ORDINANCE NO. XX-2025
AN ORDINANCE OF THE CITY OF FREMONT REZONING A 4.2-ACRE
SITE AT THE SOUTHEAST CORNER OF FREMONT BOULEVARD
AND ICE HOUSE TERRACE FROM REGIONAL COMMERCIAL (C-R)
TO TECH INDUSTRIAL (I-T), TO ALLOW D E V E L O P M E N T O F AN APPROXIMATELY 69,872-SQUARE-FOOT INDUSTRIAL BUILDING AND
MAKING FINDINGS OF ADOPTION OF NEGATIVE DECLARATION
WHEREAS, a project applicant has proposed a General Plan Amendment (GPA) to change the land use designation of the property located at the southeast corner of Fremont Boulevard and Ice House Terrace from Regional Commercial to Tech Industrial in conjunction with an application to rezone the property to Tech Industrial (I-T); and
WHEREAS, a Negative Declaration was prepared and circulated in compliance with the California Environmental Quality Act (CEQA), adopted by Resolution of this City Council of even date, and
WHEREAS, the Planning Commission held a noticed public hearing on the project including the GPA on December 12, 2024, after which the Commission recommended that the City Council approve the GPA and the project, as proposed, by a vote of 7-0; and
WHEREAS, the City Council held a noticed public hearing on January 14, 2025, on the project, and considered the reports and documents presented by City staff, the Planning Commission’s deliberations, and the written and oral comments presented at the public hearing; and
WHEREAS, all legal requirements for adopting the proposed ordinance have been met.
THE CITY COUNCIL OF THE CITY OF FREMONT DOES ORDAIN AS FOLLOWS:
SECTION 1. ZONING MAPS AMENDED
The Zoning Maps of the City of Fremont, codified as Fremont Municipal Code Title 18, Chapter
18.35 (Zoning Maps), Section 18.35.010, are hereby amended by rezoning property located at the southeast corner of Fremont Boulevard and Ice House Terrace, as more particularly shown on the PLN2024-00080 rezoning attached hereto and incorporated herein as Attachment 1, from Regional Commercial (C-R) to Tech Industrial (I-T).
SECTION 2. CALIFORNIA ENVIRONMENTAL QUALITY ACT COMPLIANCE
The City Council hereby finds, in accordance with CEQA Guidelines Section 15074 that it has considered the Negative Declaration as shown in Exhibit “A” to the January 14, 2025 City Council

staff report, together with any comments received during the public review process, that was prepared in accordance with the requirements of CEQA, that there is no substantial evidence that the project will have a significant effect on the environment, and that this action reflects the independent judgment and analysis of the City of Fremont. The Director of Community Development shall file a Notice of Determination with the County Clerk in accordance with the CEQA guidelines.
SECTION 3. EFFECTIVE DATE
This ordinance shall take effect and will be enforced thirty (30) days after its adoption.
SECTION 4. PUBLICATION AND POSTING
The City Clerk has prepared and published at least five days before the date of adoption a summary of this ordinance once in a newspaper of general circulation printed and published in Alameda County and circulated in the City of Fremont. A certified copy of the full text of the ordinance was posted in the office of the City Clerk since at least five days before this date of adoption. Within 15 days after adoption of this ordinance, the City Clerk shall cause the summary to be published again with the names of those City Council members voting for and against the ordinance and shall post in the office of the City Clerk a certified copy of the full text of this adopted ordinance with the names of those City Council members voting for and against the ordinance.
The foregoing ordinance was introduced before the City Council of the City of Fremont at the regular meeting of the City Council, held on the ___ day of _________, and finally adopted at a regular meeting of the City Council held on __________, 2025, by the following vote:
