Updated: 1/30/2026 8:49 AM by Alberto Quintanilla Page 1 VACATION OF EASEMENT AT 44235 NOBEL DRIVE - Adopt a Resolution Summarily Vacating a Portion of a Storm Drain Easement at 44235 Nobel Drive in the Bayside Industrial Community Plan Area (PLN2025-00092) and Make Findings of CEQA Exemption.

Executive Summary: The purpose of this report is to facilitate the construction of tenant improvements at a one-story commercial building at 44235 Nobel Drive located within the Bayside Industrial Community Plan Area by vacating a portion of a storm drain easement that is no longer needed.
BACKGROUND: EWA Fremont 44235 Owner, LLC, the property owner and developer of the project, has submitted an application to vacate a portion of a storm drain easement on the property. The easement proposed for vacation was originally dedicated to the City on Parcel Map 7077, recorded on May 20, 1997 and is located behind an existing commercial building (see Exhibit B).
On July 18, 2024, the City of Fremont issued a building permit to allow the construction of tenant improvements at the site, which required a portion of an existing public storm drainage pipe to be relocated. The developer has provided a grant deed for a new storm drain easement to match the realignment. The original easement, where the storm drainage pipe was previously located, is no longer needed.
DISCUSSION/ANALYSIS: California Streets and Highways Code Section 8330 – 8334.5 allows the City to summarily vacate a public service easement when it is “superseded by relocation, or determined to be excess by the easement holder, and there are no other public facilities located within the easement.” City staff have determined that the storm drain easement is no longer needed and there are no other public facilities located within the easement.
Notification to Utility Companies: All concerned utility companies have been notified and consented to the proposed vacation of the easement.
FISCAL IMPACT: None.
ENVIRONMENTAL REVIEW: The vacation of the Storm Drain Easement is exempt from environmental review, pursuant to California Environmental Quality Act (CEQA) Guidelines, Section 15305, because the action is considered a minor alteration to land use limitations that does not result in any land use or density changes.

DRAFT
RESOLUTION NO. 2026-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FREMONT SUMMARILY VACATING A STORM DRAIN EASEMENT
AT 44235 NOBEL DRIVE , IN THE BAYSIDE INDUSTRIAL
COMMUNITY PLAN AREA (PLN2025-00092) OF FREMONT , AND
MAKING A FINDING OF CEQA EXEMPTION
WHEREAS, the Applicant/Developer of the property located at 44235 Nobel Drive in Fremont is requesting approval of a summary vacation of the Storm Drain Easement described and depicted in Exhibits A and B, attached and incorporated herein by this reference; and
WHEREAS, pursuant to California Streets and Highways Code Section 8333(c), the legislative body of a local agency may summarily vacate a public service easement when it is superseded by relocation, or determined to be excess by the easement holder, and there are no other public facilities located within the easement.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT RESOLVES AS FOLLOWS:
SECTION 1. The City Council approves the summary vacation of the Storm Drain Easement described and depicted in Exhibits A and B, which is hereby vacated in accordance with Public Streets, Highways and Service Easements Vacation Law, Chapter 4, Part 3, Division 9 of the California Streets and Highways Code (Section 8300 et seq.), based upon the following findings and conditions:
A. The City Council finds, based on the information contained in the council report and presented by City staff, that the Storm Drain Easement being vacated is no longer needed, has been superseded by relocation, constitutes excess land, and there are no other public facilities located within the easement.
B. The vacation shall conform to Exhibits A and B (Legal Description and Plat for Storm Drain Easement Vacation).
SECTION 2. The City Council finds that the vacation of the easement is exempt from environmental review under CEQA Guidelines, Section 15305 (minor alterations in land use limitations that do not result in changes in land use or density).
SECTION 3. The City Clerk is directed to cause a certified copy of this resolution, attested under seal, to be recorded in the office of the County Recorder of Alameda County after the above conditions are met.

AWARD AND EXECUTE MASTER SERVICES AGREEMENTS FOR ON-CALL LANDSCAPE ARCHITECTURAL CONSULTANT SERVICES – Authorize the City Manager to Award and Execute Master Services Agreements for On-Call Landscape Architectural Consultant Services to Gates Studio, Mennucci Design Group, and RRM Design Group, each for an amount not to exceed $1.25M over five years.

Executive Summary: Staff is requesting authorization for the City Manager to award and execute three separate Master Services Agreements with Gates Studio, Mennucci Design Group, and RRM Design Group to perform professional-level landscape architectural work related to the design, construction and rehabilitation of landscape and irrigation facilities for parks, landscape areas, street and urban design projects, and other landscape architecture- related work in the not-to-exceed amount of $1,250,000 per agreement, over a period of five years.
BACKGROUND: The City of Fremont (City) typically uses on-call consultant service agreements for services requiring expertise that City staff does not have or to supplement City staff during periods of peak work demand. In this case, the on-call landscape architectural services will be used to supplement City staff and address any backlog of approved CIP projects.
The work provided under this agreement includes landscape architectural design and project coordination services for a variety of projects that may be requested by the City during the term of this agreement. All work, unless otherwise specified, shall be performed under supervision of the Parks Planning and Design Manager or in -house design staff, related to the design, construction and rehabilitation of landscape and irrigation facilities for parks, landscaped areas and street and urban design projects, on an as -needed basis, and completed to the satisfaction of the City Landscape Architect.
The work performed under this agreement will augment, assist, and expand production capacity of existing City landscape architectural and engineering staff in community outreach, design, the preparation of plans, specifications, estimates, site inspections, analysis, master planning and related work, grant assistance, and other landscape architectural work.
DISCUSSION/ANALYSIS: In September 2025, the City solicited Proposals for On-Call Landscape Architectural Consulting Services. Eighteen proposals were received from the firms, listed alphabetically: BFS Landscape Architects, Callander Associates Landscape Architecture, Inc., Carducci & Associates, Inc., CSWST2, Cupples Keller Designs,

Council Staff Report (ID # 5607) Meeting of February 3, 2026 Updated: 1/28/2026 9:13 AM by Alberto Quintanilla B Page 2 DVDCreative, Gates Studio, GroundLevel Landscape Architecture, Inc., Integra Landscape Architecture, Jett Landscape Architecture + Design, K&S Archiform, Landscape Dynamics, Mennucci Design Group, RRM Design Group, SWA Group, Tanaka Design Group, Verde Design, Inc., and Westwood Professional Services, Inc.
An evaluation panel comprised of three City staff members evaluated all proposals based on the Consultants’ qualifications, experience of assigned personnel, completeness of the proposal, billing rates, and their overall and local experience to perform the required services.
Based on the results of the evaluation process, staff interviewed Gates Studio, Mennucci Design Group, and RRM Design Group.
After the evaluation and interview, staff unanimously recommend authorizing the approval of three separate master services agreements for on -call Landscape Architectural design services with 1) Gates Studio , 2) Mennucci Design Group, and 3) RRM Design Group, in the not-to-exceed amount of $1,250,000 per agreement, over a period of five years.
FISCAL IMPACT: All task orders issued, and work performed by consultants under the on- call master services agreements, will be restricted to the funds appropriated and available for the specific project for which the work is required.
ENVIRONMENTAL REVIEW: Environmental review is not required, as a master services agreement is not a project pursuant to California Environmental Quality Act (CEQA) Guidelines Sections and 15378(b), as administrative and funding activity is not a “project” under CEQA, and 15061(b), as it can be seen with certainty that there is no possibility that authorization of the agreements will have a significant effect on the physical environment. The projects that the consultants will provide services for will be subject to appropriate environmental review.
ATTACHMENTS: None.
RECOMMENDATION: Authorize the City Manager, or designee, to award and execute Master Services Agreements for on-call Landscape Architectural design services with Gates Studio, Mennucci Design Group, and RRM Design Group, each for a total not-to-exceed compensation of $1,250,000 over five years.

AUTHORIZE LEASE AGREEMENT WITH LS POWER GRID CALIFORNIA - Authorize the City Manager to Execute a 28-Month Lease Agreement with LS Power for 10 Acres at 6900 Automall Parkway
Contact Persons:
Name: Tara Bhuthimethee Kim Beranek
Title: Parks Planning and Design Manager Community Services Director Div/Dept: Landscape Architecture Community Services
Phone: 510-494-4738 510-494-4330
E-Mail: [email protected] [email protected]
Executive Summary: Staff is requesting City Manager authority to execute a 28-month lease agreement with LS Power Grid California, LLC for the use of 10 acres at 6900 Automall Parkway, also known as Pacific Commons Sports Park, for a laydown space to facilitate the installation of their Power the South Bay Project.
BACKGROUND: Over the last several months, the City of Fremont has been working with LS Power Grid California, LLC (LSPGC) with their regional Power the South Bay Project to install a new 230 kilovolt alternating current transmission line through Fremont (6 miles within Fremont) from the existing NRS substation in Santa Clara (near Levi’s Stadium) to the existing Newark substation. Specifically, the City and LS Power entered into a Memorandum of Understanding Agreement, which facilitates an efficient permitting process for the construction of the underground transmission line and pledges the installation and dedication of approximately six miles of high-capacity broadband conduit to the City. This project will strengthen the electrical grid by providing robust connections and providing better access to cost-effective energy for residents and businesses. Construction is projected to begin in 2026 and conclude in 2028.
DISCUSSION/ANALYSIS: During the coordination efforts for the Power the South Bay project, LSPGC approached the City in search of an appropriate area for a 10-acre laydown space to be used as a temporary staging area and corporation yard from which to set up and run construction operations. Due to the proximity to the project site, which traverses Fremont north to south, the location at 6900 Automall Parkway was proposed. This site is also known as the future Pacific Commons Sports Park, slated to become a 40-acre park with regional-draw sports fields.
The parkland is currently vacant, as the park development project is undergoing design and environmental review. It is estimated that the first phase of the park project not commence construction for approximately 26 months, which aligns with the lease timeline. It is anticipated that neither environmental review nor construction of park improvements will interfere with or be hindered by the lease since the areas of the lease and Phase 1 of the park project do not overlap (See Exhibit 1).
The proposed lease area will be inspected to record existing conditions, monitored throughout the lease timeframe, and inspected at the end of the lease period to ensure that the land is returned to its original condition, unless requested otherwise. Staff may request

Council Staff Report (ID # 5610) Meeting of February 3, 2026 Updated: 1/28/2026 9:16 AM by Alberto Quintanilla A Page 2 that some improvements to the lease area be left in place if they are deemed beneficial to the future park (for example, a gravel parking lot could have the potential to be reused as a base for a future parking lot). LSPGC will be required to abide by all City and agency regulations and to obtain requisite permits, including an encroachment permit and grading permit from the City.
The proposed rate of the ground lease is based on third-party analysis for vacant land within the region and falls within the analyzed range of recent rental comparables. The negotiated rate reflects a fair and reasonable value for a short-term ground lease while ensuring that Fremont retains as much public benefit from the project as possible. Based on the City’s request, LSPGC has agreed to prepay the lease in the lump sum amount of $2,500,344.
FISCAL IMPACT: For the 28-month lease, LSPGC will make an upfront lump-sum payment of $2,500,344. Staff recommends that this payment for use of City parkland, along with any additional payments for extensions of the lease term, be recognized in the Capital Improvement Fund (Fund 501) and appropriated to the new Central Park Community Center project (PWC9087), a citywide recreational park facility.
ENVIRONMENTAL REVIEW: Environmental Review for this item is addressed in two parts.
Environmental review is not required for the lease agreement, as a lease agreement is not a project pursuant to California Environmental Quality Act (CEQA) Guidelines Sections 15378(b)(2) and/or 15378(b)(5). It can be seen with certainty that there is no possibility that authorization of the agreements will have a significant effect on the physical environment per CEQA Guidelines Section 15061(b)(3), each as a separate and independent basis for CEQA compliance.
The California Public Utilities Commission (CPUC) is the lead agency for the Power the South Bay Project for which the lease is being considered. As a Public Utility in the State of California, LS Power Grid California is regulated by the California Public Utilities Commission (CPUC). More specifically, LS Power Grid California is required to obtain a Certificate of Public Convenience and Necessity (CPCN) for the Power the South Bay Project, which includes evaluation under the California Environmental Quality Act (CEQA) with the CPUC serving as the lead agency. All aspects of the Project, including laydown areas, are being evaluated by the CPUC under CEQA. In order to obtain Notice to Proceed (NTP) from the CPUC to begin work, LS Power Grid California has to provide an environmental evaluation of the entire Project, including the laydown area in Fremont, to the CPUC for their evaluation.
Use of the laydown area as part of the Power the South Bay Project will be covered by the CPCN with the CEQA evaluation being completed by the CPUC.

Executive Summary: The purpose of this report is to authorize the City Manager or designee to issue a change order increasing the amount of the purchase order with East Bay Tire Co. by $35,000 for a new not to exceed amount of $130,000 for fiscal year 2025/26.
This increase will allow the City to continue purchasing tires utilizing California General Services (CGS) Contract No. 1-23-26-01B and ensure uninterrupted fleet operations.
BACKGROUND: The City of Fremont (City) routinely purchases tires for its fleet vehicles from East Bay Tire Co., under California General Service Contract No. 1-23-26-01B. Tires are a critical consumable part of the City’s fleet that are essential for maintaining vehicle safety, performance and reliability. Tire costs have increased in recent years due to market conditions and supply chain factors.
DISCUSSION/ANALYSIS: Fremont Municipal Code, Chapter 3.20, authorizes the use of cooperative agreements, and the City can realize cost savings by purchasing tires through California General Services Contract No. 1-23-26-01B. California uses a public competitive solicitation and award process like that required by the City’s Purchasing Code. Finance and the City Manager’s Office have approved the use of this cooperative agreement, and staff recommends that Council authorize the City Manager or designee to amend the purchase order with East Bay Tire Co., for the purchase of tires for City fleet vehicles.
Staff anticipates that the current FY 2025/26 purchase order in the amount of $95,000 will soon be exceeded, and that an additional $35,000 would be needed to meet projected tire replacement needs for the remainder of the fiscal year.
FISCAL IMPACT: There is sufficient funding in the Maintenance Operations Department’s General Fund FY 2025/26 budget to cover this cost.
ENVIRONMENTAL REVIEW: The actions recommended in this report are not projects subject to review under the California Environmental Quality Act (CEQA) per CEQA Guideline section 15378(b)(2) as they are maintenance activities of government.

Executive Summary: The purpose of this report is to authorize the City Manager or designee to issue a change order increasing the amount of the purchase order with Golden State Emergency Service (Golden State) by $85,000, for a new not to exceed amount of $180,000 for fiscal year 2025/26 to facilitate the purchase of parts and services for fire apparatus needed to support operations of the Fire Department.
BACKGROUND: The City of Fremont (City) regularly purchases parts and off-site repair services from Golden State for the City’s fleet of Pierce fire apparatus. Golden State is the exclusive dealer for Pierce Manufacturing Inc. parts and services in Northern California. The costs for parts and services have been increasing over time, and include expenses related to unanticipated repairs to fire apparatus and the need for major repair services.
DISCUSSION/ANALYSIS: Parts and services for Pierce Manufacturing fire apparatus can only be purchased through their authorized dealer, Golden State. These parts are vital to the operation of the City’s fleet of Pierce fire apparatus (fire engines and fire trucks) that are used in the Fire Department’s response to emergency calls for service.
Staff anticipates that the current FY 2025/26 purchase order, in the amount of $95,000, will soon be exceeded, and that an additional $85,000 would be needed to meet the needs of the Fire Department through the remainder of this year.
FISCAL IMPACT: There is sufficient funding in the Maintenance Operations Department’s General Fund FY 2025/26 budget to cover this cost.

ATTACHMENTS: None.
RECOMMENDATION: Authorize the City Manager or designee to increase the existing Purchase Order with Golden State Emergency Vehicle Service by $85,000, for a new not to exceed of $180,000 for FY 25/26.

VETERINARY CARE AND SPAY/NEUTER SERVICES - Authorize the City Manager, or her Designee, to increase the Purchase Order with Aborn Veterinary Hospital for an additional $100,000 for a total not-to-exceed amount of $199,000 for Animals at Tri-City Animal Shelter.

Executive Summary: The purpose of this report is to recommend that the City Council authorize the City Manager, or designee, to increase the existing purchase order with Aborn Veterinary Hospital to provide veterinary care, including spay/neuter services, for animals impounded at the Tri-City Animal Shelter. Aborn has been a valued partner and is the only veterinary provider in Fremont able to accommodate urgent same-day cases for diagnosis, treatment, and surgery.
BACKGROUND: California law requires that all animals in public shelters receive necessary veterinary care, including diagnosis, treatment, and surgery, and that all animals leaving shelters be sterilized. Fremont Municipal Code further mandates sterilization for dogs impounded more than once.
The City has actively recruited a full-time veterinarian and veterinary technician for over a year, but these positions remain unfilled, preventing the shelter from providing inhouse spay/neuter and urgent medical care. Aborn Veterinary Hospital is uniquely positioned to meet these needs immediately, providing same-day care for urgent cases, routine spay/neuter procedures, and convenient proximity to the shelter. This partnership ensures compliance with state and local law and is critical to maintaining animal health, public safety, and effective shelter operations. Meanwhile, recruitment for the veterinarian and veterinary technician position will continue.
DISCUSSION/ANALYSIS: Aborn Veterinary Hospital provides same-day care for urgent cases, routine spay/neuter procedures and is located near the shelter. They also offer the City a reduced “rescue” rate, helping to manage costs. This partnership ensures the City can meet its legal obligations under California law and the Fremont Municipal Code to provide diagnosis, treatment, surgery, and sterilization when needed. With key veterinary positions unfilled, Aborn is essential to sustaining shelter services, protecting animal welfare, and maintaining public safety.
FISCAL IMPACT: The proposal is to increase the purchase order by $100,000, for a total amount of $199,000 for the remainder of Fiscal Year 2025/26. No additional staffing or operational costs are anticipated. This expenditure is within the current fiscal year Animal Services operating budget and ensures compliance with state and local law while maintaining humane, safe, and efficient animal care services.
