MISSION BOULEVARD / SULLIVAN UNDERPASS TRAFFIC SIGNAL PROJECT - Approval of Plans and Specifications; Award Contract to Guerra Construction Group in the Amount of $929,223 (includes 10% Contingency) for the Mission Boulevard / Sullivan Underpass Signal Project (PWC8930); Appropriation Actions; and Make Findings of CEQA Exemption

Executive Summary: The purpose of this report is to initiate the construction of a new traffic signal at the intersection of Mission Boulevard and Sullivan Underpass/Nichols Avenue. The traffic signal will improve safety for all travel modes and enhance access for the Niles community and business district.

BACKGROUND: Mission Boulevard is a state highway (SR 238) that is owned and operated by the California Department of Transportation (Caltrans). Over the past ten years, there have been a number of severe injury and fatal crashes along the Mission Boulevard corridor.

The overall design of Mission Boulevard with high traffic speeds and volumes have been contributing factors that make it difficult to navigate the Mission/Sullivan intersection without a traffic signal.

The City of Fremont has collaborated with Caltrans on an updated intersection design at the Mission Boulevard/Sullivan Underpass intersection to improve intersection safety, walking/biking access, and vehicle traffic operations. The new intersection design consists of new curb return extensions to shorten pedestrian crossings distance as well as a new traffic signal to facilitate safe and efficient traffic movement at the intersection. The new traffic signal can also be used as a tool to manage corridor traffic speeds when connected and coordinated with other existing traffic signals along the Mission Boulevard corridor. Finally, the project will stripe new high visibility crosswalks at all four legs of the intersection, install intersection safety lighting, and construct new curb ramps to facilitate ADA access.

Project construction is anticipated to begin in February 2026 with completion scheduled by the end of 2026.

DISCUSSION/ANALYSIS: Bids were received on December 4, 2025. The bidders with their respective bid amounts are shown below. The Engineer’s Estimate is $1,101,000.

7. Ransome Company $1,088,643.00

The low bidder, Guerra Construction Group submitted a responsive bid and is experienced in this type of work and has satisfactorily completed concrete and traffic signal related improvements in various Bay Area cities including the City of Sunnyvale, Mountain View, San Jose, and Santa Clara.

PWC8930 – Fund 531 – Traffic Impact Fee 700,000

Proposed Funding Reallocation
PWC8930 – Fund 136 – Gas Tax ($ 70,000)
PWC8930 – Fund 531 – Traffic Impact Fee (700,000)
PWC7953 – Fund 515 – Measure BB Funds 930,000
Total Funding Available $1,060,000

FISCAL IMPACT: Additional funding is needed for the award of this contract. Also, staff recommends changing the sources of funding to use unspent Measure BB funds. This change helps the City meet its annual obligation to expend Measure BB funds allocated from Alameda CTC in a timely manner. The specific project funding plan includes: allocating $930,000 in unspent Measure BB funds (Fund 515) from the Traffic Improvement Program (PWC7953) to the project (PWC8930) to fund the construction contract; reallocating Gas Tax funds (Fund136) in the amount of $70,000 from the existing project budget (PWC8930) to the Traffic Improvement Program (PWC7953); and reallocating Traffic Impact Fee funds (Fund 531) in the amount of $700,000 from the existing project budget (PWC8930) to the Traffic Improvement Program (PWC7953). The remaining Gas Tax funds (in the amount of $130,000) in the project budget will be used to support City staff time to provide construction inspection, construction contract administration services and other project management services.

With the recommended reallocation of funds to the project, there will be sufficient funds available for the estimated project cost.

ENVIRONMENTAL REVIEW: The project is statutorily exempt from CEQA review under Section 21080.25 of the Public Resources Code, as amended, because the project is a

As a separate and independent basis, the project is exempt under CEQA Guideline Section 15301, Class 1(c), 15301 for “Existing Facilities” in that it involves operation, repair, maintenance or minor alteration of existing structures and facilities involving negligible or no expansion of existing or former use. The project is located within public right of way and does not add new infrastructure that increases automobile capacity. None of the exceptions to the categorical exemptions outlined in CEQA Guidelines Section 15300.2 applies to the project.

ATTACHMENTS: None.

RECOMMENDATION: Approval of the following actions related to the Mission Boulevard / Sullivan Underpass Signal Project (PWC8930):

1. Approve the plans and specifications for the project.

2. Accept the bid and award the construction contract to the lowest responsive and responsible bidder, Guerra Construction Group in the amount of $844,748, allocate a 10% contingency in the amount of $84,475 for a total construction contract amount of $929,223 and authorize the City Manager, or designee to execute the contract.

The work performed under this agreement will include, but not be limited to, designing traffic signal improvements; planning and designing fiber optic communication infrastructure; developing traffic signal timing and coordination; and developing and implementing Intelligent Transportation System (ITS) applications.

DISCUSSION/ANALYSIS: In August 2025, the City solicited proposals for On-Call Traffic Signal Engineering Consultant Services. The selected consultants will work under a five -year Master Service Agreement.

Four proposals were received from traffic signal engineering consulting firms, listed alphabetically: Iteris, Inc.; Kimley-Horn and Associates, Inc.; TJKM Transportation Consultants; and W-Trans.

An evaluation panel comprised of City staff evaluated all proposals based on the Consultant’s qualifications, experience of assigned personnel, their ability to respond in a timely manner, completeness of the proposal, ability to meet contract and insurance requirements, satisfaction of previous clients, and the overall and local experience to perform the required services.

Based on the results of the evaluation process, staff recommends authorizing the approval of four separate master agreements for On-Call Traffic Signal Engineering Consultant Services with Iteris, Inc., TJKM Transportation Consultants, Kimely-Horn and Associates, and W-Trans, in the not-to-exceed amount of $1,250,000 per agreement, over a period of five years.

Council Staff Report (ID # 5600) Meeting of January 6, 2026 Updated: 12/31/2025 10:16 AM by Alberto Quintanilla Page 2 FISCAL IMPACT: All task orders issued and work performed by consultants under the on- call Master Service Agreements will be restricted to the funds appropriated and available for the specific project for which the work is required.

ENVIRONMENTAL REVIEW: Environmental review is not required because award of this agreement is not a project within the meaning of California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15061 (b)(3) and 15378(b) as it can be seen with certainty that there is no possibility that award of the contract will have a significant effect on the environment and the award is an administrative activity that will not result in an effect on the physical environment. The projects or work task that the consultants will provide services for will be subject to appropriate environmental review.

ATTACHMENTS: None.

RECOMMENDATIONS:

1. Approve and authorize the City Manager or their designee, to execute a Master Service Agreement for on-call traffic signal engineering consultant services with the following consultants:
a. Iteris, Inc. for a total not-to-exceed compensation of $1,250,000 for five years. b. TJKM Transportation Consultants for a total not-to-exceed compensation of $1,250,000 for five years.
c. Kimley-Horn and Associates for a total not-to-exceed compensation of $1,250,000 for five years.
d. W-Trans for a total not-to-exceed compensation of $1,250,000 for five years.

2. Find that the actions are exempt from environmental review, each as a separate and independent basis for CEQA compliance, under CEQA Guidelines, Section 15378 (administrative and funding activities are not a “project” under CEQA) and Section 15061 (no possibility the activity may have significant effect on the environment).

SECOND AMENDMENT TO MASTER AGREEMENT FOR ELECTRONIC HEALTH RECORD SOFTWARE - Authorize the City Manager, or Designee, to amend Master Agreement with Netsmart Technologies, Inc., for an Electronic Health Records System and Related Software and to Add $116,170 for a Total Not-to- Exceed Amount of $697,020.

E-Mail: [email protected] [email protected]

Executive Summary: The Human Services Department has utilized Netsmart Technologies’ MyEvolv electronic health record (EHR) system software since September 2019. This EHR system allows the Human Services Department to track client information and care plans, coordinate treatment and resource referrals, provide data to funding entities, and to facilitate billing for reimbursement from 3rd party sources, such as Medi-Cal and Medicare.

On July 16, 2019, the City Council authorized the City Manager to enter into a Master Agreement with Netsmart Technologies (Netsmart) for the ERH system and related software in an amount up to $497,056 over a five-year period. On February 7, 2023, the City Council authorized the City Manager to enter into a First Amendment to the Master Agreement with Netsmart to extend the term of the Master Agreement through September 30, 2027, and to increase the total not to exceed amount to $589,850. The final executed First Amendment to the Master Agreement with Netsmart included a not to exceed amount of $580,850.

Staff recommends the City Council authorize the City Manager, or designee, to enter into a Second Amendment to the Master Agreement with Netsmart for the ERH system and related software. This Second amendment will provide additional services, including Netsmart Identify and Access Management Federated (NIAM), Security Analysis, Key Performance Indicators (KPI) Dashboards, Operational Process Analysis (OPA), and Application Management Services (AMS). To cover the costs of these additional services, the proposed Second Amendment will increase the not to exceed amount under the Master Agreement by an additional $116,170, resulting in a new total not-to-exceed amount of $697,020 for all services through September 30, 2027.

BACKGROUND: In 2019, the City completed a public proposal process to upgrade its aging EHR System. On September 30, 2019, the City entered into a Master Agreement with Netsmart Technologies, the successful bidder, to design and implement a new Electronic Health Record system (EHR) for client services. The EHR went live in December 2020 and has been utilized since then to document client services and bill for services.

On February 7, 2023, the City Council authorized the City Manager to enter into a First Amendment to the Master Agreement with Netsmart to extend the Master Agreement for a five-year term and to increase the total not to exceed amount to $589,850. The City

Packet Pg. 20
Council Staff Report (ID # 5598) Meeting of January 6, 2026 Updated: 12/31/2025 10:09 AM by Alberto Quintanilla Page 2 ultimately entered into a First Amendment with Netsmart for the EHR system and related software extending the term through September 30, 2027, and increasing the total not to exceed amount to $580,850.

Alameda County Behavioral Health (ACBH) has awarded the City one-time FY 2025/26 Enhancement Funds in the amount of $90,000 to assist providers in managing recent changes in the state-wide mental health systems, including the 2024 Behavioral Health Service Act (Proposition 1) and California Advancing and Innovating Medi-Cal (Cal-AIM) payment reform.

DISCUSSION/ANALYSIS: The MyEvolv EHR system is a cloud-based system hosted in a data center in Netsmart’s private cloud. The data center is fully redundant and meets current industry security standards, including Systems and Organizational Controls (SOC) and is consistent with the City’s IT Strategic Plan for cloud-based computing.

The proposed Second Amendment to the Master Agreement with Netsmart Technologies, Inc. will use the Enhancement Funds from ACBH to add the following services:

• Netsmart Identify and Access Management Federated (NIAM): Multi-Factor Authentication and Single Sign-On for the end-user and sending assertions to the Netsmart Identity and Access Management platform using standard protocols. • Security Analysis: Assessment of existing security processes to verify compliance with HIPAA guidelines.
• Key Performance Indicators (KPI) Dashboards: KPI Dashboards provide at-a- glance metrics to clinical, financial, and operational decision-makers to determine if the organization is moving in the right direction to achieve organizational goals. • Operational Process Analysis (OPA): Analysis of current City processes to determine if the City is leveraging the full potential of the system and improving productivity.
• Application Management Services (AMS): Provides as-needed access to a virtual team of application specialists with unique clinical and billing knowledge of Netsmart EHRs and reporting solutions.

These additional services will enable Staff to fully utilize the MyEvolv EHR system, boosting Staff efficiency and improving services to constituents. Therefore, Staff recommends that the City Council authorize the City Manager, or designee, to enter into a Second Amendment to the Master Agreement with Netsmart Technologies, Inc. to increase the not to exceed amount by $116,170 for the additional services above. Under the proposed Second Amendment, the revised total not-to-exceed amount under the Master Agreement will be $697,020.

FISCAL IMPACT: The City Council has appropriated sufficient funds to cover the FY 2025/26 one-time costs under the proposed Second Amendment and the first year of annual maintenance costs ($58,059), in the Mental Health – EPSDT account of the ACBHCS YFS Behavioral Health Fund (Fund 170). Funding for subsequent years of annual maintenance and management services costs ($58,111) will be budgeted in the ITS Operating Fund (Fund 620), with a direct cost allocation to the ACBHCS YFS Behavioral Health Fund and Medi-Cal Administrative Activities Fund, and requested as part of the City’s annual budget process.

Executive Summary: In December 2025, following completion of the meet-and-confer process and mediation, the City of Fremont (City) and the Teamsters, Local 856 (Teamsters) concluded labor negotiations for a successor Memorandum of Understanding (MOU). The bargaining unit consists of 71 members. The proposed MOU incorporates modest compensation and health-benefit allowance increases (inclusive of a parity clause), an increase to the maximum accrual limit for sick leave bank hours, the addition of classifications eligible for bilingual pay and vest allowance, additional comp swaps for eligible classifications, along with non-economic clarifying language edits to uniform allowance, meal periods, and bereavement leave sections. All other substantive provisions of the MOU will remain unchanged.

BACKGROUND: The City’s MOU with Teamsters expired on June 30, 2025. Following multiple negotiation sessions, the City presented its Last, Best, and Final Offer (LBFO) to Teamsters on August 22, 2025. On September 22, 2025, Teamsters notified the City that they were declaring impasse and requesting an impasse meeting, which took place on October 24, 2025. After no agreement, the parties mutually agreed to mediation, which took place on December 17, 2025.

As a result of mediation, the parties reached a tentative agreement. Consistent with that outcome, the City Council is being asked to approve the successor MOU, effective December 28, 2025 (the start of the first full pay period following Teamster’s ratification of the tentative agreement), through June 30, 2026. California Government Code Section 3505.1 requires the City Council to vote on the proposed successor MOU at a duly noticed public meeting.

DISCUSSION/ANALYSIS: The significant changes in the proposed successor MOU include:

1. Employee Compensation:
a) Effective the start of the first full pay period following Teamsters ratification of the tentative agreement, Teamsters members will receive a base wage increase of 1.3%.

2. Health Benefit Allowance:

2.H
Packet Pg. 23
Council Staff Report (ID # 5609) Meeting of January 6, 2026 Updated: 12/31/2025 10:23 AM by Alberto Quintanilla Page 2 a) Effective the first of the month following Teamsters ratification of the tentative agreement, the unit’s health benefit allowance will be increased by $100 per month (from $2,700 per month to $2,800 per month).

b) Effective January 1, 2026, the unit’s health benefit allowance will be increased by an additional $100 per month (from $2,800 per month to $2,900 per month).

3. Parity or “Me Too”:
a) If, during the term of this Memorandum of Understanding, the City grants an across-the-board wage increase to another bargaining unit greater than the

1.3% provided in Article 2, Section 2.1, the City agrees to extend the equivalent general wage increase to all Teamsters classifications listed in Appendix A. This provision does not apply to increases that are the result of any market equity increases or increases based on internal relationships (e.g., compaction). This provision will sunset at 11:59 p.m. on June 30, 2026.

b) If, during the term of this Memorandum of Understanding, the City grants a larger Health Benefit Allowance increase to another bargaining unit, the same allowance shall be granted to Teamsters classifications listed in Appendix A.

FISCAL IMPACT:

1. Compensation Increase:
a) Fiscal Year 2025/26 Anticipated Fiscal Impact: $58,443

2. Health Benefit Allowance:
a) Fiscal Year 2025/26 Anticipated Fiscal Impact: $60,000

Staff will return to the City Council with recommended adjustments to the FY 2025/26 Adopted Budget reflecting the terms of the approved successor MOU.

ENVIRONMENTAL REVIEW: The proposed approval of a successor MOU is exempt from and not subject to review under the California Environmental Quality Act (CEQA) because, without limitation, it is not a “project” as defined in CEQA Guidelines Section 15378(b)(2) and/or 15378(b)(5), and it can be seen with certainty that the action has no possibility of causing a significant effect on the environment under CEQA Guidelines Section 15061(b)(3), each as a separate and independent basis for CEQA compliance.

ADDITIONAL INFORMATION:

My journey into art and writing has grown naturally alongside my background in healthcare and community service. As an eye care professional, I have spent decades listening to people, not only to their clinical needs but also to their lived experiences. I am especially interested in projects that bring art into everyday public spaces, libraries, schools, senior centers, hospitals and civic environments where it can be experienced without barriers.

If given the opportunity to serve, I would bring a thoughtful, compassionate perspective to the Art Commission, valuing collaboration, cultural sensitivity, and the role of art as a bridge between diverse voices in Fremont. I see public art not only as a visual expression, but as a shared experience that quietly nurtures the soul of a city.
