RESOLUTION NO. 2025-_____
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FREMONT
AMENDING THE WARM SPRINGS / SOUTH FREMONT COMMUNITY
PLAN (PLN2025-00065) AND MAKING FINDINGS OF CEQA
EXEMPTION/NO FURTHER ENVIRONMENTAL REVIEW REQUIRED
WHEREAS, on July 22, 2014, the City Council adopted the Warm Springs / South Fremont Community Plan (“ WS/SF Community Plan”), which implements the General Plan vision of a vibrant, innovative, and sustainable employment -based urban center that allows industrial, research and development, residential, office and convention, retail and entertainment, and public facility uses in the approximately 879-acre area that surrounds the then-under-construction Warm Springs / South Fremont Bay Area Rapid Transit (BART) station; and WHEREAS, on July 22, 2014, the City Council adopted a resolution certifying the WS/SF Community Plan Environmental Impact Report (EIR) (State Clearinghous e No. 2013032062) , adopted Findings of Fact that determined that the EIR had been prepared in compliance with the California Environmental Quality Act (CEQA) , and adopted a Statement of Overriding Considerations and a Mitigation Monitoring and Reporting Program based on an evaluation of the potential impacts associated with implementation of the WS/SF Community Plan; and WHEREAS, on July 22, 2014, the City Council adopted as part of the WS/SF Community Plan a requirement that projects larger than five acres in obtain approval of a Master Plan to show how applicable land use targets w ould be achieved, how new streets and b icycle and pedestrian pathways interconnect with the overall street network, and provide an acceptable plan for interim land uses for undeveloped land; and
WHEREAS, the City is proposing amendments to the WS/SF Community Plan that would repeal the requirement of a Master Plan; and
WHEREAS, on November 21, 2024, the Planning Commission held a public hearing to consider the recommended approval of the proposed WS/SF Community Plan amendments to the City Council; and
WHEREAS, on December 17, 2024, the City Council held a public hearing to consider the recommendation of the Planning Commission regarding the proposed amendments to the WS/SF Community Plan.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT RESOLVES AS FOLLOWS:
SECTION 1. CEQA
The City Council finds that the proposed WS/SF Community Plan amendments are exempt from the requirements of CEQA pursuant to CEQA Guidelines Section 15061(b)(3) in that the amendments do not have the potential to cause a significant effect on the environment and CEQA

Guidelines Section 15183 in that the amendments are consistent with the general plan and zoning and otherwise meeting the requirements of that exemption; and that each of these findings would qualify on a separate and independent basis.
SECTION 2. FINDINGS FOR AMENDMENT OF COMMUNITY PLAN
The City Council finds that the proposed amendments are consistent with the General Plan and would maintain the purpose, intent, and effectiveness of the WS/SF Community Plan.
SECTION 3. AMENDMENT OF COMMUNITY PLAN
The City Council hereby amends the WS/SF Community Plan as more particularly shown on Exhibit “A” to this resolution, as included in the PLN2025-00065 staff report presented to the City Council at their December 17, 2024 hearing.
SECTION 4. SUBSTANTIAL CHANGES
Any substantial amendments to the WS/SF Community Plan shall be presented to the Planning Commission and City Council, respectively, for consideration and approval.
SECTION 5. EFFECTIVE DATE
The effective date of this resolution shall be ____________________.
