Executive Summary: Staff recommends the City Council authorize the City Manager or a designee to execute the Enrichment Program Services Agreement between the City of Fremont and the Fremont Unified School District (FUSD) through August 2026, consisting of afterschool, intersession and summer enrichment learning programs for FUSD students in grades TK through eighth, on a fee for service basis.

BACKGROUND: The California Department of Education (“CDE”) apportions state funding to local education agencies, including the FUSD, to provide an Expanded Learning Opportunities Program (“ELO-P”), consisting of afterschool and summer school or intersession learning programs for students in grades transitional kindergarten (“TK”) through eighth, and focusing on developing the academic, social, emotional, and physical needs and interests of pupils through hands-on, engaging learning experiences, and complement, but not replicate, learning activities in the regular school day and school year.

The City operates enrichment camps and programs (“Programs”) for students in grades TK-8, with students engaging in hands-on learning activities, leadership opportunities, and teambuilding skills in structured, safe and supportive environments; providing participants options that stimulate their interest and growth and meet their developmental, physical, and socio-emotional needs.

FUSD and the City desire to enroll FUSD students that are eligible for ELO-P in the City’s Recreational Division’s enrichment programs throughout Fremont through August 2026.

DISCUSSION/ANALYSIS: FUSD will cover program fees for eligible students to enroll in City of Fremont Recreation Division Programs pursuant to this Agreement. Eligible students may enroll in the courses offered by the City of Fremont Community Services Department ’ Recreation Division. The Recreation Division lists available courses through regular newsletters and their website, http://www.RegeRec.com.

FUSD ELO-P students will have their program fees paid for at specific levels based on determination of eligibility through FUSD. FUSD will reimburse the City for program fees for Council Staff Report (ID # 5334) Meeting of January 14, 2025 Updated: 1/8/2025 8:28 PM by Susan Gauthier A Page 2
eligible students. Funding for this program is provided by ELO-P funds allocated by the CDE to FUSD.

FISCAL IMPACT: Under this proposed Agreement, FUSD will reimburse the City in an amount not to exceed $500,000 through August 2026 for ELO-P eligible students for grade TK–8 students.

FUSD will cover the tuition and material fees for each category of ELO-P eligible students up to the following total:
• English Learner-eligible students: Up to $1000/student • NSLP-eligible students: Up to $2000/student
• Foster Youth, McKinney-Vento Program, and Migrant Program eligible students: Up to $3000/student
• Foster Youth, McKinney-Vento Program, and Migrant Program eligible students:

FUSD may permit reimbursement totals beyond the $3000/student limits for these eligible students. FUSD will notify the CITY of any exceptions to this limit.

The City shall submit invoices to FUSD itemizing and clearly identifying all charges.

Payments to FUSD shall be made within thirty days after City staff submits a detailed invoice to FUSD.

Revenue and expenditures for the current year were included in the Recreation Cost Center (Fund 189) FY 2024/25 adopted operating budget. Staff will include next year’s revenue and expenditures in the FY 2025/26 proposed operating budget.

ENVIRONMENTAL REVIEW: The proposed agreement is not subject to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Providing enrichment services to children in existing facilities will clearly not have a significant effect on the environment and, thus, CEQA does not apply, and no further environmental review is necessary.

ATTACHMENTS: None.

RECOMMENDATION: Authorize the City Manager or designee to execute the Enrichment Program Services Agreement between the City of Fremont and the Fremont Unified School District for partnership and services consisting of intersession, afterschool and summer programs through August 2026 for Transitional Kindergarten through eighth grade students, on a fee for service basis.
