Executive Summary: The Fremont Police Department has utilized Metals Treatment Technologies (MT2) to conduct annual lead maintenance, including lead recovery, recycling, and high-efficiency particulate air filter (HEPA) vacuuming of the indoor range since 2019.

The agreement with MT2 expired on October 16, 2024.

Staff recommends that the City Council authorize the City Manager, or designee, to enter into an agreement with metals Treatment Technologies, LLC, for a total not-to-exceed $100,445 over a five-year period for annual indoor range lead maintenance.

BACKGROUND: MT2 is located in Arvada, Colorado, and is a leader in range safety. They provide range consultation and assessment for all environmental and Occupational Safety and Health Administration (OSHA) safety issues. MT2 has never received a violation from OSHA or the Environmental Protection Agency (EPA). MT2 not only complies with OSHA and EPA regulations, but they also help establish industry standards for environmental and safety methods. MT2 is accredited through the Better Business Bureau (BBB) and is the most extensive nationwide range maintenance and cleaning company.

DISCUSSION/ANALYSIS: The Fremont Police Department selected MT2 based on its proprietary process and its status as the nation’s largest environmental range cleaning service provider. MT2 specializes in environmental lead reclamation, range cleaning, and maintenance. They offer OSHA and EPA-certified work teams and are listed as a certified technology vendor with the EPA. MT2 has proprietary technology called ECOBOND, a chemical treatment process that remediates heavy metals at contaminated sites. This process chemically alters the metal to prevent seepage and allows less hazardous metal to exist in the surrounding environment and people who may encounter it. The recommended agreement qualifies under Fremont Municipal Code Section 3.20.300 as an exception to competitive procurement requirements due to MT2's proprietary technology, ECOBOND.

FISCAL IMPACT: Funding for the first year has been included in the General Fund FY 2025/26 proposed operating budget.

ENVIRONMENTAL REVIEW: The contract for range services is exempt from and not subject to review under the California Environmental Quality Act (CEQA) because, without limitation, it is not a “project” as defined in CEQA Guidelines Section 15378(b)(2) and/or Council Staff Report (ID # 5457) Meeting of June 3, 2025 Updated: 5/28/2025 4:49 PM by Dina Lewis Page 2
15378(b)(5) and as it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment per CEQA Guidelines Section 15061(b)(3), each as a separate and independent basis for CEQA compliance.

ATTACHMENTS: None.

RECOMMENDATION: Authorize the City Manager, or designee, to execute an agreement and issue a purchase order with Metal Treatment Technologies, LLC in an amount not-to-exceed $100,445 over a five-year term for the Fremont Police indoor range lead maintenance.
