Executive Summary: The City of Fremont may, from time to time, apply for State and Federal disaster assistance funding from the California Governor’s Office of Emergency Services (Cal OES), as authorized by the California Disaster Assistance Act (CDAA), or when granted by Federal sources as authorized under the Robert T. Stafford Disaster Relief and Emergency Assistance Act, as amended. As a condition of receiving such assistance, Cal OES regulations, pursuant to the CDAA, require the governing body of a city to pass a resolution designating and authorizing agents to act on behalf of the city for the purpose of obtaining such funding, and to renew such authorization at least once every three years.

BACKGROUND: On March 14, 2023, the City Council of the City of Fremont passed Resolution 2023-16, designating the City personnel authorized to apply for emergency financial assistance in response to declared emergencies.

Under the Robert T. Stafford Disaster Relief and Emergency Assistance Act, as Amended, a public entity may apply for Federal disaster assistance, including under the Federal Emergency Management Agency (FEMA) Public Assistance program, when such assistance has been requested by the Governor and a Major Disaster or Emergency has been declared by the President of the United States. Under the California Disaster Assistance Act (CDAA), a local government may apply for CDAA disaster assistance when the Governor proclaims a State of Emergency and authorizes such assistance, or when the Director of Cal OES authorizes certain assistance.

Additionally, the CDAA provides that the State may contribute a share toward FEMA Public Assistance program funding, reducing the applicable local cost share.

The City of Fremont may occasionally be eligible to apply for other grant funding from Cal OES, including FEMA’s Hazard Mitigation Grant Program and Building Resilient Infrastructure and Communities (authorized under the Stafford Act), the FEMA Flood Mitigation Assistance Program (per Section 1366 of the National Flood Insurance Act, as Amended), National Earthquake Hazards Reduction Program (per 42 U.S. Code Sections 7704(b)(2)(A)(ix) and 7704(b)(2)(B) and the Consolidated Appropriations Act, 2018, Div. F, Department of Homeland Security Appropriations Act, 2018, Pub. L. No. 115-141.), and the California Early Earthquake Warning program (under CA Govt. Code – Gov, Title 2, Div. 1, Chapter 7, Article 5, Sections 8587.8, 8587.11, 8587.12). Cal OES applies the designation of Authorized Agents to matters concerning these funding sources as well.

DISCUSSION/ANALYSIS: Adoption of the proposed resolution would designate certain City staff as agents to enter into agreements and to act on behalf of the City of Fremont in all matters pertaining to State and Federal disaster assistance funding, as required by Cal OES as a condition of eligibility for such funding. Generally, when Federal disaster assistance is authorized to the City of Fremont, FEMA considers Cal OES to be the grantee and the City to be the subgrantee.

Resolution 2023-16 designates the Assistant City Managers, Deputy City Manager, and Finance Director as authorized agents. The proposed resolution designates the same positions.

The City Council may adopt a new resolution designating authorized agents at any time.

FISCAL IMPACT: Adoption of the resolution will permit the City of Fremont to continue to obtain financial assistance for all open and future major disasters proclaimed by the Governor of the State of California and declared by the President of the United States.

ENVIRONMENTAL REVIEW: This action is not subject to review under the California Environmental Quality Act (CEQA) under CEQA Guidelines sections 15378 because the action is an administrative governmental activity that will not result in direct or indirect physical changes in the environment.

RECOMMENDATION: Adopt a resolution designating the Assistant City Managers, Deputy City Manager, and Finance Director as the City of Fremont’s agents to provide required assurances and execute agreements for the purposes of obtaining financial assistance from the State of California Governor’s Office of Emergency Services (Cal OES) and the Federal Emergency Management Agency (FEMA).
