Executive Summary: The purpose of this report is to facilitate compliance with the State’s accountability requirements for the use of Senate Bill 1 (SB1) funds. In Fiscal Year (FY) 2025/26, the City of Fremont expects to receive SB1 funds in the amount of $6.0 million and proposes to use these funds for the pavement rehabilitation projects.
BACKGROUND: On April 28, 2017, the Governor signed SB1, the Road Repair and Accountability Act of 2017. This bill enabled new revenue for state and local transportation projects through increases in gasoline and diesel fuel excise tax, along with an increase in vehicle registration fees. Portions of the revenues were directly allocated to cities for pavement maintenance, safety improvements, and “complete streets” (enhancing facilities for walking and bicycling). Other funding will be available on a competitive basis. The expected direct annual revenue for Fremont is $6.0 million for FY 2025/26.
In order to receive direct allocations of the SB1 revenues for FY 2025/26, cities must adopt a Council action and submit a list of projects to the California Transportation Commission (CTC) by July 1st with information about the proposed use of funds related to location, scope, and expected useful life of the project.
DISCUSSION/ANALYSIS: Staff recommends that Fremont’s SB1 funds of $6.0 million for FY 2025/26 and the remaining unspent SB1 funds of $0.4 million from FY 2024/25 be utilized on the following projects:
Project Name SB1 Funding Amount
Pavement Rehabilitation (PWC 8234-134-Y) $6,400,000
Any SB1 funds not used for the above listed project will be used for future SB1 projects.
FISCAL IMPACT: The adoption of an SB1 Project List is required by the State to receive $6.0 million in planned state revenue for transportation projects.
ENVIRONMENTAL REVIEW: The proposed action is not a project as defined by Public Resources Code Section 21065, and is further exempt from CEQA review as an administrative and funding activity that will not result in direct or indirect physical changes in the environment under CEQA Guidelines Section 15378(b), and because when it can be Council Staff Report (ID # 5463) Meeting of June 3, 2025 Updated: 5/28/2025 4:29 PM by Dina Lewis Page 2
seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment under CEQA Guidelines Section 15061(b)(3). Each of the foregoing provides a separate and independent basis for CEQA compliance with respect to the subject action.

RECOMMENDATION: Approval of the following actions related to the 2025/26 SB1 Project List:
1. Adopt a Resolution Approving a List of Projects Funded by SB1, the Road Repair and Accountability Act for FY 2025/26.
2. Find that the actions are exempt from environmental review, each as a separate and independent basis for CEQA compliance, as an administrative and funding activity that will not result in direct or indirect physical changes in the environment (CEQA Guidelines Section 15378(b)), and it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment (CEQA Guidelines Section 16061(b)(3)).
