Manager to execute a Fifth Amendment with ACPD to extend the term through June 30, 2025, and for the additional amount of $56,268, increasing the total not-to-exceed amount from $397,179 to $453,447.
2. Authorize the City Manager or her designee to execute a Third Amendment to a sub-contract with Seneca to extend the term through June 30, 2025, for the additional amount of $36,451, increasing the total not-to-exceed amount from $191,449 to $227,900.
3. Appropriate an additional $56,258 to the Alameda County Probation Youth Diversion Fund (Fund 133).
BACKGROUND: For many years, ACPD has contracted with the City’s Human Services Department (HSD) Youth and Family Services (YFS) Division to provide counseling, case management and truancy intervention services under a Delinquency Prevention Network (DPN) contract, to Juvenile Justice involved youth and their families.
Since 2019, ACPD has also contracted with the City for YFS to provide Juvenile Justice Crime Prevention Act (JJCPA) funded services, including Trauma Focused Cognitive

Behavioral (TF-CBT) Groups and Parenting Classes, for youth in ACPD’s Community Supervision Program (Program). This Program serves at-promise (at-risk) youth who are on formal Probation and under Community Supervision and the parents of these youth.
Due to the broad scope of JJCPA funded services being provided, the higher-level needs of youth in this specialized Program, and the large service area, the City currently partners with Seneca to deliver services in the South County service area, which includes Fremont, Union City, Newark and San Leandro. In 2022, Seneca absorbed Girls, Inc., the City’s original partner.
Since their original Agreement, the City and ACPD have executed four amendments over the years, extending the term of the agreement through December 31, 2024, and increasing the not-to-exceed amount to $397,179.
Concurrently, the City and Seneca have executed two amendments to their agreement, extending the term of the agreement through December 31, 2024, and increasing the not-to-exceed amount to $191,449.
DISCUSSION/ANALYSIS: The goal of the services provided through the Program is to help youth successfully complete Probation requirements, gain life skills, reduce symptomatic behaviors, improve social relationships and prevent youth recidivism. Most youth in ACPD’s Community Supervision Program have experienced traumatic events and, as a result, have negative symptomatic behaviors that contribute to their social, emotional and educational instability. The parents of these youth have also faced many challenges and need significant support.
The proposed Fifth Amendment with ACPD will extend the term of the Agreement through June 30, 2025, and increase the not-to-exceed amount by additional $56,268 to support existing counseling and administrative positions across the two partner agencies, including City staff. It also covers all non-personnel and operating costs associated with running the Program. The City, as the primary contractor, will collect all administrative overhead costs.
The proposed Third Amendment to the sub-contract with Seneca will extend the term through June 30, 2025, and increase the not-to-exceed amount by an additional $36,451.
FISCAL IMPACT: There will be no impact to the General Fund. As part of the FY 2024/25 Adopted Operating Budget, the City Council appropriated $55,479 in the ACPD Probation JJCPA account of Alameda County Probation Youth Diversion Fund (Fund 133). Staff recommend an additional appropriation of $56,268 to Fund 133 to reflect the additional funding authorized in the Fifth Amendment.
ENVIRONMENTAL REVIEW: This action is not a project subject to California Environmental Quality Act (CEQA) review pursuant to, without limitation, CEQA Guidelines section 15378 as it is an administrative governmental activity that will not result in direct or indirect physical change in the environment.

Executive Summary: City staff have worked with Ava Community Energy to prepare plans and agreements for the installation of solar and batteries at six City facilities: Fire Station 1, Fire Station 9, the Family Resource Center, Age Well Center at Lake Elizabeth, Age Well Center at South Fremont and the City-owned building at 37350 Joseph St. housing the Tri City Volunteers food bank. The installations would be financed through a Power Purchase Agreement (PPA) between the City and Ava Community Energy. The PPA would allow a third-party developer (consisting of a team including Fremont-based Gridscape Technologies) to own, operate, and maintain the generating equipment and the City would agree to host the systems and purchase the electric output for 25 years. The project is an implementation action of both the updated Climate Action Plan (“Climate Ready Fremont”) and the City’s Hazard Mitigation Plan.
BACKGROUND: East Bay Community Energy (EBCE) formed in 2016 as a joint powers authority to provide cleaner, greener energy at lower rates to Alameda County customers.
EBCE started providing electricity to customers in 2018 and has expanded to include communities in San Joaquin County. In 2023, the name was changed to Ava Community Energy (Ava) to better reflect the larger service territory. Ava’s goals include local control and oversight, driving investment in renewable energy, and improving resilience of local communities. To help advance these goals, Ava is offering a procurement program called the Critical Municipal Facilities program, to deploy solar/battery microgrids at member agencies’ facilities.
On July 6, 2021, the City Council adopted a resolution authorizing the City Manager to pursue deployment of solar and battery energy systems at critical municipal facilities in partnership with Ava.

Council Staff Report (ID # 5268) Meeting of December 3, 2024 Updated: 11/27/2024 12:04 PM by Dina Lewis Page 2
Across Ava’s service area, more than 300 critical municipal facilities were analyzed to determine the feasibility of solar and battery energy storage systems to meet critical loads in times of grid outages. In Fremont, approximately forty critical municipal facilities were initially identified as potential microgrid locations.
After excluding sites that were due for significant retrofitting, rebuilding, or likely redevelopment, six sites in Fremont (described in the Discussion section, below) were selected as part of the procurement project portfolio.
The project schedule is divided into two phases based on the third-party developer’s capacity while also maximizing the financial savings generated by the project. Of Fremont’s six proposed sites, two (the two Age Well Center sites) are included in Phase 1 and are scheduled to be operational by April 2026. To achieve that operational date, the current schedule requires the PPA to be executed by the end of 2024.
The schedule for completion of the remaining four sites has not been finalized but is expected to trail the first phase by 1-2 years.
DISCUSSION/ANALYSIS: There are 30+ project sites across six cities participating in this program. Ava designed the Resilient Municipal Critical Facilities program to reduce barriers to local governments for the deployment of solar and storage by providing technical expertise and staff time and aggregating cities’ small solar projects into a larger portfolio to take advantage of bulk purchasing, a streamlined contracting process, and better pricing.
The primary objective of this program is to add resilience to municipal facilities, allowing them to operate emergency loads using solar and storage technologies during a grid outage.
Battery systems will also allow facilities to “island”, or isolate, from the grid during a Public Safety Power Shutoff (PSPS) event or other grid outage. The battery systems will provide eight or more hours of backup service under normal usage, 2.5 hours of backup service at maximum usage, and potentially infinite backup power with solar recharging and reducing demand to essential operations only.
Similar solar/battery microgrids were installed at three Fremont fire stations in 2018/19 with help from a California Energy Commission grant and have proven to provide reliable and clean backup power with no negative impact on operations.
The six sites proposed for upgrades are:

Power Purchase Agreement (PPA) – Under a PPA model, a PPA provider pays for the installation, operations and maintenance of the solar and battery energy storage systems, and the City pays an agreed upon price per kilowatt-hour (kWh) for power generated. Staff has negotiated the key terms of the PPA between the City and Ava. Ava will contract with Green Bridge Energy as the project owner and contractual counterparty. Green Bridge Energy has in turn selected Fremont-based Gridscape Solutions as its developer. (It should be noted the City contracted with Gridscape for the three CEC-funded fire station microgrids installed in 2018/19 and that the company has performed well to-date). With support from Gridscape, Green Bridge Energy will install, own, operate and maintain the solar and battery systems. The solar will be placed either on building rooftops or on carport structures in parking lots, depending on site-specific considerations.
Key Terms of the PPA:
• There are no upfront costs to the City.
• The City will make monthly payments to Ava for the kilowatt hours of electricity received from the solar and batteries.
• The proposed Power Purchase Agreement (PPA) establishes a Year One photovoltaic (PV) electricity rate of $0.3616 per kilowatt-hour for four of the six designated locations: the Family Resource Center, Tri-City Volunteer, Fire Station #1, and Fire Station #9. The remaining two locations, the Age Well Center North and the Age Well Center South, will have a Year One rate of $0.3152 per kilowatt-hour. Additionally, the proposed kWh rates will include a 2.5% annual escalation over the 25-year term of the agreement.
• The Year 1 City PPA Annual Storage cost is set at $10.25 per kW per month, with a
2.5% annual escalation rate applied consistently over the 25-year term.
• The City’s total payments over the 25-year contract, in combination with regular electricity and natural gas bills, will be less than they would be without the project. • The City will only pay for the electricity received from the systems. Furthermore, if the equipment delivers less than 85% of the expected annual power output from the system, Ava would make cash payments to the City to offset the City’s costs in procuring needed power. This provision provides additional incentive to Ava and in turn GreenBridge/Gridscape to maintain the systems in good working order. • The PPA grants Ava and its contractors a license to access the solar and battery systems for monitoring and maintenance purposes.
• Gridscape will ensure that all contractors, subcontractors, and employees hired or contracted by Gridscape which will perform work on the projects will be paid prevailing wages.
Climate Ready Fremont and Hazard Mitigation Plan

Council Staff Report (ID # 5268) Meeting of December 3, 2024 Updated: 11/27/2024 12:04 PM by Dina Lewis Page 4
Council adopted an updated Climate Action Plan (entitled “Climate Ready Fremont”) in October 2023. Climate Ready Fremont includes a “Game Plan” that identifies priority actions to be completed in the first three years of implementation. Partnering with Ava to install solar/battery microgrids at City facilities is one of the actions called for in the Game Plan as it furthers the goals of carbon neutrality and community resilience embedded in Climate Ready Fremont.
Council also adopted an updated Hazard Mitigation Plan (HMP) in November 2024. The HMP includes a list of prioritized Mitigation Actions. One of the identified Mitigation Actions is to maintain and expand auxiliary power capabilities at critical City facilities, which would be furthered by the proposed solar/battery microgrid project.
Single Source Procurement
The proposed PPA with Ava, described above, is a single source procurement. Staff recommends that the City utilize California Government Code Section 4217.10, et seq., which allows for the expedited procurement of energy conservation projects by municipal agencies as long as the energy project is determined to provide financial savings over the operating lifetime.
Specifically, Code Section 4217.10 et seq authorizes public agencies to enter into an energy service contract without competitive bidding, provided that there is a two-week public notice before the authorization of the procurement and the cost of the conservation services provided by an energy conservation facility will be less than the anticipated marginal cost of energy that would have been consumed in the absence of the project. (see Government Code Section 4217.12)
FISCAL IMPACT: The proposed projects will increase the resiliency of critical facilities by using clean electricity generated and stored on site to perform essential operations during power outages. In addition to that primary benefit, the City can anticipate a reduction in utility costs. The City currently pays approximately $248,000 per year for electricity at the six sites. Assuming grid-purchased rates increase at 4.5% per year (the historic average of electric rate increases), the City would pay approximately $11,000,000 for electricity for the six sites over the next 25 years absent the PPA. With the PPA, which fixes annual rate increases at 2.5% Ava estimates the six proposed projects will generate total savings of nearly $900,000 over the 25-year life of the PPA.
The project developer, Gridscape Technologies, is a Fremont-based company. In addition to the direct benefits of the project to the local economy from employment, material purchases, etc., the project will also serve as a catalyst for the continued growth of a local company, further benefiting the local economy.
ENVIRONMENTAL REVIEW: The proposed project is exempt from the requirements of the California Environmental Quality Act (CEQA) per, without limitation, on a separate and independent basis, Public Resources Code 21080.35, Guideline 15301 (Existing Facilities), 15303 (New Construction or Conversion of Small Structures), and 15311 (Accessory Structures).

Background Information:
Why do you wish to serve as a member of this Board or Commission: As a resident of Fremont, and somebody who extensively uses the parks, courts, playgrounds, and other recreational facilities, I would like to be involved with the decision-making. I realized how fortunate I was to be less than 10 minutes walking distance from two parks and would love to see more of our residents have at least one park meet that criterion. Having filled Newark’s coffers by utilizing Silliman when my children were younger, I would love to see Fremont develop an athletic center with a pool, gym, weights, indoor athletic facilities.
____________________________________________________________________________
What would you bring by way of perspective or experience to this Board or Commission: I have served on the PTAs of all three public schools attended by my children. Before coming to CA I was a volunteer naturalist who gave presentations on nature (flora, fauna, geology, natural history) to the public and was also on the board of the Boulder County Nature Association. I would bring the “parent perspective”, the “nature perspective”, the end-user “recreation citizen” perspective, and now, the “senior citizen” perspective,
