VACATION OF EASEMENT AT 5567 CUSHING PARKWAY - Adopt a Resolution Summarily Vacating a Portion of an Emergency Vehicle Access Easement at 5567 Cushing Parkway in the Bayside Industrial Community Plan Area (PLN2025- 00067) and Make Findings of CEQA Exemption.

Executive Summary: The purpose of this report is to facilitate the installation of exterior equipment for Quanta Computer by vacating a portion of an Emergency Vehicle Access Easement (EVAE) that is no longer needed.

BACKGROUND: Pacific Commons Owner, LP, is the owner of a 171,233 square-foot industrial building located at 5567 Cushing Parkway in the Bayside Community Plan Area.

The tenant, Quanta Computer, has applied to vacate a portion of an EVAE on the property.

The EVAE proposed for vacation was originally dedicated to the City on Tract Map 8348, recorded on July 30, 2018, and encumbers the entire parcel except for the existing building footprint.

The City of Fremont issued Building Permits to allow the construction of exterior improvements, including an outdoor enclosure that contains equipment for power generation. To fulfill a condition of approval prior to Building Occupancy, the tenant has applied for a vacation of a portion of the EVAE that is no longer needed, with the authorization of the property owner.

DISCUSSION/ANALYSIS: California Streets and Highways Code Section 8330 – 8334.5 allows the City to summarily vacate an emergency vehicle access easement when it is “superseded by relocation, or determined to be excess by the easement holder, and there are no other public facilities located within the easement.” City staff has determined that a portion of the EVAE is no longer needed and there are no other public facilities located within the easement.

Notification to Utility Companies: All concerned utility companies have been notified and consented to the proposed vacation of the easement.

FISCAL IMPACT: None.

ENVIRONMENTAL REVIEW: The vacation of the EVAE is exempt from environmental review, pursuant to California Environmental Quality Act (CEQA) Guidelines, Section 15305, because the action is considered a minor alteration to land use limitations that does not result in any land use or density changes.

SUMMARILY VACATING A PORTION OF AN EMERGENCY VEHICLE
ACCESS EASEMENT AT 5567 CUSHING PARKWAY , BAYSIDE

MAKING A FINDING OF CEQA EXEMPTION

WHEREAS, the Applicant/Developer of the property located at 5567 Cushing Parkway is requesting approval of a summary vacation of the Emergency Vehicle Access Easement described and depicted in Exhibits A and B, attached and incorporated herein by this reference; and

WHEREAS, pursuant to California Streets and Highways Code Section 8333 (c), the legislative body of a local agency may summarily vacate a public service easement when it is superseded by relocation, or determined to be excess by the easement holder, and there are no other public facilities located within the easement;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT RESOLVES AS FOLLOWS:

SECTION 1. The City Council approves the summary vacation of the Emergency Vehicle Access Easement described and depicted in Exhibits A and B, which is hereby vacated in accordance with Public Streets, Highways and Service Easements Vacation Law, Chapter 4, Part 3, Division 9 of the California Streets and Highways Code (Section 8300 et seq.), based upon the following findings and conditions:

A. The City Council finds, based on the information contained in the City Council report dated October 21, 2025, and presented by City staff, that the Emergency Vehicle Access Easement vacated is no longer needed, has been superseded by relocation, constitutes excess land, and there are no other public facilities located within the easement.

B. The vacation shall conform to Exhibits A and B (Legal Description and Plat for Emergency Vehicle Access Easement Vacation).

SECTION 2. The City Council finds that the vacation of the easement is exempt from environmental review under CEQA Guidelines, Section 15305.

FLOCK SAFETY SYSTEMS AGREEMENT AMENDMENT - Authorize the City Manager, or Designee, to execute an amendment to agreement with Flock Group Inc, dba Flock Safety Systems, for the installation of Flock ALPR Systems and subscription.

Executive Summary: The purpose of this staff report is to recommend that the City Council authorize the City Manager, or designee, to execute an amendment to an existing agreement with Flock Safety Systems to replace 35 BOSS Automated License Plate Reader (ALPR) cameras and expand the ALPR system to a total of 80 cameras citywide.

BACKGROUND: Since March 2016, the City of Fremont has been a leader in leveraging community-based video surveillance, establishing a robust Community Camera Network to enhance public safety. The CCN includes pan-tilt-zoom color cameras and Automated License Plate Readers (ALPRs), strategically installed at city entry/exit points and major intersections. Additionally, mobile ALPRs are deployed in nearly all marked patrol vehicles, and solar-powered mobile camera systems are used for special events and dynamic deployments.

Community support has been foundational to the program. In 2015, prior to implementation, the City conducted an Open City Hall survey and held public meetings to gauge interest in the CCN and ALPR technology. Of the nearly 400 survey respondents, 85% expressed strong support.

Since its launch, the CCN has proven to be a valuable tool in deterring crime and identifying suspects. Fremont Police Department (FPD) remains committed to maintaining and expanding this resource to improve community safety through the timely apprehension of offenders.

The City of Fremont (City) is also committed to protecting individual privacy. All video footage is securely stored for 30 days unless flagged as evidence in an investigation. ALPR data is retained for one year and shared only with authorized law enforcement partners under strict data-sharing agreements and in compliance with federal, state, and local laws.

Data tied to criminal investigations may be retained beyond one year per department policy.

Currently, the Fremont Police Department operates 44 fixed-position ALPR systems, of which 35 were purchased from Neology. These systems are accessed via Neology’s BOSS web application. However, Neology has announced its exit from the law enforcement market and will no longer provide or support ALPR technology. As a result, the Police Department must transition to a new ALPR vendor to ensure the continued functionality and effectiveness of the CCN.

Council Staff Report (ID # 5548) Meeting of October 21, 2025 Updated: 10/17/2025 9:25 AM by Dina Lewis A Page 2

DISCUSSION: FPD believes that continued investment in the Community Camera Network will enhance the identification and apprehension of criminals and deter future criminal activity. This investment aligns with the City Council’s established priority of enhancing public safety and the Police Department’s Strategic Plan Goal #1: Mitigate the Impact of Crime and Enhance Community Safety (Strategies 1.5, 1.6, and 1.8).

Two options were considered to modernize the department’s Automatic License Plate Reader (ALPR) infrastructure. Replace Neology with another purchase-based vendor or expand the use of Flock Safety’s lease-based system.

Based on the two options, the FPD would benefit most from transitioning to Flock. Flock’s regional data-sharing capabilities have already proven effective in helping FPD apprehend suspects fleeing through neighboring cities and solving serious crimes committed by individuals outside our jurisdiction. Expanding FPD’s use of Flock provides several advantages, including ongoing technology upgrades, cost stabilization through a multi -year lease, reduced operational expenses, minimized downtime for repairs, improved equipment reliability, and stronger vendor accountability. Additionally, Flock offers simplified installation for faster deployment, flexible placement with solar-powered cameras, and environmentally sustainable technology that supports FPD’s efforts to reduce its carbon footprint.

FPD has worked with Flock Safety on a proposed three-year amendment to the current agreement. Key features of this amendment include stable and predictable ALPR system costs through 2027, vendor-managed installation and maintenance, and 90-day ALPR data retention at no additional cost.

In FY 2025/26 the Department anticipates completing the installation of 36 additional cameras and the replacement of 35 Boss Cameras in the City. With these additions, the total deployment will consist of 80 Flock ALPR cameras citywide.

One-Time Installation Cost $50,650
Year 1 subscription (3-year agreement) $301,400 (per year)

FISCAL IMPACT: The installation and year one subscription costs, totaling $352,050, will be funded through a federal COPS grant previously appropriated in the Federal Operating Grants Fund (Fund 191). Subsequent year subscription costs will be included in the Information Technology Services Operating Fund (Fund 620) proposed budget beginning in FY 2026/27. Depending on the future ongoing funding availability for FY 2026/27, the sources for the new ongoing funding required to support this expanded program could potentially be achieved through a budgetary request for new funding, absorbed within the existing FPD operating budget by eliminating lower priority programs, the federal COPS grant program or some combination of all three options.

RECOMMENDATION:

Authorize the City Manager, or designee, to enter into an amended agreement with Flock Safety System for the installation of 71 Flock ALPR systems and subscription for 80 Flock cameras.

Executive Summary: This staff report implements the City Council’s direction to City staff to develop a policy that emphasizes the City of Fremont’s commitment to addressing local matters and restricts official City statements on international affairs. The draft resolution attached to this report would establish such a City policy, emphasizing the need to prioritize municipal affairs and restricting City actions or statements on matters that do not directly affect the City of Fremont.

BACKGROUND: On occasion, the City Council receives requests to take action on matters that do not have a direct effect upon the administration of the local affairs of the City of Fremont. The City Council has expressed an interest in reviewing a draft policy that would prioritize municipal affairs and issues that have a direct effect on the City of Fremont. The City Council previously voted 7-0 in favor of Councilmember Yang Shao’s referral to direct staff to develop such a policy for City Council review and consideration.

As directed, City staff has developed a draft policy that would restrict the City Council from issuing official statements on international issues or other matters that have no direct effect upon the administration of the local affairs of the City of Fremont. Notably, the policy would not limit the right of any individual Council member or members of the public to give their personal view on such matters or to seek interpretation of the applicability of the policy when uncertain.

FISCAL IMPACT: None.

ENVIRONMENTAL REVIEW: The proposed action is exempt from and not subject to review under the California Environmental Quality Act (CEQA) because, without limitation, it is not a “project” as defined in CEQA Guidelines Section 15378(b)(2) and/or 15378(b)(5), and it has no possibility of having a significant effect on the environment, as specified in CEQA Guidelines Section 15061(b)(3), each as a separate and independent basis for CEQA compliance.
