RESOLUTION NO. 2025-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FREMONT
AMENDING ARTICLE VII OF THE MASTER FEE SCHEDULE
(RESOLUTION NO. 8672) DECREASING THE STATE GENERAL
OVERSIGHT PROGRAM FEE TO BE COLLECTED UNDER CUPA AND
REMITTED TO THE STATE
WHEREAS, on March 1, 1994 the City Council adopted Resolution No. 8672, as amended from time to time, establishing the City’s Master Fee Schedule, fixing and establishing fees, rates and charges for goods and services provided by the City of Fremont (“City”); and
WHEREAS, the City’s Master Fee Schedule includes fees for certain state directed program oversight fees that the City is mandated to collect and remit to the applicable State agency; and
WHEREAS, the City is part of the Certified Unified Program Agency (“CUPA”) and as part of the program inspects certain businesses; and
WHEREAS, the California Environmental Protection Agency (“CalEPA”) regulates certain businesses according to the California Health and Safety Code; and
WHEREAS, the Office of the State Fire Marshal is responsible for oversight of the CUPA Program; and
WHEREAS, CalEPA has decreased the Unified Program State Oversight Surcharge CERS NextGen component to $79.00 for each business/facility under the CUPA Program; and
WHEREAS, the City is required by state law to collect and forward all Unified Program State Oversight Surcharge fees to the CalEPA at the end of each fiscal year.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT HEREBY RESOLVES AS FOLLOWS:
SECTION 1. Article VII, Section B, subsection 16 of the Master Fee Schedule (Resolution No. 8672, as amended) is hereby amended to decrease the pass-through fee of the Unified Program State Oversight Surcharge for CERS NextGen to $79.00 per business/facility, which will be paid annually to the Secretary of the California Environmental Protection Agency and shall read as follows:

SECTION 2. The Master Fee Schedule (as adopted by Resolution No. 8672, and as amended by this Resolution) shall be kept on file in the office of the City Clerk.
