RESOLUTION NO. 2025-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FREMONT AMENDING THE GENERAL PLAN BY CHANGING THE
LAND USE DESIGNATION FOR THE PROPERTY LOCATED AT
SOUTHEAST CORNER OF FREMONT BOULEVARD AND ICE HOUSE
TERRACE FROM REGIONAL COMMERCIAL TO TECH
INDUSTRIAL AND MAKING CEQA FINDINGS AND ADOPTING A
NEGATIVE DECLARATION
WHEREAS, a project applicant has proposed a General Plan Amendment (GPA) to change the land use designation of the property located at the southeast corner of Fremont Boulevard and Ice House Terrace from Regional Commercial to Tech Industrial in conjunction with an application to rezone the property to Tech Industrial (I-T); and
WHEREAS, a Negative Declaration was prepared and circulated in compliance with the California Environmental Quality Act (CEQA), and
WHEREAS, the Planning Commission held a noticed public hearing on the project including the GPA on December 12, 2024, after which the Commission recommended that the City Council approve the GPA and the project, as proposed, by a vote of 7-0; and
WHEREAS, the City Council held a noticed public hearing on January 14, 2025 on the project, and considered the reports and documents presented by City staff, the Planning Commission’s deliberations, and the written and oral comments presented at the public hearing.
WHEREAS, in accordance with Government Code Section 65358, the City Council finds that it is in the public interest to adopt the GPA.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT RESOLVES AS FOLLOWS:
SECTION 1. The City Council finds that the proposed General Plan Amendment is consistent with the General Plan and furthers the public interest, convenience, and general welfare of the City as described in the January 14, 2025 City Council staff report.
SECTION 2. The General Plan of the City of Fremont, and more particularly the General Plan Land Use Diagram, is hereby amended to change the land use designation of the property located at the southeast corner of Fremont Boulevard and Ice House Terrace from Regional Commercial to Tech Industrial, as more particularly depicted on Attachment 1, attached hereto and made a part hereof.

The City Council hereby finds, in accordance with CEQA Guidelines Section 15074 that it has considered the Negative Declaration as shown in Exhibit “A” to the January 14, 2025 City Council staff report, together with any comments received during the public review process, that is was prepared in accordance with the requirements of CEQA, that there is no substantial evidence that the project will have a significant effect on the environment, and that this action reflects the independent judgment and analysis of the City of Fremont. Based upon the foregoing and all evidence in the record, the City Council hereby adopts the Negative Declaration. The Director of Community Development shall file a Notice of Determination with the County Clerk in accordance with the CEQA guidelines.
SECTION 4. The Director of Community Development is directed to file a certified copy of the amendment to the General Plan of the City of Fremont with all public entities specified in Government Code Section 65352 and any other public entities that submitted comments on the proposed General Plan Amendment, including but not limited to the Board of Supervisors and the Planning Commission of the County of Alameda and the planning agency of each city within the County of Alameda abutting the area covered by the proposal. The filing of a certified copy of this resolution constitutes compliance with this section.
