DRAFT

RESOLUTION NO. 2025-XX

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FREMONT

ADOPTING THE FREMONT ACTIVE TRANSPORTATION PLAN
WHEREAS, the purpose of an Active Transportation Plan (ATP) is to provide an overarching framework and guidance for the implementation of projects and programs that support and encourage walking and biking in the City of Fremont (City); and WHEREAS, General Plan Mobility Element Policy 3-2.5 directs the City to regularly maintain and implement a master plan addressing pedestrians and bicycling; and

WHEREAS, the City Council approved the Fremont Pedestrian Master Plan on December 13, 2016, and the Bicycle Master Plan on July 10, 2018; and

WHEREAS, the City is required to update its Pedestrian Master Plan, Bicycle Master Plan, or a combined Active Transportation Plan, every five years, based on an agreement with the Alameda County Transportation Commission (ACTC), to receive Measure BB and Vehicle Registration Fee (VRF) Bicycle and Pedestrian Program Funds; and

WHEREAS, as the policies, programs, and projects identified by these plans are largely interdependent and complementary, City staff recommends consolidation of the plans under an Active Transportation Plan; and

WHEREAS, adoption of a combined Active Transportation Plan supports other City and regional planning efforts in the areas of transportation and sustainability, including the 2019 Mobility Action Plan, the 2021 Trails Strategy Plan, and the 2023 Climate Action Plan, each as updated from time to time; and

WHEREAS, the Active Transportation Plan aligns with regional efforts to plan for the next five years of active transportation investment in the City and more broadly in the southern Alameda County region, including the Alameda County Transportation Commission’s Countywide Bikeways Network and the Metropolitan Transportation Commission’s Bay Area- wide Regional Active Transportation Network; and

WHEREAS, adoption of a combined Active Transportation Plan will position the City to pursue additional county, regional, state, and federal competitive grants; and

WHEREAS, on April 16, 2025, the Mobility Commission unanimously recommended approval of the ATP by the City Council.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT RESOLVES AS FOLLOWS:

SECTION 1. Based on the information set forth in the report to the City Council dated May 6, 2025, as well as any information submitted to or considered by the City Council during

Resolution 2025-XX Page 2 of 2

its deliberations on this matter, the City Council adopts the Fremont Active Transportation Plan, a copy of which is on file in the Office of the City Clerk.

SECTION 2. The City Council finds that adoption of the Fremont Active Transportation Plan is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to, without limitation, each on a separate and independent basis, CEQA Guidelines Section 15061(b)(3), Review for Exemption, and Section 15004, Time of Preparation. The proposed action does not authorize potential uses as “projects” as defined under CEQA. Given the range of potential varying uses over the life of the plan, the proposed action to adopt the ATP will not result in a reasonably foreseeable significant impact on the environment. If a specific action under the ATP would result in a reasonably foreseeable physical change to the environment, environmental review under CEQA in accordance with applicable law would be conducted at that time. Any future actions under the ATP would be subject to environmental review when the plans are available, and therefore, the proposed action is exempt from CEQA review under the aforementioned exemptions. In addition, per CEQA Guidelines Section 15378(b), the ATP is not a “project” as defined by CEQA but involves the creation of government funding mechanisms or other government fiscal activities that do not involve any commitment to any specific project that may result in a potentially significant physical impact on the environment.

The adoption of the ATP is in accordance with the Fremont General Plan Mobility Element and is further exempt from CEQA review pursuant to CEQA Guidelines Section 15183 (Projects Consistent with a Community Plan, General Plan, or Zoning) and CEQA Guidelines Section 15262 related to the adoption of feasibility, planning studies, and policy documents for possible future actions.

SECTION 3. This resolution shall be effective upon adoption by City Council.
