Executive Summary: The purpose of this report is to facilitate replacing four of the aging and substandard public restrooms at Fremont Central Park with new prefabricated restrooms.
BACKGROUND: Fremont Central Park, located at 40000 Paseo Padre Parkway in Fremont, is set on 450 acres with an 83-acre lake, large grass fields, sports field, playgrounds, restrooms, and various parking lots.
The City’s updated Parks and Recreation Master Plan, adopted in 2022, identified existing park restrooms as one of the highest priorities for park facility/amenity investments. The restrooms are beyond their useful life and do not comply with current building codes or the Americans with Disability Act (ADA). The Central Park restrooms located at the Tennis Complex, Soccer Complex, Babbling Brook Picnic Area, and Lions Picnic Area are four of the several public restrooms being replaced as part of a multi-year park restroom improvement program. The new restrooms are prefabricated by Public Restroom Company, through a contract previously awarded by the City Council on June 4, 2024, and they will have a traditional men’s and women’s restroom, one all gender restroom, a storage area, and a utility room.
A separate construction contract that is the subject of this report includes work to demolish the existing four restrooms and prepare the site to accept the new prefabricated restroom structures. Construction is anticipated to begin in June 2025 with completion anticipated by Fall 2025.
DISCUSSION/ANALYSIS: Bids for this project were opened on April 8, 2025. The bidders with their respective bid amount are shown below. The Engineer’s Estimate is $1,000,000.

The low bidder, Alex Kushner General Inc., is a responsive bidder and all documents are in order. The contractor is experienced in this type of work and has satisfactorily completed contracts of a similar nature with the City and other nearby agencies.

FISCAL IMPACT: The estimated project cost of $1,162,500 will be funded from sources in the adopted Capital Budget. The appropriation for the Citywide Park Restroom Replacement Project (PWC9089) has sufficient funding to complete the project.
ENVIRONMENTAL REVIEW: The project is categorically exempt from environmental review based on, without limitation, CEQA Guideline Section 15302(c). The replacement of the existing park restroom involves negligible or no expansion of use or capacity, which does not involve significant new environmental effects or changed circumstances.

RECOMMENDATION: Approval of the following actions related to the Fremont Central Park Restrooms Replacement Project (PWC9089):
1. Approve Plans and Specifications for the Fremont Central Park Restrooms Replacement (Phase I) Project.

2. Accept the bid and award the construction contract to the lowest responsive and responsible bidder, Alex Kushner General Inc. in the amount of $690,000 and allocate a 15% contingency in the amount of $103,500 for a total construction contract amount of $793,500 and authorize the City Manager, or her designee, to execute the contract.
3. Find the project is exempt from CEQA review pursuant to CEQA Guideline pertaining to replacement of the park restroom involving negligible or no expansion of capacity.
