Executive Summary: The purpose of this report is to facilitate continued progress toward the replacement or remodeling of 16 old restroom buildings in City parks. Six projects are currently in construction. This Council action supports replacing three additional park restrooms located at the Niles Town Plaza, Central Park Kennedy Play Area, and Central Park Sailway locations. The existing old restrooms are planned to be replaced with prefabricated buildings.

BACKGROUND: The City’s 2022Parks and Recreation Master Plan identified the upgrading of existing park restrooms as one of the highest priorities for the park facility/amenity investments. Many park restrooms are beyond their useful life and do not comply with current building codes or the Americans with Disability Act (ADA). A total of 16 park restrooms are planned to be replaced or remodeled over a multi-year period. Funding for the program is from a $15 million General Fund allocation approved by the City Council in June 2023. The upgraded park restroom locations are noted below:
• Phase 1 (construction contracts have already been awarded; completion by December 2025): Northgate, Irvington, and Central Park (Tennis Center, Lions Picnic Area, Babbling Brook, Soccer Complex)
• Phase 2 (completion by December 2026): Niles Town Plaza, Central Park (Kennedy Play Area, Sailway), Nordvik, Sylvester Harvey, and Niles Community Park • Phase 3 (completion by December 2027): Old Mission, Mission San Jose, Los Cerritos, and Central Park (Five Palms)

DISCUSSION/ANALYSIS: This City Council report addresses the replacement of three park restrooms at Niles Town Plaza, Central Park Kennedy Play Area and Central Park Sailway. Each will be replaced with a prefabricated restroom building at or near the locations of the current restrooms. The new restroom at Niles Town Plaza will have a traditional men’s and women’s restroom with two stalls in the women’s and one stall and one urinal in the men’s, and a maintenance chase. The roof line and exterior aesthetics will have characteristics similar to other existing structures in Niles. The proposed restrooms at Central Park will have a traditional men’s and women’s restroom with 3 stalls each, one all gender restroom, and a storage and maintenance chase. The roof line and exterior Council Staff Report (ID # 5464) Meeting of June 3, 2025 Updated: 5/28/2025 4:38 PM by Dina Lewis Page 2
aesthetics will be identical to the restroom installed at Lila Bringhurst Community Park, also manufactured and installed by Public Restroom Company.

Cooperative Purchase

The prefabricated restrooms will be purchased from the Public Restroom Company through a cooperative contract with Sourcewell, a public agency/cooperative created by the Minnesota legislature to provide purchasing contracts that are competitively bid nationally and at lower prices to other public entities.

Fremont Municipal Code (FMC) Section 3.20.310 authorizes the City to participate in cooperative agreements with other public agencies to purchase goods and services, including incidental labor and public works components, at prices established by the cooperative purchasing agency through a competitive bidding process that meets the City’s procurement goals and objectives. To qualify, the terms of purchase in the City’s proposed contract must be materially the same as those of the existing contract, and the contract must have resulted from procurement methods similar to those required by the Purchasing Ordinance. Authority for cooperative purchases is also codified in Public Contract Code Sections 10298 and 10299.

Based on staff’s review, Sourcewell’s competitive bidding process meets the City’s procurement goals and objectives under Fremont Municipal Code (FMC) Section 3.20.

Sourcewell solicitation and request for proposal (RFP) process includes the following:
1) identify the needs of public agencies; 2) research solutions available in the marketplace; 3) request permissions from the Sourcewell Board of Directors; 4) draft a solicitation, public advertisement, and notice; 5) conduct a pre-proposal conference followed by receipt of responses; 6) evaluate responses from proposers; 7) review evaluation results; 8) provide recommendations to Sourcewell Board of Directors; 9) award vendor(s); 10) post approved contract documents; 11) develop and implement a joint marketing plan with awarded vendor(s); and 12) review and maintain contract throughout its term.

The Public Restroom Company will design, manufacture, deliver and install the prefabricated restrooms at a cost saving to the City compared to typical on-site construction methods.

Savings will largely be achieved in architectural and labor cost reductions resulting from redesigned floor plans and construction taking place offsite. This method of project delivery also expedites the project timeline since building fabrication is the longest lead item on this type of project.

Completion of site improvement plans and other work to replace or extend utilities to support the prefabricated restrooms will be designed and bid under a separate Public Works contract.

Project Schedule

The Public Restroom Company has provided a delivery schedule of 240 working days from the issuance of a Notice to Proceed to finalize the fixtures and finishes, revise all drawings and submit to the City for permitting, construct the bathroom structure, and deliver to the site. Based on the rough schedule, staff anticipates a target delivery date after April 2026.

Council Staff Report (ID # 5464) Meeting of June 3, 2025 Updated: 5/28/2025 4:38 PM by Dina Lewis Page 3
Associated site improvements and utilities providing infrastructure for these proposed restroom buildings are being designed concurrently. This will allow both project schedules to align. The overall planned completion for the three new park restrooms is December 2026.
