Executive Summary: The purpose of this report is to facilitate fire extinguisher services for portable fire extinguishers located in buildings owned by the City of Fremont (City).

BACKGROUND: The National Fire Protection Association (NFPA) develops and publishes safety codes for building safety, electrical safety, and fire prevention. NFPA 10 outlines the standards for installation, inspection, and general maintenance including recertification of portable fire extinguishers. The City owns roughly 545 portable fire extinguishers within 86 City buildings to include the Police Department buildings, Fire Stations, Administration buildings, Community Centers, Maintenance Center, and others. Each fire extinguisher must be inspected annually.

DISCUSSION/ANALYSIS: A Request for Proposals (RFP) was put out for bid March 25, 2025, and closed on April 22, 2025. No bids were received. Per Purchasing Code 3.20.210, if no bids are received by the City, the City is not required to rebid the work and may proceed to negotiate and enter into a contract with a vendor provided that the contract meets the purpose and goals set forth in Section 3.20.030. The City reached out to the current vendor, Cintas Corporation, who expressed interest in continuing to provide services for the City, and City staff and Cintas were able to negotiate new pricing and contract terms for a new agreement.

Staff recommend that the City Council authorize the City Manager, or designee, to enter into a seven-year agreement with Cintas to provide installation, inspection, maintenance, and recertification of the City’s portable fire extinguishers for a total amount not-to-exceed $145,405.15.

FISCAL IMPACT: Sufficient funding for the first year of services was appropriated to the Maintenance Operations Department in the General Fund FY 2025/26 adopted operating budget. Funding for future year services will be included in the proposed operating budgets for those years.

ENVIRONMENTAL REVIEW: The project is exempt from the requirements of the California Environmental Quality Act (CEQA), each as a separate and independent basis, pursuant to the following sections of Title 14 of the California Code of Regulations: (1) CEQA Guidelines Section 15061(b)(3), in that the service agreement does not have the potential to cause a significant effect on the environment, and (2) CEQA Guidelines Section 15301(d), as the Council Staff Report (ID # 5486) Meeting of July 15, 2025 Updated: 7/11/2025 8:25 AM by Dina Lewis Page 2
scope of work involves repair and maintenance of existing mechanical equipment involving negligible or no expansion of existing or former use.

ATTACHMENTS: None.

RECOMMENDATION: Authorize the City Manager, or designee, to execute a seven-year fire extinguisher service agreement with Cintas Corporation for a total contract amount not-to-exceed $145,405.15, and make findings of CEQA exemption.
