Executive Summary: Staff is recommending the City Council approve and authorize the City Manager to enter into a three-year agreement (FY 2025/26 – FY 2027/28) with the East Bay Agency for Children (EBAC) in an amount not to exceed $237,856 for EBAC to provide resource specialists for the Welcome Center who will offer assistance in multiple different languages to those seeking services at the Fremont Family Resource Center (FRC).
Funding for the first year of the proposed agreement was appropriated as part of the FY 2025/26 Adopted Operating Budget.
BACKGROUND: Established in 1999, the FRC co-locates 24 State, County, City and non-profit agencies working together to support families, children and individuals. Described as a “one-stop shop,” the FRC offers a myriad of services including benefit assistance, case management, financial coaching and free tax preparation, mental health services, State Department of Rehabilitation and State Employment assistance, childcare support, family support, homeless service assistance, and housing assistance, etc. The Human Services Department’s FRC Division is the lead organization for this collaborative endeavor.
Among the core values of the FRC is to provide culturally and linguistically appropriate services. The Welcome Center has been integral to this goal by making multi-lingual resource specialists available in a central location to assist those who come to the FRC with obtaining information, referrals, and public benefits assistance in different languages.
DISCUSSION/ANALYSIS: EBAC is highly experienced in delivering culturally and linguistically appropriate family resource center services. EBAC’s Fremont Healthy Start (FHS) program began in 1992 and provides multi-lingual assistance with information, referrals, and public benefits application and renewal assistance.
Under the proposed agreement, EBAC will provide experienced resource specialists to assist families at the FRC Welcome Center in ten different languages: English, Mandarin, Cantonese, Dari, Korean, Pashto, Spanish, Punjabi, Hindi, and Urdu. These multi-lingual resource specialists will assist the public with in-person services, as well as by phone, and will be available Monday through Friday, during normal FRC operating hours.

Executive Summary: The Fremont Police Department (FPD) obtained grant funding from the Organized Retail Theft Prevention grant to create a Real Time Information Center (RTIC). Staff is now seeking authority to contract with Constant Technologies , Inc. to implement the RTIC. This includes the layout and design, engineering, procurement and installation of technical consoles, specialized video displays, parts, related software, customized training and maintenance for a RTIC in an amount not-to-exceed $874,151.
BACKGROUND: In 2023, the California Board of State and Community Corrections (BSCC) provided an opportunity for grant funding through the Organized Retail Theft Prevention grant. FPD submitted a grant application and was awarded $2,453,958 to establish and implement a Real Time Information Center (RTIC). The grant period runs from October 1, 2023, to December 31, 2026.
The RTIC will enhance FPD’s ability to deter, detect, and respond to criminal activity more effectively and efficiently by centralizing technology, specialized personnel and data-driven crime strategies. The RTIC will increase support to officers by providing information and observations to improve officer safety and decision making; provide investigative assistance; expand analytical and technological capacity throughout the department; and contribute to overall community safety.
The RTIC will deploy two analyst positions to utilize specialized training in analysis, technology, operations and procedures to support police officers in real-time response. The RTIC will incorporate a range of integrated technologies including an extensive camera network, automated license plate readers, data integration platform, Live911, Axon/Evidence.com, information databases, and CAD/RMS/GIS. The integration of these resources into a centralized space, with the ability to visualize feeds and communications on a large-scale video wall optimizing operational awareness, by highly trained specialists will be a great force multiplier for responding officers. This will be utilized not only for mitigating crime, but for quality of life issues, such as attention and potential response to traffic collisions and found/missing persons.
DISCUSSION/ANALYSIS: In March 2025, FPD posted a Request for Proposals for a vendor/consultant to provide design, procurement and implementation of the RTIC. Three

bids were received and a team of subject matter experts from various departments unanimously selected Constant Technologies, Inc. as the most qualified bidder. Their comprehensive proposal provided all of the design, procurement, installation, implementation, training and maintenance support required by Fremont Police Department to successfully operationalize a 24/7 command center, the RTIC.
Constant Technologies, Inc. is an industry leader in turnkey command center solutions for law enforcement. They build command centers for city, state, and federal government agencies as well as key industry leaders such as Meta, whose facility footprint includes Fremont. Their reputation within the industry, across the country, and in California, is extremely strong, which was verified in the references collected during this process.
FISCAL IMPACT: The estimated project cost for the Real Time Information Center (RTIC) is $760,132 plus 15% contingency of $114,019 for a total amount not-to-exceed $874,151.
This project will be funded utilizing the BSCC Organized Retail Theft Prevention grant.
ENVIRONMENTAL REVIEW: The reconfiguration of existing office space in the Police Department building to incorporate the RTIC is exempt from and not subject to review under the California Environmental Quality Act (CEQA) because, without limitation, it is not a “project” as defined in CEQA Guidelines Section 15378(b)(2) and/or 15378(b)(5) and as it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment per CEQA Guidelines Section 15061(b)(3), each as a separate and independent basis for CEQA compliance.
ATTACHMENTS: None.
RECOMMENDATION: Authorize the City Manager, or designee, to execute a contract with Constant Technologies, Inc. in an amount not-to-exceed $874,151 for the design, procurement, and implementation of a RTIC at the Police Department building.

Executive Summary: The Fremont Housing Navigation Center (HNC) has operated since September 2020 and has assisted 279 individuals with shelter, housing, and case management services. For the past five years, the City has contracted with Bay Area Community Services (BACS) to operate the HNC, and BACS’ current agreement ends June 30, 2025.
City staff issued a Request for Information (RFI) to solicit proposals for the continued operations of the HNC and BACS was selected. Staff has identified two years of funding for HNC operations and recommends that the City Council authorize the City Manager to execute a two-year operating agreement and a two-year lease agreement with BACS with the option to extend the agreements for three additional one-year terms, subject to funding availability.
BACKGROUND: On September 10, 2019, the City Council authorized the development, construction and opening of the HNC for up to 45 residents experiencing homelessness, located at the parking lot behind City Hall. The City solicited proposals and selected BACS as the operator of the HNC and executed a three-year services agreement and a three-year lease agreement with the option to extend the agreements for two additional one-year terms.
At the time, staff identified funding from state, county and City sources to fund construction and operating costs only for the initial term of the agreement. The City source was the Affordable Housing and Homeless Services Fund. For clarification, this source is not related to the City’s affordable housing investment funds, which support the development of affordable housing projects.
The HNC opened in September 2020 during the COVID pandemic and operated at partial capacity, serving 25 residents with immediate shelter, intensive case management, and housing navigation. The HNC operated at partial capacity for two years to adhere to shelter health standards and COVID protocols until July 2022, when BACS was able to expand the program to serve the full capacity of 45 residents and continues to do so in 2025.
HNC residents are provided with interim housing services (including one meal a day), as well as intensive case management to link them to benefits, employment, and housing

placements. Once housed, former residents are provided up to six months of transitional case management, including but not limited to: reviewing key elements of a rental agreement; establishing utilities or applying for low-income assistance utility programs; working with clients to ensure rents are paid on time; developing a housing crisis response plan; and planning for self-sufficiency after assistance ends.
Housing Outcomes: Through March 31, 2025, the HNC has served 279 individuals, all of whom were living in Fremont, Newark, or Union City prior to their stay at the HNC. Referrals for the program come from many sources, including the Fremont Winter Relief Program, the Human Services Department, the Police Department’s Mobile Evaluation Team (MET), the BACS Wellness Center, located off Grimmer Boulevard, BACS Outreach Team, and Abode Services street outreach teams.

Public Health’s (ACPH) COVID-19 mandated capacity reductions. The City also successfully advocated for funding with our elected representatives and received $1.5 million in one-time State and Federal awards, which has allowed the City to save the use its own affordable housing and homeless service dollars for future years.
Currently, the HNC costs an average of $2.4 million a year to operate. Operating costs include staff specializing in housing case management, supportive service staff, meals for participants, facility costs, and overhead expenses. Since opening, the HNC has increased its spending in flexible client support (flex) funds, from $186,388 in FY 2020/21 to $286,773 in FY 2023/24. Flex funds are used to provide first and last month rental deposits, security deposits, titrated rental assistance, or move-in assistance for individuals receiving services at the HNC.

Operating Expenses $7,450,248
Flex Fund Expenses $977,070
Total: $8,427,318

CoF H&H $844,435
Donations $10,487
Total: $8,427,318
The City successfully leveraged several state and county funding sources to cover 100% of the operating and flex fund costs. These funding sources include:
• Alameda County Social Service Agency Funding (AC SSA) • State Homeless Housing, Assistance and Prevention (CA HHAP) • State Permanent Local Housing Allocation (CA PLHA)
• State Housing and Community Development General Fund (CA HCD) • Federal Department of Housing and Urban Development (Fed HUD) • City of Fremont Homeless & Housing Fund (CoF H&H)
• Private Donations
DISCUSSION/ANALYSIS: The City of Fremont continues to experience a homelessness crisis. The 2024 Alameda County Point-in-Time Homeless Count showed 807 unhoused

people in Fremont, of which 612 were unsheltered. On a more positive note, the 2024 PIT count does reflect the City’s ongoing efforts to mitigate homelessness, with a 21% reduction in homelessness since the 2022 count. Combined with the 76% rate of placing HNC residents in stable housing or an appropriate facility, these outcomes reflect the City’s strong partnerships with federal, state, and regional agencies and its investments in prevention, shelter, and housing programs.
The City continues to dedicate resources to mitigate and prevent homelessness through a variety of programs and partnerships with local non-profits, including the partnership with BACS to operate the HNC. The HNC is a primary component of the City’s Homelessness Plan adopted in May 2024 along with a number of shelter, prevention, and housing services. The City also partners with BACS to operate the Homeless Wellness Center on Grimmer Boulevard.
With the current five-year HNC operating and lease agreements period ending on June 30, 2025, City staff released a Request for Information (RFI) and solicited proposals to continue operating the HNC. BACS was the only agency to respond and after reviewing their application, interviewing BACS staff, and performing a walkthrough of the HNC, BACS was selected to continue operations due to their qualifications, performance, and familiarity with the City.
BACS has provided behavioral health care and housing services across the spectrum of need since 1953, with a focus on individuals with severe mental illness (SMI) and other complex challenges like homelessness, co-occurring disorders, criminal justice involvement, and/or other history of institutionalization. Today, BACS’ 700+ team members serve nearly 20,000 people each year with 65 unique programs whose services target individuals experiencing or at-risk of homelessness.
Through its consistent outreach presence in Fremont, BACS has been able to gain trust and familiarity with many of the unhoused individuals in the City. As mentioned earlier, BACS’ 60% rate of transitioning HNC residents to stable housing is significantly higher than the national average due to their preparation of residents for housing and employment and direct connections to landlords in Fremont. The HNC and the Fremont Wellness Center help allow BACS to identify the best resources and direction for an individual who may need services to prepare them for the transition to stable housing.
As the HNC operates year-round, BACS has also developed a positive supportive community environment through both professional and social events for HNC residents. Pets are welcome at the facility, which alleviates the fear of having to choose housing over abandoning their pet and ensuring that their mental wellness is being sustained.
Additionally, BACS has been a good neighbor to the City and surrounding businesses, working in cooperation with all stakeholders to address any issues that may arise.
Staff recommend that the City Council authorize the City Manager, or designee, to execute a two-year services agreement and a two-year lease agreement with BACS to operate the HNC, with the option to extend the agreements for three additional one-year terms, subject to funding availability.
FISCAL IMPACT: BACS estimates the cost of operating the HNC to be $2.5 million in FY 2025/26 and approximately $2.55 million in FY 2026/27, for a total cost of $5,050,000

over the initial two-year term of the agreement. Staff have identified sufficient funding to cover the first two years of funding:
Funding Sources for Two-Year HNC Operating Agreement
Source Amount
CoF Affordable Housing and Homeless Services $4,345,000 State Permanent Local Housing Allocation 705,000
Total: $5,050,000
This funding includes all remaining City Affordable Housing and Homeless Services fund balance. As part of the FY 2025/26 Adopted Operating Budget, the City Council appropriated $2.5 million for operating costs, including $1.72 million from the HNC account of the Affordable Housing and Homeless Services Fund (Fund 112) and $781,000 from the CAHCD PLHA account of the Miscellaneous Operating Grants Fund (Fund 190). This report also recommends the City enter into a two-year lease agreement at $1.00 per year with three optional years at the same rate.
Staff will continue to seek additional funding for years three through five of the proposed agreement. The long-term funding environment for homelessness services is uncertain as federal homelessness funding has been targeted for cuts or elimination. Future allocations of state HHAP funds to address homelessness are also uncertain. Additionally, state PLHA funds for housing related services and projects depend on real estate transaction fees and may produce lower revenues considering the cooling real estate market.
ENVIRONMENTAL REVIEW: The proposed action is exempt from the requirements of California Environmental Quality Act (CEQA) because, without limitation, it is not a “project” under CEQA Guidelines Section 15378(b)(2), (4) and/or (5) and/or because it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment per CEQA Guidelines Sections 15061(b)(3) and 15061(b)(3), each of the foregoing providing a separate and independent basis for CEQA exemption.

RECOMMENDATION: Authorize the City Manager, or designee, to execute a two-year services agreement with Bay Area Community Services to operate the Fremont Housing Navigation Center in an amount not-to-exceed $5,050,000, with the option to extend the agreement for three additional one-year terms; and a concurrent two-year lease agreement at $1 per year with the option to extend the lease agreement for three additional one-year terms, subject to funding availability.

INDUSTRIAL SUPPLIES AND EQUIPMENT - Authorize the City Manager, or Designee, to Execute a Purchase Order through a Cooperative Agreement with Grainger to Provide Industrial Supplies and Equipment

Executive Summary: The City of Fremont’s (“City”) purchase order for industrial supplies and equipment, procured through a cooperative contract, has expired. NASPO ValuePoint led a competitive solicitation process and has awarded a new cooperative contract to Grainger, valid through August 2030. Staff recommends that the City Council authorize the City Manager, or designee, to execute a new purchase order with Grainger under this contract, in an amount not-to-exceed $140,000 per fiscal year, through June 30, 2030.
BACKGROUND: Various City departments have an ongoing need to purchase industrial supplies and equipment to support routine maintenance and operations of City buildings, parks, and fleet vehicles. Commonly purchased items include air filters, hand tools, electrical components, and vehicle maintenance parts. Since 2017, the City has maintained a citywide purchase order with Grainger for these items through a cooperative agreement.
Grainger is not the City’s exclusive supplier for these items, and departments may also purchase from other vendors. However, Grainger is a preferred provider for commonly purchased items due to its broad selection, competitive pricing, and reliable customer service. Based on recent expenditure trends, staff anticipates annual spending to approach $140,000, an amount which requires City Council approval.
DISCUSSION/ANALYSIS: Fremont Municipal Code Section 3.20.310(b) authorizes the City to dispense with competitive bidding and use the terms of another governmental contract (“piggyback”) to buy equipment or services. To qualify, the governmental contract must have resulted from procurement methods similar to those required by the City’s Purchasing Ordinance and the terms of the governmental contract must be consistent with the City’s contract terms.
NASPO ValuePoint is a public entity with a national cooperative procurement program offering its member agencies access to publicly solicited contracts. As a member of NASPO ValuePoint, the City has the opportunity to realize cost savings by utilizing existing NASPO ValuePoint contracts.
Pursuant to a public solicitation in 2024, NASPO ValuePoint contracted with Grainger to provide industrial supplies and equipment through August 31, 2030. The solicitation method meets the requirements of the City’s Purchasing Ordinance and the terms of purchase in the

recommended City purchase order with Grainger are materially the same as those of the Grainger contract with NASPO ValuePoint. As specified in the Purchasing Ordinance, the Finance Director and the City Manager have approved the proposed use of the NASPO ValuePoint contract with Grainger.
FISCAL IMPACT: Departments that utilize this citywide purchase order have included appropriate funding for industrial supplies and equipment in the FY 2025/26 Adopted Operating Budget.

Executive Summary: In April 2025, the City of Fremont (City) released a Request for Proposals (RFP) for security services at the Fremont Family Resource Center (FRC). Through the RFP process, American Global Security (AGS) was selected, and City staff recommends the City Council approve and authorize the City Manager to enter into a five-year agreement with AGS for security guard services in an amount not-to-exceed $479,382. Funding for the first year of this agreement was appropriated as part of the FY 2025/26 Adopted Operating Budget.
BACKGROUND: Since 2000, the FRC has contracted for security services to ensure the safety of clients and staff for its more than 20 agencies.
In April 2025, the City released an RFP for security services. The City received 24 bids that were scored using the following weighted criteria: complete submittal of proposal documents, at least three references, hourly and overtime costs, clarity of training provided to the security guard, location of nearest office to the FRC, number of years in business, evidence of staff stability, and data tracking capabilities.
After an extensive RFP process that included review of qualifications and interviews with Human Services Department and Police Department representatives, American Global Security (AGS) was selected as the provider.
DISCUSSION/ANALYSIS: AGS was founded in 1999 and has experience in providing security guard services in social service settings, such as housing authorities, in both northern and southern California. AGS’ key personnel have an average of 8 to 15 years in the security guard industry, and its training program includes a mental health module for behavioral health settings and a community outreach training program.
The proposed agreement with AGS for security guard services includes 50 hours of weekly on-site security: Monday-Thursday from 8:30 a.m. - 7:30 p.m.; Friday from 7:30 a.m. - 6:30 p.m.; and 9 hours of patrol during weekday nights, early mornings, weekends, and holidays.

FY 2028-2029 $95,683
FY 2029-2030 $95,721
Total: $479,382

AMENDED AND RESTATED SOLID WASTE TRANSFER AND RECYCLING PROCESSING AGREEMENT- Authorize the City Manager to Execute an Amended and Restated Agreement with BLT Enterprises Combining the Transfer Station and Curbside Processing Agreements and Aligning the Contract Terms Contact Persons:
Name: Kathleen Cote-Guarnieri
Title: Environmental Services Manager
Div/Dept: Environmental Services
Phone: 510-494-4583
E-Mail: [email protected]
Executive Summary: The City contracts with BLT Enterprises to process residential recycling and consolidate and transfer solid waste received at the Fremont Recycling and Transfer Station. These services are provided under two separate agreements: the Curbside Processing Agreement expiring May 31, 2026, and the Solid Waste Transfer Agreement expiring June 30, 2037.
On February 17, 2023, the City Council authorized staff to negotiate a merged restated agreement with BLT Enterprises to consolidate the Curbside Processing and the Solid Waste Transfer agreements into a single document, align the contract terms for the two agreements, update language to reflect current regulatory and market conditions, upgrade the recycling processing equipment, and incorporate enhanced waste processing and diversion services. Staff recommends the City Council authorize the City Manager to execute this merged restated agreement that implements the City Council’s direction. The process of merging and consolidating the two contracts and 14 amendments took longer than originally anticipated due to the volume of work required and complexity of the task.
There is no General Fund impact as any costs associated with these services are funded by solid waste rate payer fees.
BACKGROUND: The City has four solid waste agreements, including waste collection, solid waste transfer services, recycling processing and landfill disposal, which are all elements of providing solid waste services to Fremont residents and businesses. Collection is provided by Republic Services, landfill disposal is provided by Waste Management at Altamont Landfill and solid waste transfer and recycling processing services are provided by BLT Enterprises at the Fremont Recycling and Transfer Station (Transfer Station). Fees for these various solid waste services are calculated biennially in accordance with each contract's terms. The various solid waste fees are all components of the solid waste collection rates set once every two years by the Council and charged to ratepayers. The current rates are in effect through December 31, 2025.
Solid Waste Transfer Agreement: Prior to development of the Fremont Recycling and Transfer Station, solid waste was collected and hauled by Republic Services for disposal at Tri-Cities Recycling and Disposal Facility, a landfill located at the terminus of Auto Mall Parkway. In anticipation of the landfill reaching capacity, the City entered into a facility

development and operating agreement with BLT Enterprises to meet its long-term waste disposal needs. This Solid Waste Transfer Agreement (Agreement between the City of Fremont and BLT Enterprises of Fremont, Inc for Recyclable Diversion and Transfer Services) was executed in April 2004. Due to delays with the landfill closure date, solid waste delivery to the Fremont Recycling and Transfer Station did not commence until July 1, 2007. This delivery date triggered the 30-year contract term with an expiration date of June 30, 2037. The Solid Waste Transfer Agreement contains numerous sections related to facility development and readiness and City obligations to transition delivery of waste that are now obsolete.
The contract has been amended seven times to settle contract disputes, address new regulatory requirements, and respond to evolving City needs, as listed below:
1. Amendment 1 (April 2006) - Modified the facility opening date from January 2006 to a phased opening in May 2006 with full services beginning July 2007.
2. Amendment 2 (May 2007) - Added Household Hazardous Waste (HHW) Drop-Off services plus changes to transfer equipment and insurance requirements.
3. Amendment 3 (June 2007) - Newark and Union City added as transfer station users for delivery of their franchised solid waste with a per ton host fee paid to Fremont.
4. Amendment 4 (June 2012) - Incorporated delivery and processing of commercial recycling material collected in Fremont to settle a material delivery dispute.
5. Amendment 5 (February 2014) – Incorporated a tiered compensation structure for processing of commercial recycling material retroactive to June 2012.
6. Amendment 6 (May 2015) - Extraordinary compensation settlement including update to rates for facility wage increase, settlement of extraordinary transportation costs, and addition of health insurance index in biennial rate setting formula. Compensation was approved in two phases: facility wages December 10, 2013, and transportation costs December 16, 2014.
7. Amendment 7 (July 2024) - Incorporated time sensitive items into the agreement in advance of completion of the restated agreement including: authorization to proceed with recycling processing equipment design, retention of existing curbside compensation structure, addition of commercial food waste transfer services, addition of C&D (construction and demolition) processing services, update to HHW administrative fee, and clarification of self-haul fees remitted by BLT.
The seventh amendment included additional services for commercial food waste transfer and C&D processing services. The existing solid waste rate structure and incoming revenue is adequate to cover these new services; however, the budget authorization for the increased FY 2024/25 expenses of $550,000 was overlooked and has been included in this report.
Curbside Processing Agreement: Prior to development of the Transfer Station, the Republic Services direct hauled residential curbside recycling and organic material to Republic Services’ Newby Island Material Recovery Facility located on the Milpitas/San Jose border. The City conducted a procurement process when the City’s curbside processing contract with Republic Services expired and chose to transition curbside recycling processing to the Transfer Station. At the time, curbside organics were co-collected in split body trucks along with recycling and therefore organic material had to be offloaded at the Transfer Station as well.
The Transfer Station does not have the capability to compost organic material, so it is consolidated and transported to Newby Island for composting. These services are covered

under the Curbside Processing Agreement (Agreement between the City of Fremont and BLT Enterprises of Fremont, Inc for Curbside Recyclable Materials and Curbside Organic Waste Services). The contract term was established for a 20-year period in consideration of the expected life of the processing equipment. Curbside material delivery began June 1, 2006, approximately 1 year prior to the Transfer Station accepting solid waste. This delivery date triggered an expiration date of May 31, 2026. Due to the different contract terms, the City elected to execute a separate Curbside Processing Agreement rather than incorporating these services into the Solid Waste Transfer Agreement.
The Curbside Processing Agreement has been amended six times to address contract disputes, address new regulatory requirements, and respond to extraordinary impacts on the economics of processing the City’s curbside recycling material. These extraordinary conditions began with policy changes enacted by the Chinese government (known as National Sword), which increased recycling processing costs while reducing the market value of processed material. The amendments are:
1. Amendment 1 (July 2008) - Established curbside recyclable offset fee for material processed from outside of the tri-cities.
2. Amendment 2 (May 2015) – Settled extraordinary compensation dispute including update to rates for facility wage increase, settlement of extraordinary transportation costs, and addition of health insurance index in biennial rate setting formula.
Approved in two phases: facility wages December 10, 2013 and transportation December 16, 2014.
3. Amendment 3 (July 2018) - Short term extraordinary compensation adjustment related to National Sword for 18-month period ending May 31, 2019, with option to extend through November 30, 2019.
4. Amendment 4 (November 2019) - Short term extension of extraordinary compensation through May 31, 2020.
5. Amendment 5 (June 2020) - Short term extension of extraordinary compensation with addition of incoming per ton recycling processing fee through December 31, 2021. Included compensation for material landfilled during processing suspension period (March 30-May 31, 2020).
6. Amendment 6 (June 2022) - Compensation terms set effective through contract expiration of May 31, 2026 including continuation of per ton incoming processing fee and reductions to per ton mixed paper processing fee and per ton landfill residue payment. Biennial adjustment mechanism established.
Prior Council Direction: On February 17, 2023, the City Council authorized staff to negotiate a merged restated agreement with BLT Enterprises to consolidate the Curbside Processing and the Solid Waste Transfer agreements into a single document, align the contract terms for the two agreements, update language to reflect current regulatory and market conditions, upgrade the recycling processing equipment, and incorporate enhanced waste processing and diversion services. Staff recommended the following elements be included:
• Pricing for curbside processing
• Commercial food waste transfer services
• Performance/processing standards
• Fremont benefit for additional long term incoming curbside material stream • Construction & Demolition Debris processing
• Upgrades to the recycling processing equipment

Council Staff Report (ID # 5469) Meeting of June 17, 2025 Updated: 6/12/2025 10:04 AM by Dina Lewis Page 4
• Removal of obsolete provisions and exhibits
• Consolidation of retained exhibits
Due to the substantial lead time required to design and order the new recycling processing equipment, and the benefit of implementing the proposed service enhancements sooner rather than later, most of these elements were implemented as part of the seventh amendment to the Solid Waste Transfer Agreement while the parties continued to work on merging the agreements.
DISCUSSION/ANALYSIS: The Amended and Restated Solid Waste Transfer and Recycling Processing Agreement implements prior City Council direction. Except for the extension of curbside processing services through June 30, 2037, expressly authorized in the City’s Council’s February 2023 action, the Amended and Restated Agreement is a consolidation of existing terms and conditions and does not add or change any obligations for the City or BLT Enterprises. The consolidation of the agreements and elimination of obsolete provisions will greatly streamlines the contract and improves the readability and utility of the document.
FISCAL IMPACT: No rate payer impacts are expected because the extended contract term for curbside processing will be sufficient to amortize equipment upgrade costs. Staff anticipate that the existing solid waste collection rate structure and biennial adjustment procedure will continue to be adequate to fund all necessary solid waste and recycling collection, processing, and disposal costs. There is no General Fund impact as any costs associated with these services are funded by rate payer fees.
Staff is recommending a FY 2024/25 budget appropriation of $550,000 to account 11541094-6106 (Integrated Waste Management Disposal Differential Contract Services) for the commercial food waste transfer and C&D processing services added to the Solid Waste Transfer Agreement in amendment 7. There is adequate incoming revenue from solid waste collection fees to cover these services, but the budget appropriation request was inadvertently omitted from that action. These costs have been included in the recommended FY 2025/26 budget. There is no General Fund Impact.
ENVIRONMENTAL REVIEW: Authorizing execution of the Amended and Restated Solid Waste Transfer and Recycling Processing Agreement is exempt from and not subject to review under the California Environmental Quality Act (CEQA) because, without limitation, it is not a “project” as defined in CEQA Guidelines Section 15378(b)(2), (4) and/or (5) as administrative or fiscal actions which do not have the possibility to cause a significant effect on the environment, and/or CEQA Guidelines Section 15061(b)(3) in that it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment. Each of the foregoing provides a separate and independent basis for CEQA exemption.
ATTACHMENTS: None.
RECOMMENDATIONS:
1. Authorize the City Manager, or designee, to execute the Amended and Restated Solid Waste Transfer and Recycling Processing Agreement, take all reasonable actions necessary and appropriate to implement the same, and find the action is exempt from CEQA as specified in this Report.

Executive Summary: The purpose of this report is to authorize the purchase of fleet vehicles and equipment to replace current aging vehicles and equipment that are due for replacement and unanticipated vehicle replacements due to collisions, mechanical failures, and future approved additions to the fleet.
BACKGROUND: There are 19 fleet vehicles that staff recommend for replacement because they have reached the end of their useful life and are incurring increased mechanical failures, downtime, and maintenance costs, or are ideal vehicles to be replaced with electric options in order to meet State Compliance. These vehicles and equipment are scheduled for replacement and fund appropriations have been approved for Fiscal Year 2025/26. The 19 vehicles are used by various departments and will be replaced using Vehicle Replacement funds (Fund 610). In 2025, staff met with departments and determined the vehicle and equipment make and models that would best meet their operational needs for the 19 vehicles. There are two additional Police Patrol Vehicles that Council has approved for the purchase of through the COPS Grant Fund (Fund 151).
Staff compared the available vendor pricing and contract pricing from other public agencies and determined that the Alameda County Master Contract No. 901979 with The Ford Store San Leandro and the Sourcewell Contract No. 091521-NAF and Contract No. 060920-NAF with National Auto Fleet Group (NAFG) Sourcewell Contract No. 040924-ALT with Altec Industries, Inc./Global Rental Co Inc. provides fair and competitive pricing for the 19 fleet vehicles being purchased and any unanticipated vehicle replacements.
DISCUSSION/ANALYSIS: Fremont Municipal Code, Chapter 3.20, authorizes the use of cooperative agreements, and the City of Fremont (“City”) can realize cost savings by purchasing vehicles through the Alameda County Master Contract No. 901979, Sourcewell Contract No. 091521-NAF and Contract No. 040924-ALT cooperative purchasing programs.
Alameda County is a California public agency and Sourcewell is a political subdivision of the State of Minnesota. Both are public agencies offering publicly solicited contracts to government entities nationwide. Alameda County and Sourcewell both use a public competitive solicitation and award process like that required by the City’s Purchasing Code.
Finance and the City Manager’s Office have approved the use of these cooperative

Planned Electrification of Fleet Vehicles
It is noted that the City is currently planning to transition much of the City’s fleet to electric vehicles (EV) and is coordinating the installation of the EV charging infrastructure before the EVs arrive. New EVs are acquired to replace older vehicles to the degree that suitable vehicles are available on the market. This year 7 EV models planned to be acquired include Ford Mach-E SUVs, Ford E-Transit Vans and Ford Lighting Trucks.
FISCAL IMPACT: The Council-approved FY 2025/26 Vehicle Replacement Fund (Fund 610) appropriation is $2,253,500 and provides sufficient funding for the purchase of the various fleet vehicles. The Council-approved COPS Grant Fund (Fund 151) provides sufficient funding for the purchase of the additional patrol vehicles.
ENVIRONMENTAL REVIEW: The purchase of equipment is not a project as defined by the Public Resources Code Section 21065. Furthermore, the action is exempt from review under the California Environmental Quality Act, per CEQA Guidelines Section 15378 (b), as an organizational, administrative, policy, and fiscal activity that will not result in direct or indirect physical changes in the environment, and Section 15061 (b)(3), as it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment.

PURCHASE OF FIRE APPARATUS - Approval of Purchase Order through a Cooperative Agreement with Golden State Fire Apparatus for the Purchase of two Pierce Aerial Ladder Trucks in the Amount of $4,934,280; Make Findings of CEQA Exemption

Executive Summary: The purpose of this report is to authorize the City Manager, or designee, to issue a purchase order for the purchase of two Pierce Enforcer Aerial Ladder Trucks for a total amount not-to-exceed $4,934,280 using a cooperative agreement with Golden State Fire Apparatus (GSFA).
BACKGROUND: The replacement schedule for Fire Department apparatus has been established based on service life, reasonable maintenance costs, technology advancement and safe operations. Fire Department aerial ladder trucks have a first-line service life of 15 years; however, a vehicle may be replaced earlier or later if safety and maintenance so warrant.
There is currently one Pierce aerial ladder truck due for replacement that was purchased in 2009 (City vehicle #29015) and has reached its recommended service life. The second truck is needed to ensure that there are adequate apparatus available to serve as both frontline and spare to respond to local and statewide mutual aid requests. There is currently an estimated three-to-four-year construction process to build the fire apparatus, which means these aerial ladder trucks would not be delivered and put into service until FY 2028/29.
The Fire Department has established a standardized fleet of fire apparatus. At the organizational level, apparatus with identical operating and performance features allow Fire Department senior staff to take a consistent operational approach to an incident regardless of which company responds. At the company level, ladder trucks operated and outfitted with identical equipment provide firefighters with a familiar operating environment. Standardized training/outfitting based on a single equipment type also allows Fleet Maintenance Services to stock a smaller inventory of replacement parts and minimize maintenance costs. These benefits to the City, including both higher performance and lower cost, make compatibility with the existing fleet an overriding procurement consideration.
Since 1986 the Fire Department has purchased Pierce Fire Apparatus to outfit its fleet, including both engines and aerial ladder trucks. The recommended purchase of two Pierce Enforcer Aerial Ladder Trucks meets the standardization requirement established by the Fire Department.

Council Staff Report (ID # 5478) Meeting of June 17, 2025 Updated: 6/12/2025 10:41 AM by Dina Lewis Page 2
Sourcewell is a public entity with a national cooperative procurement program offering its member agencies access to publicly solicited contracts. As a member of Sourcewell, the City has the opportunity to realize cost savings by utilizing existing Sourcewell contracts.
Pursuant to a public solicitation in 2021, Sourcewell contracted with Golden State Fire Apparatus (GSFA) for the purchase of fire apparatus, which included Pierce Enforcer Tillers.
The solicitation method meets the requirements of the City’s Purchasing Ordinance and the terms of purchase in the recommended City contract with GSFA are materially the same as those of the GSFA contract with Sourcewell and consistent with the City’s contract terms. As specified in the Purchasing Ordinance, the Finance Director and the City Manager have approved the proposed use of the Sourcewell contract with GSFA.
Staff recommends that the City purchase the Pierce Enforcer Aerial Ladder Trucks using the terms of the Sourcewell contract with GSFA as the City will save $64,073 using those terms.
Staff anticipates receiving additional savings of $709,060 by prepaying the vendor, as well as a $39,676 multi-unit discount, making the total savings $812,809.
FISCAL IMPACT: The budget allocation for this purchase is included in the FY 2025/26 adopted budget for the Fire Capital Replacement Fund (Fund 615).
The price quote of $4,934,280 from GSFA includes a total discount of $812,809. The sales/use tax for the purchase of $458,174 will be paid directly by the City to the State of California though a direct use tax payment upon delivery of the apparatus. This direct payment will benefit the City because the total amount of the City’s share of the sales tax will be allocated back to the City, rather than being shared with all Alameda County cities through the countywide sales tax pool.
ENVIRONMENTAL REVIEW: The action recommended in this report is not a project subject to review under the California Environmental Quality Act (CEQA) per CEQA Guideline Section 15378(b)(2) as it is an administrative and funding activity of government.
ATTACHMENTS: None.
RECOMMENDATION: Authorize the City Manager, or designee, to execute a purchase order with Golden State Fire Apparatus for two Pierce Enforcer Aerial Ladder Trucks in a total amount not-to-exceed $4,934,280, using the Sourcewell cooperative agreement and find that the action is exempt from CEQA review per CEQA Guideline section 15378(b)(2) (administrative and funding activities of government).

FY 2025-2028 HUMAN SERVICE GRANT RECOMMENDATIONS – Referrals from Human Relations Commission; Approve Recommendations for FY 2025-28 Human Service Grant Funding and Authorize the City Manager to Execute Agreements with Non-Profit Agencies.

Executive Summary: The Human Relations Commission (HRC) has developed its FY 2025-2028 Human Service Grant cycle funding recommendations. The HRC reviewed twenty-eight proposals, including twenty-seven for Social Service Funds and one for Opioid Settlement Funds, totaling $1,925,304 in requests. The HRC is recommending funding twenty programs with Social Service Funds and one with Opioid Settlement Funds, resulting in a total of $872,732 in grant funding for Human Service programs.
BACKGROUND: Since the late 1970s, the City of Fremont has administered a grant program for non-profit agencies to deliver social services to Fremont residents and historically the Human Relations Commission has facilitated the RFP process and made funding award recommendations to the City Council. The grants are directed to the following three categories:
• Strengthening Services that are designed to foster independence and/or prevent people from needing services in the future.
• Crisis Intervention Services that help people who are in crisis and at immediate risk of losing their independence.
• Basic Needs Services that help people with the fewest resources and who are most in need.
The City awards Human Service Grants on a three-year competitive funding cycle. These grants are supported through a combination of General Funds and Community Development Block Grant (CDBG) funds. FY 2025-2026 will be the first year of a new cycle. All grant agreements with the selected agencies will be for one year, and an agency’s continued funding for the remaining two years of this grant cycle is contingent upon satisfactory completion of the service goals, completion of administrative requirements, and funding availability. The HRC will review and evaluate the agencies on an annual basis and making funding recommendations to the City Council for its consideration and approval.
In July 2021, several large opioid manufacturers and distributors agreed to pay $26 billion to settle over 3,000 opioid crisis-related lawsuits nationwide (collectively, the “2021 National Opioid Settlements”). In May 2023, the City Council authorized the City Manager to execute and ratify agreements related to National Opioid Settlements, making the City eligible to directly receive funding. The City convened a group of partner agencies to determine how to utilize these funds to best serve the Fremont community. The City

agreed to distribute these funds via an RFP. The City allocated $100,000 per year, for a total of $300,000 over the next three-year grant cycle.
FY 2025–2026 Human Service Grant Funding Process: In October 2024, the HRC reviewed and approved the Request for Proposals (RFP) documents, the funding timeline, and plan for the 2025-2028 Grant review process. On November 1, 2024, staff and the HRC issued a Notice for Funding Availability (NOFA) for the next 3-year funding cycle and an RFP. The RFP process was completed as follows:
1. November 1, 2024: RFP materials were made available to the public. The availability of funds was advertised in the Tri-City Voice, on the City’s website, the City’s cable channel, via email, and was further broadcast via the Patch.
2. November 6, 2024: Staff conducted a grant workshop for prospective applicants that gave applicants the opportunity to understand the proposal process, including proposal parameters, scoring criteria, and the SCC’s role in the process.
3. November 29, 2024: Mandatory pre-applications were due.
4. December 3 and 4, 2024: Commissioners were trained on the use of ZoomGrants, the electronic grant application software.
5. December 13, 2024: Applications were due by 5pm.
6. December 2024 and January 2025: Commissioners and staff independently reviewed proposals and developed supplemental questions. Applicants responses to these additional questions were due by March 3, 2025. The HRC then evaluated proposals on the following criteria:
• The agency program is clearly addressing one or more of the impact categories. • The proposed program will produce outcomes that meet a priority community need.
• The program has clearly articulated measurable outcomes. • The agency has the knowledge, methods, and capacity to document and measure program outcomes.
• The agency demonstrates effective service and management capability. • The agency or parent organization demonstrates good fiscal strength. • The agency successfully leverages City funding to bring funding to Fremont. • The agency or program has a substantial presence in the Fremont community. • The agency has local support and community ownership. • The agency collaborates with the City to improve service delivery. • The proposal is complete, accurate, and clearly addresses all questions posed in the application.
7. March 17, 19, and 20, 2025: HRC conducted public hearings to interview agencies regarding their proposals.
8. April 17, 2025: HRC held a public hearing to develop recommendations for the City Council’s consideration and approval. Applications were scored and ranked as a starting point for discussion of funding recommendations
DISCUSSION/ANALYSIS: The HRC had a total of $952,731 in grant funding to recommend for award. This included a pool of $852,731 for any human services eligible under the three categories listed above, and an additional $100,000 in Opioid Settlement Funds that required an agency to meet a specific set of guidelines as dictated by State settlement terms.
The HRC reviewed twenty-eight proposals, including twenty-seven under Social Service Funds and one under Opioid Settlement Funds, totaling $1,925,304 in funding requests.

After completing the process above, the HRC decided to fund the top twenty Social Service Fund applicants and one Opioid Settlement Fund applicant. The HRC recommends granting $852,732 in funding for twenty programs from Human Service Funds and $20,000 in grant funding using Opioid Settlement Funds, resulting in a total of $872,732 in awarded grant funding to all programs.
The Commission based its final recommendations on areas of need, including additional support for homeless individuals, meeting basic nutritional needs, legal assistance, support for victims of domestic violence, providing information and referrals, support for homeless and low-income resident’s pets, education/early intervention, and specialized support for children and case services.

Executive Summary: The Senior Citizens Commission (SCC) has developed its FY 2025-2028 Senior Service Grant funding recommendations. The SCC reviewed a total of eight proposals, requesting a total of $351,165 in funding. The SCC recommends awarding funding to seven of the Senior Service Grant proposals received for a total amount of $208,802.
BACKGROUND: Since the late 1970s, the City of Fremont has administered a grant program to provide funding to non-profit agencies for the delivery of social services to Fremont’s senior residents and historically the Senior Citizens Commission has facilitated the RFP process and made funding recommendations to the City Council. The funding is awarded across the following three categories:

• Basic Needs Services that help people with the fewest resources and who are most in need.
The City awards Senior Service Grants on a three-year competitive funding cycle, and FY 2025-2026 will be the first year of a new cycle. All grant agreements with the selected agencies will be for one year, and an agency’s continued funding for the remaining two years of this grant cycle is contingent upon satisfactory completion of the service goals, completion of administrative requirements, and funding availability. The SSC will review and evaluate the agencies on an annual basis and make funding recommendations to the City Council for its consideration and approval each subsequent year of this grant cycle.
FY 2025–2028 Senior Service Grant Funding Process: In October 2024, the SCC reviewed and approved the Request for Proposals (RFP), the funding timeline, and plan for the FY 2025-2028 Senior Services grant review process. DISCUSSION/ANALYSIS: The SCC had a total of $208,802 in funding to recommend for the Senior Services grants for FY 2025-2026. This included a pool of $126,802 for any senior services eligible under the three categories listed above, and an additional $82,000 in Measure B/BB funding that could only go to proposals for home delivered meals for older adults or people with disabilities.
After completing the process above, the SCC recommends the City award grant funding to seven agency proposals. The SCC based its final recommendations on areas of need for older adults, including the need for additional support in health monitoring, legal assistance, meeting basic and specific nutritional needs, and providing specialized support for the disabled and deaf communities in Fremont.

LANDSCAPING ASSESSMENT DISTRICT NO. 88 - Hold a Public Hearing (Published Notice) and Adopt a Resolution Approving the Engineer's Report, Confirming Diagrams and Assessments, and the Levying of Annual Assessments for Fiscal Year 2025/26 for Fremont Landscaping Assessment District 88 Contact Persons:

Executive Summary: Adoption of the proposed resolution would confirm the information in the Engineer’s Report, including District boundaries, maps, and assessment roll, and authorize the levy of assessments for Landscaping Assessment District 88 for Fiscal Year 2025/26. Upon adoption of the resolution and completion of the annual LLAD requirements, the City will submit the assessment roll to the Alameda County Auditor-Controller by August 10, 2025, for inclusion in the Fiscal Year 2025/26 property tax bill and collection of assessments within the District for public landscape maintenance.
BACKGROUND: The Landscaping and Lighting Act of 1972 (Act) (California Streets & Highways Code Sections 22620-22631) allows local government agencies to form assessment districts to finance the costs and expenses of landscaping and lighting in public areas, among other things. Assessment districts allow for the creation of landscape maintenance zones as a condition of approval of subdivision tract maps to ensure ongoing maintenance of public landscaping improvements that are in or adjacent to the subdivisions and that complement their appearance.
The City formed the Fremont Landscaping Assessment District 88 (District) in December 1988. On June 24, 1997, the property owners in the District’s then existing Zones (1 through 37) approved maximum assessments in their respective zones, except for zones 18 and 22. For the two exempt zones, majority protests under Proposition 218 were established, and, therefore, they are no longer subject to assessments and do not receive maintenance services from the City. In subsequent years, property owners approved the formation of zones 38 through 47 and the levy of maximum assessments. These newer zones were annexed into the District at the time of development. Currently, the District has 47 zones (1 through 17, 19 through 21, and 23 through 47). Forty one zones are managed by the City and four zones are maintained by homeowner associations.
As applicable, the City also must comply with the requirements of Proposition 218 that was adopted by California voters in November 1996. Generally, Proposition 218 and its implementing legislation allow property owners to defeat, by majority protest, assessment increases beyond previously established maximum assessments for any zone within the District, or the the formation or annexation of any new district or zone. Formation or annexation of new zones into a district may be required as a condition of tract map approval, if a developer does not form a homeowner’s association to maintain public

landscaping. There are no proposed increases in assessments, and no new zones are being created or annexed into the District in FY 2025/26.
As required by the Act, each year the City initiates the process to levy the annual assessments by taking several actions. The City Council, by resolution: 1) orders the preparation of the Preliminary Engineer’s Report, 2) approves the Preliminary Engineer’s Report and declares its intention to levy the annual assessments, and 3) sets the date of the public hearing and final action to confirm the Engineer’s Report and authorize the levying of the annual assessments. The City Council approved and adopted the initiation and intention resolutions on April 15, 2025.
DISCUSSION/ANALYSIS:
Public Hearing: The City Council must hold a public hearing to consider public comments, oral and in writing, regarding the proposed levy of the on-going assessments for the District for FY 2025/26. The proposed assessments for next year are not being increased beyond maximum assessments previously established, and therefore, a majority protest cannot defeat the proposed assessments. Notice of the public hearing was given in accordance with the requirements of the Act and was posted in the Tri-City Voice on Tuesday, April 29, 2025.
Engineer’s Report: The Engineer’s Report lists the estimated maintenance costs (including a reasonable contingency) for the new fiscal year. The amount of the proposed assessment levied on each parcel of land is based on the special benefit the parcel receives from the improvements. No substantial change is proposed to the type of maintenance provided in prior years, no new zones or annexations are proposed, and no increase in assessment amounts beyond amounts previously authorized are proposed, all as shown in the Engineer’s Report. Also included is a carryover cost (operating reserve) that is sufficient to pay the first six months of maintenance costs because assessment revenues are not disbursed to the City until after the County property tax bills are due. The assessment also includes the City’s and the County Tax Collector’s administrative costs for imposing and collecting the assessment. The total of these cost items is the gross assessment shown on the budget pages in the Engineer’s Report.
In addition to the annual gross assessment, the Engineer’s Report includes an accounting of reserves. The reserve fund is intended to provide for unanticipated maintenance and replacement costs, as well as planned capital improvement costs. The reserve is calculated by combining the zone balance at the beginning of FY 2024/25 and the anticipated revenue from the FY 2024/25 assessments minus the projected FY 2024/25 expenditures. For the annual assessment process, 41 zones will be assessed in FY 2025/26. All 41 zones will have the same assessment as FY 2024/25. There are no increases or reductions in assessments from the prior year. Pages 11 through 15 of the Engineer’s Report list the previous years’ assessments for each zone. Pages 5 through 9 list the FY 2024/25 proposed assessments and budgets for each zone.
The maximum assessments for each zone and the amount of the proposed levy for the coming fiscal year for the annual assessment process are shown in the Engineer’s Report on pages 5 through 9. All proposed assessments are at or below the maximum assessment s previously approved by property owners of the District on or after June 24, 1997.

The City Council also must approve and confirm the Engineer’s Report, including the boundaries of the District, the designated zones, the annual assessment roll, and any maps, diagrams, and attachments thereto, for Fiscal Year 2025/26.
Assessment: As provided in the proposed resolution, the City Council must affirm and authorize the levy and collection of assessments as set forth in the Engineer’s Report for the District for the period commencing July 1, 2025 and ending June 30, 2026, and direct the City Manager or designee to present an itemized report or assessment role to the Auditor- Controller of Alameda County to be placed on the Fiscal Year 2025/26 County Tax Roll for collection. The reasons for the assessments and the types of improvements, activities, and services proposed to be funded and provided by the levy of assessments on property in the District, and the period for which the proposed assessments are to be made are those specified in the Engineer’s Report, on file with the City Clerk and incorporated into the resolution.
The proposed resolution further affirms the City Council’s findings, based on the Engineer’s Report, that the District and each parcel therein is benefited by the improvements, maintenance, and activities funded by the assessment to be levied, including all expenses incidentally incurred thereto, upon the lots and parcels of real property in proportion to the estimated benefits to be received as specified in the Engineer’s Report.
FISCAL IMPACT: All City costs associated with maintaining and administering the District are covered by the annual assessments. There is no General Fund impact.
ENVIRONMENTAL REVIEW: The levy of assessments will ensure the continued maintenance of existing improvements and will not result in any significant changes to the environment. The annual assessment for the District is exempt from and not subject to review under the California Environmental Quality Act (CEQA) because, without limitation, it is not a “project” as defined in CEQA Guidelines Section 15378(b)(2) and/or 15378(b)(5) and as it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment per CEQA Guideline Section 15061(b)(3), and CEQA Guideline Section 15301 as the assessments will be used to maintain existing facilities, each as a separate and independent basis for CEQA compliance.

20 PART IV – METHOD OF APPORTIONMENT
Method of Apportionment
Street and Highways Code Section 22573 requires that maintenance assessments be levied according to benefit rather than according to assessed value. This section states:
“The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the improvements.”
The 1972 Act permits the designation of areas of benefit within any individual assessment district if "by reason of variations in the nature, location, and extent of the improvements, the various areas will received different degrees of benefit from the improvements." (Sec. 22574). Thus, the 1972 Act requires the levy of a true "assessment" rather than a "special tax."
In November 1996, the voters of California adopted Proposition 218, which has been codified as Articles XIIIC and XIIID of the California Constitution. Proposition 218 imposed a number of substantive and procedural requirements on taxes, assessments, and property-related fees imposed by local governments in California. Since the District Assessments were imposed prior to November 5, 1996, they are “grandfathered” under Article XIIID, Section 5(a) of the Constitution, which permits the continuation of asses sments existing prior to the effective date of Proposition 218. The Assessments may continue to be levied annually by the City without additional property -owner approval at the rates that existed when Proposition 218 went into effect. Any increase above such rates must be in compliance with Proposition 218 and requires property-owner approval.
The method of apportionment described in this Report, and confirmed by the City Council, utilizes commonly accepted engineering practices which have been established pursuant to the 1972 Act and the California Constitution for the allocation of special benefit assessments. The calculation of assessments is based upon the parcel type and the services and improvements provided to equitably apportion the costs based on the special benefit received by each lot or parcel.
The special benefit received by each lot or parcel is over and above any general benefit conferred upon said lots or parcels or to the public at large.
Special Benefit
The improvements and associated costs have been allocated to the assessable properties within the District based upon the special benefit received by those properties. The improvements for which the properties are assessed have been identified as necessary, were installed and are being maintained as part of the development plans specifically for each tract. As such, the improvements and continuing maintenance and servicing of those improvements are strictly the obligation of the properties within the District.

21 Definition of Special Benefit
The method of apportionment described in this Report is based on the premise that each assessable parcel or unit receives distinct and special benefits from the improvements and services provided, including the visual desirability provided by well-maintained landscaping. In accordance with Article XIII D, Section 4 of the California Constitution:
“Special benefit means a particular and distinct benefit over and above general benefits conferred on real property located in the District or the public at large.” The special benefits associated with local landscaping improvements are specifically:
• Enhanced desirability of properties due to proximity and accessibility of the improvements. • Improved aesthetic appeal provided by a positive representation of the development, neighborhood and the community.
• Improved ingress and egress to property resulting in enhanced traffic flow, reduced traffic accidents and consequent reduction of possible property damage.
• Improved traffic visibility and circulation.
• Improved accessibility for emergency vehicles.
• Reduced vandalism and other criminal activity.
• Enhanced environmental quality provided by adequate green space and other landscaping which helps moderate temperatures, reduce noise pollution and control dust and debris.
General Benefit
Although the improvements may be visible to passersby or to the public at large, the improvements were installed as a requirement of the development of the tract and are for the benefit of properties within the District. It has been determined therefore, any access or use by properties or individuals outside the District is incidental but still provides measurable benefit to outside properties or individuals.
The proceeds from the assessments are used to fund enhanced maintenance of improvements, services and activities that provide a special benefit to parcels within the District that, in absence of the assessment, would not otherwise be provided. The District will continue to receive the same level of general service provided to the public at large under City- funded and administered programs, as determined annually, related to the maintenance and servicing of public facilities and improvements (landscaped medians, streetscapes and right-of-way maintenance).
Consistent with the requirements of Section 4 of Article XIII D of the California Constitution that “only special benefits are assessable”, the City will provide the District with additional maintenance services at $0.088 per square foot of landscaped area along arterial or collector streets. The cost is based on the City’s current landscape maintenance contract for areas outside the District. These cost allocations are considered to be “general benefits” and are equal to or greater than the general benef it related to the services being provided. All other maintenance, operations and administrative costs associated with the District, which exceed the City’s contribution to the public at large, are accordingly considered to be “special benefits” funded by the District assessments which provide a special benefit to the parcels within the District.” The assessment levied upon each parcel as presented does not exceed the reasonable costs of the proportional special benefit conferred to the parcel.

22 The table below shows the general benefit calculation for each Zone where general benefit applies and the total amount that should be contributed to the District to pay for the general benefit portion of the Zone costs.
The above Zones have landscape maintenance services performed along arterial or collector streets within the District.
The General Benefit Cost per Zone is based on the estimated percentage of landscaping along arterial or collector streets, multiplied by the $0.088 per square foot of landscaping. The cost per square foot determined and provided by City staff, and represents the costs to provide similar landscaping services in other areas of the City. The General Benefit Costs per Zone have been accounted for by the services provided by the City and are therefore not shown on the budget pages.

23 ASSESSMENT RANGE FORMULA
It is generally recognized that most budgetary items will be impacted by inflation in future years. In an effort to minimize the impact this has on maintenance districts, a formula for inflationary adjustments is typically included as a part of the maximum assessment to be approved by the property owners during the formation of the District. Prior to the passage of Proposition 218 however, inflationary adjustments were not included as a standard part of the formation and approval process. The District wa s formed in 19 88, prior to the passage of Proposition 218 , and does not include an inflationary adjustment for the annual assessments.
To impose a new assessment or increased assessment in excess of the Maximum Assessment Rate, the City must comply with the provisions of the California Constitution, Article XIII D, Section 4c that requires a public hearing and certain protest procedures including mailed notice of the public hearing and property owner protest balloting. Property owners must approve the proposed new or increased assessment via a property owner protest balloting process before any such new or increased assessment can be imposed. A protest occurs when, at the public hearing, the returned assessment ballots opposed to the new or increased assessment outweigh the returned ballots in favor of the new or increased assessment, weighting those returned assessment ballots by the financial obligation of each parcel.
The definition of new or increased assessments includes any assessment which, 1) did not previously exist or, 2) exceeds a previously approved assessment amount or assessment range formula. Any assessment range formula must have been previously adopted by the agency and approved by the property owners.

APPENDIX A – ASSESSMENT ROLL
Appendix A
Parcel Identification for each lot or parcel within the District shall be based on available parcel maps and other property data from the Alameda County Assessor’s office as they existed at the time this Report was prepared and adopted by the City Council.
A listing of parcels assessed within the District for Fiscal Year 2025-2026, along with the corresponding assessment amount is shown on the following pages. If any parcel submitted for collection is identified by the County Auditor/Controller to be an invalid parcel number for the current fiscal year, a corrected parcel number and/or new parcel numbers will be identified and resubmitted to the County Auditor/Controller. The assessment amount to be levied and collected for the resubmitted parcel(s) shall b e based on the method of apportionment and assessment rate approved in this Report.
Therefore, if a single parcel has changed to multiple parcels, the assessment amounts applied to each of the new parcels shall be recalculated and applied according to the approved method of apportionment and assessment rate rather than a proportionate share of the original assessment.
Non-assessable lots or parcels include areas of public streets and other roadways (typically not assigned an APN by the County); dedicated public easements, open space areas and rights -of-way, including public greenbelts and parkways; utility rights-of-way; common areas; landlocked parcels; small parcels vacated by the County, bifurcated lots and any other property that cannot be developed or has s pecific development restrictions. These types of parcels are considered to receive little or no benefit from the improvements and are therefore, exempted from assessment.
