RESOLUTION NO. 2025-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FREMONT
ACCEPTING THE CALIFORNIA HIGHWAY PATROL CANNABIS TAX
FUND GRANT PROGRAM (CTFGP)
WHEREAS, with the passage of Proposition 64 in 2016, the Control, Regulate, and Tax Adult Use of Marijuana Act (AUMA), California voters mandated the state set aside funding for the California Highway Patrol (CHP) to award grants to local governments and qualified nonprofit organizations, as described in Revenue and Taxation Code Section 34019(f)(3)(B); and
WHEREAS, the City of Fremont desired to participate in the Cannabis Tax Fund Grant Program (CTFGP) funded through the CHP to support local law enforcement to reduce and mitigate the impacts of impaired driving in the community; and
WHEREAS, the City of Fremont Police Department applied for a grant through the CHP CTFGP and was awarded $172,999.97 for fiscal year 2025/2026.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT RESOLVES AS FOLLOWS:
SECTION 1. The City Manager, or designee, is authorized on behalf of the City Council of the City of Fremont to accept the $172,999.97 allocated to the City from the CTFGP and sign the Grant Agreement with the CTFGP, including any amendments thereto and any other implementing actions.
SECTION 2. The grant funds received hereunder shall not be used to supplant expenditures by the City of Fremont Police Department.
SECTION 3. The City of Fremont agrees to abide by the terms and conditions of the Grant Agreement as set forth by the CTFGP.
