Executive Summary: The Fremont City Council established the Special Event Sponsorship Program (SESP) in 2019 to support local organizations that host community events. Staff has completed the review and sponsorship award allocation process for special event organizers who submitted applications for FY 2025/26 and recommend the City Council approve the special event sponsorship awards described in this report.

BACKGROUND: In FY 2024/25, the City continued to support the SESP. The program has grown, with a larger pool of applicants as new events become eligible for the program. In FY 2024/25, the City Council allocated $350,000 for thirteen special events under the SESP.

At the time of this report, final accounting for several events held in May and June of 2025 are pending as final reports are typically available 90 days after the event. It is anticipated that all events awarded a sponsorship will spend all their allocated funds.

In December 2024, the City opened the SESP application process for FY 2025/26. The program remains accessible to established event organizers who have held successful, permitted events that required City services on the day(s) of the event or utilized a City-approved vendor for such services. Eligible organizers may request sponsorship up to 50% of the event budget or the estimated cost of City Services, whichever amount is greater. Sponsorship awards are effective July 1 each year, contingent upon budget approval. The FY 2025/26 Proposed Operating Budget includes $350,000 of funding for the SESP. With event costs on the rise, many organizers depend on the City’s sponsorship program for the success of their events.

DISCUSSION/ANALYSIS: The FY 2025/26 special event sponsorship letter of intent process opened in early December 2024, and the full application process opened by January 30, 2025, with a deadline of March 26, 2025. The program was advertised on the City's website and the City's Fremont Connection Newsletter. Additionally, staff reached out to all known eligible event organizers and hosted a virtual public information session to discuss the overview of the program.

Full Applications Received and Eligibility Review: The City received thirteen eligible SESP applications by the deadline.

Applications were reviewed and scored for funding purposes. Staff from five City departments participated in the review process: Community Development, Community Services, Economic Development, Police, and Public Works. Reviewers provided Pass/No Pass scores and comments on the Narrative/Significance and Financial Capabilities/Event Execution sections of each application. All thirteen eligible applications received an overall passing score. In consultation with the City Manager’s Office, all thirteen events are recommended for funding.

To enhance oversight of City-sponsored events, starting in FY 2025/2026, the City will establish a new sponsorship agreement with each award recipient. The agreement will require sponsorship recipients to comply with all applicable City ordinances and State and federal regulations pertaining to special events and public gatherings. Failure to comply with any regulations may result in revocation of the current award and eligibility for future sponsorship, and award recipients may be subject to fines or other appropriate actions.

Sponsorship Award Allocation and Funding Recommendation: Staff calculated the estimated City service cost for each eligible event and used that as a guide for award allocation.

Funds are allocated pro-rata to each eligible applicant based on the estimated cost of City services. City services include, but are not limited to, those provided by Community Services, Fire, Police, Maintenance Operations, and/or City-approved vendors. Using this allocation method and rounding up to the nearest $100, Staff recommends the City Council award the funding amounts shown in the far-right table below. Based on available funding, the proposed award is anticipated to cover approximately 88% of City services estimated for each event.

Disbursement of Sponsorship Awards: The SESP is a reimbursement grant intended to cover some or all of an event's City services costs and possibly some of the event's other expenses. After the event has been held, staff will determine the actual cost of the City services provided using the hourly rate schedule for special events previously adopted by the City Council. The event's sponsorship award will be credited against the actual cost of City services. The event organizer is responsible for paying the City any actual costs in excess of the sponsorship award amount.

Event organizers have until 90 days after the event, or 30 days after final billing details from the City are available, whichever is later, to submit a final report (including a post-event evaluation, attendance estimate, and documentation of actual costs). To the extent the sponsorship award exceeds the actual cost of City services, the City will reimburse the event organizer for eligible event-related expenses, which may include City- approved third-party traffic control vendors for street closures or City facility rental fees.

The combination of credit for the cost of City services and reimbursement for other event-related expenses will not exceed an event's sponsorship award amount.

FISCAL IMPACT: The FY 2025/26 Proposed Operating Budget included a $350,000 General Fund allocation for the SESP.

ENVIRONMENTAL REVIEW: The Special Event Sponsorship Program, an administrative government activity, is not subject to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3), in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. The Special Event Sponsorship Program does not involve the approval of special events or individual projects, which are subject to a separate environmental review and permitting process. Thus, the Special Event Sponsorship Program will not significantly affect the environment, and no further CEQA review is required.

FY 2025/2026 Special Events Sponsorship Program
Guidelines and Application Checklist

Letter of Intent (LOI) Deadline: Wednesday, January 15, 2025, 12:00 p.m. PT Application Deadline: Wednesday, March 26, 2025, at 12:00 p.m. PT Late and/or incomplete submissions will not be accepted Overview and Goals
The Special Events Sponsorship Program (SESP) offers financial assistance to support large-scale special events in the City of Fremont. These events include festivals, parades, and community celebrations that require overtime or specialty City staff support from the Police Department, Fire Department, Public Work Department (Street Maintenance), or Community Services (Parks and Recreations) on the days of the event. Funds are made available annually through the City budget process and awarded by City Council through a competitive application and review process. The program aims to foster successful high-impact community events that:

1. Enhance economic development;

2. Encourage community participation;

3. Promote arts and/or cultural growth; and

4. Provide a rich variety of festivities for residents and visitors.

The program is not intended to support events where the purpose is fundraising for a cause or to advocate for a political position. The SESP funding is specifically meant to partially offset the cost of City services by providing financial support for events. Award amounts may vary per event, per year.

Organizers may request up to 50% of the anticipated total event cost or 100% of the anticipated cost of City services, whichever is higher. Award amounts may be less than the amount requested and all awards are subject to Council approval and/or the availability of funding.

Administration
The Fremont Police Department manages the administrative process of the SESP, as the department also manages the permitting process for high-impact special events in the City. The special event sponsorship application and the special event permit application will be processed together in Spring of each year for events taking place in the upcoming fiscal year. SESP applications will be reviewed by a sub-committee including City of Fremont staff from various departments.

Funding and Grant Use Restrictions
The amount of available funding may vary per year depending on economic outlook and available resources. Past grant awards are no assurance of future awards. Available funds are subject to City Council approval. The City may terminate the program at any time due to unforeseen circumstances.

Grant funds must be used for event-related expenses only and not for operating deficit, administrative costs, or other organizational costs unrelated to production of the event or for any capital equipment purchases. No part of the grant shall be used for political advocacy or for religious events.

• Required application materials that were submitted by the deadline were omitted from the materials the Committee considered during the review process; • A member of the Committee did not recuse her/himself even though s/he had a conflict of interest, as such term is defined under state law, in relation to an applicant, which should have resulted in the council member’s recusal from evaluating the application or participating in a discussion regarding the applicant.

The Committee will not consider appeals based on any other circumstances, including but not limited to:
• Correcting applicant errors and omissions in the application or review process; • Information received after the application deadline;

Final Report
SESP grantees must submit a Final Report for the event on a City-provided form 90 days after the event is held, or 30 days after City billing information is received, whichever is later. Grantees must be current on filing required reports before they can receive grant funding.

Reimbursement Process:

1. The sponsorship award is used to offset any city service cost on the day(s) of the event.

2. If your sponsorship award is not sufficient to cover all city service cost, you will receive a bill for the remaining balance due.

3. If your sponsorship award is sufficient to cover all city service cost, you will not be billed for the event, and any remaining balance on the sponsorship award may be used to reimburse for other event-related expenses. Any reimbursement will take place after submission of your Final Report and all necessary event expense receipts. You must submit receipts equal to, or greater than the amount available for reimbursement.

Acknowledging City Support
Grant recipients must acknowledge the City’s financial support in all appropriate materials and media.

The acknowledgement should read, “Supported in part by the City of Fremont” or similar language, unless the City is a part of a list of supporters. In the latter case, the acknowledgement may simply say City of Fremont. Grantees must display the City’s logo whenever other sponsor logos are displayed, and in accordance with City logo use guidelines.

FASTER ASSET SOLUTIONS UPGRADE - Authorize the City Manager, or Designee, to Enter into an Agreement with TT FASTER LLC, dba FASTER Asset Solutions, in the amount of $328,741.80, and to Execute Any Implementing Documents and Take Any Implementing Actions as Necessary; Appropriation Actions

Executive Summary: The City of Fremont has utilized the FASTER Asset Solution software as its primary fleet management system since 1999. This system provides real-time asset management, integrates with the City’s fuel system and plays a critical role in supporting City staff and daily fleet operations. To improve productivity, expand system capabilities, and align with modern technology standards, the system is now due for an upgrade to a more robust web-based version. This upgrade will enhance operational efficiency, provide improved user accessibility, and ensure continued support for the City’s fleet management needs.

Staff recommends that City Council authorize the City Manager, or designee, to enter into an agreement and to execute implementing documents with TT FASTER LLC, dba FASTER Asset Solutions. The total cost for the project is $328,741.80, which includes $135,001.20 for migration and professional services to upgrade to FASTER Web, and $193,740.60 for a five-year software license and ongoing annual support and maintenance.

BACKGROUND: The Fleet Maintenance Division of the Maintenance Operations Department is responsible for the maintenance, repair, and servicing of City vehicles and equipment.

Fleet’s mission is to provide customer departments with vehicles and equipment that meet operational needs and are safe, reliable, and cost-effective. Currently, Fleet manages and maintains approximately 600 vehicles and pieces of equipment.

DISCUSSION/ANALYSIS: Fleet operations are tracked through the City’s current Faster Solution Fleet Management Software Program. Originally implemented in 1999, the current on-premise version of Faster Solution has served the City’s Fleet Services department for over two decades. The City’s fleet has grown, and technology has advanced, the limitations of the current on-premise system have become more apparent. The software is no longer able to meet the evolving needs of the Fleet Division, and key modern features such as real-time updates, cloud accessibility, and integration with fuel systems are lacking.

The proposed upgrade to Faster Solution’s web-based Software-as-a-Service (SaaS) version will modernize fleet management operations, enhancing efficiency, accessibility, and scalability. This upgrade will improve work order management, parts tracking, fuel monitoring, and reporting, while providing more seamless integration and greater flexibility.

Council Staff Report (ID # 5467) Meeting of June 10, 2025 Updated: 6/6/2025 8:19 AM by Dina Lewis Page 2

The proposed upgrade to the web-based Faster Solution SaaS version will address these challenges and support the department’s ongoing mission by providing enhanced tracking capabilities, better data management, and improved efficiency across all fleet operations.

Staff recommends that the Council approve an upgrade to the FASTER ASSET SOLUTIONS Fleet Maintenance Management System. Software upgrades and maintenance are exempt from competitive purchasing requirements pursuant to Fremont Municipal Code section

3.20.280(c).

FISCAL IMPACT: Funds are appropriated for the migration and professional services to FASTER Web in the Information Technology Services Department equipment replacement budget (Fund 625). An amount sufficient for the annual first-year maintenance cost was included as a placeholder in the FY 2025/26 General Fund proposed operating budget. As the actual payments will need to be reported in the Information Technology Services Operating Fund (Fund 620), staff recommends that the City Council reallocate the General Fund appropriation as a direct charge to Fund 620 and establish an expenditure appropriation in the same amount in Fund 620. Funding for subsequent years will be requested as part of the City’s annual budget process.

ENVIRONMENTAL REVIEW: This project is a software upgrade, and is exempt from and not subject to review under the California Environmental Quality Act (CEQA) because, without limitation, it is not a “project” as defined in CEQA Guidelines Section 15378(b)(2) and/or 15378(b)(5) and as it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment per CEQA Guidelines Section 15061(b)(3), each as a separate and independent basis for CEQA compliance.

ATTACHMENTS: None.

RECOMMENDATIONS:

1. Authorize the City Manager, or designee, to execute an agreement with TT FASTER LLC, dba FASTER Asset Solutions, in the amount of $328,741.80 to provide migration and professional services to FASTER Web, and ongoing annual maintenance and support for a 5-Year Term.

2. Authorize the City Manager, or designee, to execute any implementing documents and take any implementing actions as necessary.

3. Reallocate $38,750 in the FY 2025/26 General Fund Maintenance Operations Department operating budget from contractual services expenditures to the ITS Operating Fund direct charge cost allocation.

4. Recognize $38,750 of direct charge cost allocation revenue in the ITS Operating Fund and appropriate the same amount to software support expenditures.

DIGITAL ENGAGEMENT PLATFORM RENEWAL - Authorize the City Manager, or Designee, to enter into an Agreement and to Execute Implementing Documents with Granicus, LLC, for the Bang The Table/EngagementHQ Digital Engagement Platform Annual Subscription Renewal, in an Amount Not-to-exceed $125,057.43 for a 3-Year term.

Executive Summary: In FY2021/22, the City entered into an agreement with Granicus, LLC, for the implementation and annual subscription of the Bang The Table/EngagementHQ Digital Engagement Platform, otherwise known as MyFremont. Staff recommends that City Council authorize the City Manager, or designee, to enter into an Agreement and to execute implementing documents with Granicus, LLC, for the Bang The Table/EngagementHQ Digital Engagement Platform annual subscription renewal, in an amount not-to-exceed $125,057.43 for a 3-Year term.

BACKGROUND: In FY 2021/22, the City issued a Request for Proposals seeking the implementation of a Digital Engagement Platform for the City. After a thorough RFP process, Staff selected Bang The Table/EngagementHQ from Granicus, LLC for the implementation of the MyFremont community engagement platform.

DISCUSSION/ANALYSIS: Since its launch in September 2022, the MyFremont community engagement platform has enabled constituents to learn about and provide input on important topics facing the City. To date, the City has posted 30 different projects on the platform and the myfremont.gov site has received over 55,000 visits. More informed decisions are made when community members are involved in project and program development, and the MyFremont community engagement platform has made it easier and more convenient for the public to contribute ideas or ask questions about City projects.

Therefore, Staff recommends that the Council approve the annual subscription renewal for the Bang The Table/EngagementHQ Digital Engagement Platform. Software license renewal is exempt from competitive purchasing requirements pursuant to Fremont Municipal Code section 3.20.280(c).

FISCAL IMPACT: Funds are appropriated for the annual software subscription for the Bang The Table/EngagementHQ Digital Engagement Platform in the Information Technology Services Department Operating Fund for FY 2025/26 proposed operating budget (Fund 620). Funding for subsequent years will be requested as part of the City’s annual budget process.

DUMBARTON BRIDGE TO QUARRY LAKES TRAIL PROJECT - Approve Professional Services Agreement with Alta Planning + Design, Inc. in the Amount of $1,078,000 (including 10% contingency) for Design and Right of Way Services for the Phase A Segment of the Dumbarton Bridge to Quarry Lakes Trail Project (PWC9026); Appropriation Actions; and Make Findings of CEQA Exemption.

Title: Principal Transportation Engineer Public Works Director Div/Dept: Public Works Public Works
Phone: 510-494-4542 510-494-4722
E-Mail: [email protected] [email protected]

Executive Summary: The purpose of this report is to facilitate the Design and Right of Way phases for the Dumbarton to Quarry Lakes Trail Project – Phase A Segment. The project will provide a new multi-purpose trail that parallels the Dumbarton (State Route 84) corridor between the existing Dumbarton Bridge toll plaza to Ardenwood Historical Farm, and with connections to the Ardenwood Technology Park and Ardenwood transit center. This trail corridor is designated as a priority in Fremont’s Active Transportation Plan and the project is being funded by the Metropolitan Transportation Commission (MTC) through their Regional Measure 3 bridge toll program.

BACKGROUND: The Dumbarton Bridge to Quarry Lakes Trail Project was developed to provide a continuous multi-purpose trail facility along the Dumbarton (SR 84)/Decoto Road corridor, starting from the existing bike path on the Dumbarton Bridge and ultimately connecting to the Alameda Creek Regional Trail at the Union City/City of Fremont border.

The project aims to provide a continuous active transportation alternative to connect East Bay communities with employment centers and other destinations on the San Francisco Peninsula. The project also links together major recreation facilities including the Alameda Creek Trail (near the Decoto Road and Padre Parkway intersection), Ardenwood Historic Park and Farm, the Bay Trail, Coyote Hills Regional Park, Dumbarton Quarry Campground, and Don Edwards National Wildlife Refuge. Other connections include the Ardenwood Park and Ride Lot and Transit Center, and the Ardenwood Technology Park.

Between 2020 and 2024, City staff collaborated with the Alameda County Transportation Agency (ACTC) to secure approximately $5.425 million in Measure BB funds for the project scoping, alternative analysis, and environmental clearance for the entire trail alignment between Dumbarton Bridge and Alameda Creek. Due to the overall project cost and the diverse range of stakeholders involved for the various trail segments, the Dumbarton to Quarry Lakes Trail is divided into multiple implementation phase segments for design and construction, with each phase segment having a separate funding plan, implementation strategy, and schedule.

The Phase A segment is the first to begin the Design phase, also referred to as the Plan, Specifications, and Estimate (PS&E) phase, and the Right of Way (ROW) phase, as it provides the initial trail connection between the Dumbarton Bridge and the City of Fremont

roadway network. The Phase A trail segment will extend along the north side of Quarry Road between the Dumbarton Bridge toll plaza and Paseo Padre Parkway, along the west side of Paseo Padre Parkway between Quarry Road and Kaiser Drive, utilize the existing on-street cycle track along Kaiser Drive between Paseo Padre Parkway and Ardenwood Boulevard, and along the west side of Ardenwood Boulevard between Kaiser Drive and Ardenwood Terrace. From the Ardenwood Boulevard/Ardenwood Terrace intersection, trail users can utilize the internal roadway/path network within Ardenwood Historical Farm to get to the I-880/Decoto Road interchange, which will be enhanced with the I-880/Decoto Road Interchange Modernization Project also under development by the City. Improvements in the Dumbarton/Decoto corridor are designated as City priorities in the Fremont Active Transportation Plan.

In October 2024, City Council approved the receipt and allocation of $1,078,000 in Regional Measure 3 funds from the Metropolitan Transportation Commission (MTC) for the PS&E and ROW phases of work for the Phase A segment. Also, MTC has programmed construction funding for the project which can be made available once the project is ready for construction (subject to separate approval action by MTC).

The Phase A segment project design is scheduled to begin in Spring of 2025. The Phase A segment project construction is tentatively scheduled to start in the Spring of 2027.

DISCUSSION/ANALYSIS: On March 25, 2025, the City issued a Request for Proposal (RFP) for PS&E and ROW services for the project. One proposal was received on April 15, 2025, from Alta Planning + Design, Inc.. The proposal was evaluated by a selection panel comprised of City staff based on criteria that included relevant experience, project understanding, overall project approach, and project delivery schedule. City staff has determined that Alta Planning + Design, Inc. is qualified to provide listed services for this project. It is noted that Alta Planning + Design was the City’s consultant for the project Planning phase.

FISCAL IMPACT: The Consultant fee for the Phase A segment’s PS&E and ROW phases is $980,000 with an additional $98,000 of contingency for a total fee amount of $1,078,000.

In addition, at this time, staff recommends appropriating funds for staff management expenses by reallocating $100,000 in the State Gas Tax Fund (Fund 136) from Regional Projects Funding Match (PWC9041) to PWC9026. With the approval of the recommended reallocation of funds to the project, there will be sufficient funds for the design consultant contract and to cover staff time for the Dumbarton to Quarry Lakes Trail Project – Phase A Segment Project.

ENVIRONMENTAL REVIEW: Environmental review is not required because award of this agreement is not a project within the meaning of California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Sections 15061 (b)(3) and 15378(b) as it can be seen with certainty that there is no possibility that award of the contract will have a significant effect on the environment and the award is an administrative activity that will not result in an effect on the physical environment. The appropriate environmental assessment and determination for the overall project implementation is being completed as part of the project’s environmental phase of work.

RECOMMENDATION: Approval of the following actions related to the Dumbarton to Quarry Lakes Trail Project – Phase A Segment Project (PWC9026):

1. Authorize the City Manager, or designee, to execute a Professional Service Agreement with Alta Planning + Design, Inc. in an amount not to exceed $1,078,000 for design and right of way services.

2. Reallocate $100,000 in gas tax funds from PWC9041-136 to PWC9026-136.

3. Executive Summary: The purpose of this report is to facilitate approval of the City’s five-year Capital Improvement Program (CIP) for fiscal years (FY) 2025/26 through 2029/30 (referred to as the 2025 CIP) and the two-year Capital Budget for FY 2025/26 and 2026/27.

BACKGROUND: The City’s CIP addresses Fremont’s public infrastructure needs and investments, primarily in the areas of Transportation, Parks, Building Facilities, Capital Maintenance, and General Government. The CIP includes a five-year program of planned investments with the first two years representing a two-year Capital Budget. The CIP is updated every two years. The sources of funds that support the CIP include County and State transportation taxes; grants; City development impact fees; and allocations from the City General Fund.

On April 1, 2025, the City Council received a presentation about the preparation of the City’s five-year CIP. Staff reviewed current investments, program accomplishments, funding projections, results from a community survey (posted on My Fremont from December 2024 through January 2025), and the consideration of a local ballot measure to enhance revenues. Also at the meeting, public comments were received and the City Council provided direction to staff.

On May 13, 2025, staff presented to the City Council the Proposed 2025 CIP with a full list of projects and expenditures having a total investment value of $236 million. City Council input on the Proposed CIP was supportive and no changes have been made to the Proposed CIP. The CIP approval process includes two public hearings; the first public hearing was held on June 3, 2025.

DISCUSSION/ANALYSIS: A copy of the Proposed CIP document is available on the City’s Financial Reports web page (see weblink below). A summary of the 2025 CIP was included in the staff reports for the Council meetings on May 13, 2025 and June 3, 2025.

FISCAL IMPACT: The 2025 CIP programs approximately $236 million in projects over the five-year life of the plan. Approximately $75 million is proposed for appropriation in FY 2025/26 and 2026/27 as part of a 2-year Capital Budget.

Executive Summary: Staff recommends that the City Council hold the second public hearing on the FY 2025/26 Proposed Operating Budget and adopt resolutions approving the budget and the constitutional appropriations limit.

BACKGROUND: Staff presented the FY 2025/26 Proposed Operating Budget to the City Council during a televised City Council meeting on May 13, 2025, and the City Council held the first public hearing on the proposed budget on June 3, 2025. The budget identifies total appropriations, including all funds, for FY 2025/26 in the amount of $422.6 million. The General Fund portion of the total is $277.8 million. Following tonight’s second public hearing, the Council may adopt the budget.

Article XIIIB of the California State Constitution imposes a limit on annual appropriations funded from taxes and certain regulatory fees, user fees, and investment earnings. The appropriations limit is often referred to as the “Gann limit.” The appropriations limit is adjusted from year to year using adjustment factors that must be adopted annually by the City Council.

DISCUSSION/ANALYSIS:

FY 2025/26 Budget Resolution

In addition to documenting the City Council’s approval and adoption of the budget, the Budget Resolution also authorizes the City Manager to appropriate and transfer funds under certain limited conditions specified in the resolution.

The City Council has recently established an accrued leave liability reserve in the Employee Benefits internal service fund. This reserve is used to pay accrued leave balances when employees retire or terminate employment, or as part of an annual leave cash-out. The reserve is replenished each year based on the change in accrued leave liabilities in each of the operating funds where staff are budgeted.

To give the City Manager authority to make the appropriate accrued leave transfers after the final pay period of the fiscal year, staff recommends the City Council approve the following language which is included in the Draft FY 2025/26 Budget Resolution:

Packet Pg. 60
Council Staff Report (ID # 5456) Meeting of June 10, 2025 Updated: 6/6/2025 8:54 AM by Dina Lewis Page 2

SECTION 11. The City Manager is authorized to appropriate and transfer funds from the General Fund, or other funds from which personnel costs are budgeted, to the Employee Benefits Fund in the amounts necessary to maintain adequate funding of the accrued leave liability reserve based on actual leave balances as of June 30, 2025, to the extent that the necessary amounts are available as unencumbered ending fund balance.

FY 2025/26 Appropriations Limit

Staff has calculated the FY 2025/26 appropriations limit in accordance with Article XIIIB of the California State Constitution. The appropriations limit is adjusted annually to reflect both the percentage change in population and the percentage change in cost of living.

The percentage change in population for each city is provided by the State Department of Finance, which also provides the percentage change in California per capita personal income. As an alternative to the percentage change in personal income as a cost of living factor, local agencies may choose to use the percentage change in the local assessment roll from the preceding year due to the addition of local nonresidential new construction. The Alameda County Assessor’s Office annually provides information on the value of nonresidential new construction by the city.

As the California per capita change in personal income is 6.44%, while the percentage change in the City’s assessment roll due to the value of nonresidential new construction is

0.06%, staff recommends that the City Council adopt the percentage change in per capita personal income as the cost of living factor to be used in calculating the FY 2025/26 appropriations limit.

Using the percentage change in City population of 0.16% and the percentage change in California per capital personal income of 6.44%, the appropriations limit for FY 2025/26 is calculated to be $1.0 billion. Based on the proposed General Fund operating budget of $277.8 million, the City is not at risk of exceeding the appropriations limit. The Appropriations Limit Resolution attachment describes in more detail the methodology for calculating the appropriations limit.

FISCAL IMPACT: Supplemented by funding from the Budget Uncertainty Reserve, total General Fund budgeted revenues and transfers in in the coming fiscal year of $278.3 million will be more than adequate to support total budgeted expenditures and transfers out of $277.8 million, and the $1.0 billion appropriations limit far exceeds the proposed appropriations.

ENVIRONMENTAL REVIEW: Action on this item represents a fiscal, organizational, and/or administrative governmental activity that will not result in physical changes in the environment. Therefore, it is not a project subject to review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378.

RESOLUTION NO. 2025-XX

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FREMONT

ESTABLISHING THE APPROPRIATIONS LIMIT FOR FISCAL YEAR

WHEREAS, Article XIIIB of the California Constitution (enacted with the passage of Proposition 4 in 1979 with modifications under Proposition 111 passed by the voters in 1990), as implemented by California Government Code Sections 7900 et seq, requires the City of Fremont (“City”) to establish its appropriations limits by resolution each year, for the following fiscal year; and

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT HEREBY RESOLVES AS FOLLOWS:

SECTION 1 . Pursuant to the appropriations limit formula set forth by Government Code Sections 7900-7913, the City Council does hereby establish the appropriations limit for fiscal year 2025/26 for the City of Fremont a t $1,007,585,306 , as documented in Exhibit A, attached hereto and incorporated herein by reference.

Article XIIIB of the California Constitution (enacted with the passage of Proposition 4 in 1979, with modifications under Proposition 111 passed in June 1990, and implemented by California Government Code sections 7900, and following) provides the basis for the appropriations limitation. In brief, the City’s appropriations growth rate is limited to changes in population and either the change in California per capita income or the change in the local assessment roll due to new, non-residential construction. The formula to be used in calculating the growth rate is:
% change in population + 100
100
multiplied by either
% change in per capita income + 100
100
or
% change in assessment roll due to non-residential construction + 100 100
The resultant factor times the previous appropriations limit equals the new appropriations limit.

Both the California per capita personal income price factor and the population percentage change factor are provided by the State Department of Finance to local jurisdictions each year. The population percentage change factor estimates the change in the City’s population between January of the previous fiscal year and January of the current fiscal year. Reports that present changes in new non-residential assessed value are provided by the County of Alameda. These numbers provide the basis for the factor to be used in the City’s calculation of the appropriations limit. Of the two methods above, the City is using the “per capita personal income” factor because it results in the higher appropriations limit.

In May 2025, the State Department of Finance notified each city of the population change factor and the per capita personal income factor to be used in determining the appropriations limit. The percentage change in per capita income is 6.44%. The calculation as applied to the City of Fremont for FY 2025/26 is as follows:

The population change on January 1 of the previous year (232,241) compared to the population on January 1, 2025 (232,619) is 378, or a 0.16% increase.

The change in per capita personal income is 6.44%.

The factor for determining the year-to-year increase is computed as:

0.16 + 100 X 6.44 + 100 = 1.0661
100 100
Applying this year’s factor of 1.0661 to last year’s limit of $945,113,316 yields the Appropriations Limit for FY 2025/26 of $1,007,585,306.

Based on an operating budget of $277,837,125Fremont is not at risk of exceeding the appropriations limit. The Appropriations limit is adopted by the City Council concurrently with the adoption of the FY 2025/26 operating budget.
