Executive Summary: The purpose of this report is to Authorize the City Manager, or designee, to execute a purchase order utilizing a cooperative purchase agreement between Tymco, Inc. and H-GAC to purchase two Tymco Model 600 Regenerative Air Street Sweepers to replace the current street sweepers, which have exhausted their useful life.
The purchase order should be opened in an amount not-to-exceed $835,959.60.
BACKGROUND: The City of Fremont’s (“City”) current street sweepers have reached the end of their useful life and are incurring increased mechanical failures, downtime, and maintenance costs that require they be replaced before costs become prohibitive. The street sweepers are scheduled for replacement and funds for that purpose have been appropriated for Fiscal Year 2024/25. The street sweepers are used for solid waste removal operations and will be replaced utilizing Integrated Waste Management Funds (Fund 115).
DISCUSSION/ANALYSIS: City staff determined the vehicle and equipment make and model that would best meet their operational needs for street sweeping and concluded that the Tymco Model 600 Regenerative Air Sweeper will allow operators to perform their job most effectively and efficiently.
The City can realize cost savings by purchasing vehicles through the HGAC cooperative purchasing program. The HGAC is a political subdivision of the State of Texas which offers publicly solicited contracts to government entities nationwide. Fremont Municipal Code Section 3.20.310 authorizes the City to purchase equipment through cooperative agreements and staff has confirmed that the solicitation process used for the cooperative agreements is generally consistent with the City's procurement process. HGAC uses a public competitive solicitation and award process which meets the requirements of the City’s Purchasing Code.

The City is currently planning to transition much of the fleet to electric vehicles (EV).
However, there are no commercially viable sweeper models available that utilize zero- emission technology and meet the specific operational needs of the department.
FISCAL IMPACT: FY 2024/25 budgeted appropriations in the Integrated Waste Management Fund (Fund 115) provide sufficient funding for the purchase of the two street sweepers.
ENVIRONMENTAL REVIEW: The purchase of equipment is not a project as defined by the Public Resources Code Section 21065. Furthermore, each as a separate and independent basis, the action is exempt from review under the California Environmental Quality Act, per CEQA Guidelines Section 15378(b), as an organizational, administrative, policy, and fiscal activity that will not result in direct or indirect physical changes in the environment, and Section 15061(b)(3), as it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment.
