Executive Summary: The purpose of this report is to facilitate support services for the Energy Management System (EMS System) used for City buildings.

Background: The City’s EMS System provides building automation for Heating, Ventilation, and Air Conditioning (HVAC) equipment. A local server runs the Compass Software platform that directly communicates with Ascent Control Module (ACM) global controllers at 37 City buildings. Each ACM communicates with the building’s HVAC system. Through this platform, equipment is programmed through a schedule to start, run, and stop at specific times, measures and control airflow, establishes and monitors temperature setpoints, and aids in equipment maintenance and troubleshooting.

Buildings with this advanced technology include City Hall, all Fire Stations, the Police Department Campus, Animal Shelter, Community Centers, Family Resource Centers, Senior Centers, Libraries, and Administration Buildings.

Discussion/Analysis: Alerton manufactured products have been adopted for use by the City for all EMS locations. For compatibility purposes, it is necessary to continue using Alerton products for the EMS system, and Syserco Inc. is the manufacturer’s authorized local sole source distributor for Alerton products. The City’s most recent five-year agreement with Syserco Inc. expired on March 31, 2026.

The recommended agreement is a five-year Technology Service Agreement beginning July 1, 2026, through June 30, 2031, for preventive maintenance, annual software and cyber security updates, controller firmware updates, disaster recovery, on-call technical support, a 20% discount for onsite technical support, and a 60% discount for all Alerton product purchases.

Fiscal Impact: The initial annual cost of the Technology Service Agreement with Syserco Inc. is $108,857 ($33,857 scheduled services, $25,000 for as needed sole source parts purchases plus $50,000 annually for reactive maintenance contingency). Annual price increases for the scheduled maintenance services amount are based on the
San Francisco-Oakland-Hayward Consumer Price Index for All Urban Consumers (CPI-U) and shall not exceed 4% in any year. Sufficient funding is available in the FY 2026/27 Maintenance Operations Department General Fund adopted operating budget. Future year services will be included in the proposed General Fund operating budget for those years.

Environmental Review: The proposed action and project are categorically exempt from the requirements of the California Environmental Quality Act (CEQA) per each on a separate and independent basis, the following sections of Title 14 of the California Code of Regulations: (1) CEQA Guidelines Section 15061(b)(3), in that the service agreement does not have the potential to cause a significant effect on the environment, and is not subject to CEQA review; and, (2) CEQA Guidelines Section 15301(d), as the scope of work involves repair and maintenance of existing mechanical equipment involving negligible or no expansion of existing or former use.

Executive Summary: Each year, the City of Fremont (“City”) levies annual assessments within Landscaping Assessment District 88 (“District”) for public landscape maintenance. This District currently consists of 47 zones. These zones encompass subdivision tracts that were approved by the City without requiring the formation of homeowners’ associations (HOA). The District maintains public landscaped areas benefiting these subdivisions.

State law requires two Council meetings to complete the annual assessment process. At this first meeting, staff recommend that the City Council initiate proceedings and adopt a resolution declaring its intent to levy and collect assessments within the Districts, preliminarily approving the annual Engineer’s Report detailing calculations of the annual assessments, and setting a public hearing on the proposed assessments for June 16, 2026. The City Clerk provides notice of the public hearing in accordance with the requirements of the Landscaping and Lighting Act, and the public has the opportunity to be heard on the matter.

Based on the Preliminary Engineer’s Report, staff indicate no new improvements or substantial changes in existing improvements are proposed for Fiscal Year (FY) 2026/27, and the proposed assessments will be based on maximum assessment amounts that were duly authorized by property owners within the District through Proposition 218 proceedings.

If the City Council approves the levy at the June meeting, the approved assessments will be forwarded to Alameda County for inclusion on the property tax bills in July.

Background: Ongoing annual assessments and new landscaping districts are regulated by the Landscaping and Lighting Act of 1972 (LLA). This law enables the City to collect fees for installing and maintaining public landscaping and lighting. Assessment amounts are based on the benefit each parcel receives from these improvements.

The County collects assessments with property taxes and transfers them to the City. The Fremont Landscaping Assessment District 88, established in December 1988, allows for individual landscape maintenance zones tied to residential subdivisions. These assessments fund ongoing upkeep of public landscaping in or near subdivisions, enhancing both their appearance and that of the City.

The Preliminary Engineer’s Report displays zone budgets and maximum assessments, with all proposed FY 2026/27 assessments at or below voter-approved limits. About 68% of City-managed zones are at or within $2.00 of the maximum landscaping assessment. Pages 17-18 of the Annual Engineers Report show the difference between current and maximum assessments for each zone.

The City is prohibited from exceeding maximum assessments without property owner approval through a Proposition 218 ballot process. In 2021, the City conducted such a process with Harris & Associates; however, it was unsuccessful. As a result, more zones are expected to reach maximum assessment levels, leading to potential service reductions, deferred maintenance, and limited capital improvements as costs continue to rise.

Discussion/Analysis: To begin levying District 88's annual assessments for FY 2026/27, the City Council must initiate the annual assessment process at a council meeting and adopt a resolution. The resolution declares the City Council’s intent to levy and collect the annual assessments, preliminarily approves the Engineer’s Report, and sets a public hearing for June 16, 2026 for final approval of the proposed assessment amounts for FY 2026/27.

Engineer’s Report: Each year since the establishment of Landscaping Assessment District 88, staff have prepared and submitted an Engineer’s Report to the City Council. For each zone, the Engineer’s Report lists the expected costs (including a reasonable contingency) for the new fiscal year and a carryover cost. The carryover cost is sufficient to pay for the first six months of maintenance since assessments are not collected by the County until property tax bills become due. The City’s and County’s administrative costs are also included. The total is shown on the gross

assessment line of the district budgets. A credit may be applied to each zone, which consists of the projected zone balance as of the end of the current fiscal year, less than a reserve fund. The gross assessment of less than the credit for each zone is divided among its property owners to establish the annual net assessment (Total Balance to Assessment) for each property. Forty-one zones will be assessed in FY 2026/27.

The annual assessments per lot vary considerably among the zones because of the difference in size, character of landscaped areas, and number of lots in the zone. In previous years, the City Council took special action on zone 2 (nine lots in Tract 5847), zone 6 (eight lots in Tract 5950), zone 12 (nine lots in Tract 5558), and zone 16 (seven lots in Tract 6121) to allow the homeowners in these zones to take responsibility for the landscape maintenance themselves. This action foregoes assessing these zones as long as the homeowners are properly maintaining the landscaping. Currently, the homeowners in these four zones are maintaining the landscaping in a satisfactory manner.

Historical Annual Assessments, shown on pages 11 through 15 of the Report, list the assessment amounts for each of the previous years for the 41 zones being assessed. The table also shows the maximum allowable assessments for each zone. The proposed zone assessments for the existing district do not exceed the maximums established for zones 1 through 47.

The notice of public hearing with the Resolution of Intent must be posted and published in a local newspaper, one time, at least 10 days prior to the public hearing. At the public hearing, the Council must consider public comments and written protests to the assessment levy prior to taking action on the item. However, the proposed zone assessments for the existing district do not exceed the maximums established for zones 1 through 47, so a majority protest will be merely advisory to the City Council and will not automatically defeat the proposed assessments.

New zones: There are no new zones proposed for Fiscal Year 2026/27.

Consultant Services: LLMD reserve funds have been allocated to pay the District’s consultant, Harris and Associates, for assisting City staff with statutory compliance requirements, the annual assessment and engineering report, and conducting public outreach with property owners to help them understand the assessment cap and their service options.

Fiscal Impact: The FY 2026/27 annual LLMD assessments are charged to property owners or the City of Fremont to maintain and administer landscaping services within each zone. Contract costs will continue to be paid from District reserve funds.

Environmental Review: The recommended action is not subject to CEQA review because, without limitation, it is not a “project” as defined in CEQA Guidelines Section 15378(b)(2), and/or is exempt from CEQA review under Section 15378(b)(5), and as it can be seen with certainty that there is no possibility that the activity may have significant effect on the environment per CEQA Guidelines Section 15061(b)(3), each as a separate and independent basis for CEQA compliance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FREMONT

DECLARING ITS INTENT TO LEVY AND COLLECT ASSESSMENTS
WITHIN LANDSCAPING ASSESSMENT DISTRICT 88 IN FISCAL YEAR 2026/27, APPROVING THE ENGINEER’S REPORT , AND SETTING THE

PUBLIC HEARING

WHEREAS, the City Council intends to levy annual assessments within the Landscaping Assessment District 88 for fiscal year 2026/2 027 (the “District”) under the Landscaping and Lighting Act of 1972 (the “Act”); and

WHEREAS, an Engineer’s Report supporting the levy of assessments in the District in fiscal year 2026/2027, has been prepared by Harris and Associates, Inc., and the City Council has reviewed the report; and

WHEREAS, the Engineer’s Report includes a full description of the improvements, plans and specifications for the improvements, estimate of costs, assessment district diagram, boundaries of the District and the zones therein, and method of apportionment upon assessable lots and parcels of land, as required by the Act; and

WHEREAS, the improvements in the District are generally described as the maintenance of public landscaped areas in or adjacent to the District; monitoring and removal of litter and weeds; mowing lawns and pruning plants; installing and operating irrigation systems; and providing prompt response to broken water lines, damaged plants, and other maintenance concerns; and

WHEREAS, the proposed assessments levied within the District will not exceed the maximum amounts that were duly authorized in 1997 and subsequent years by property owners through Proposition 218 proceedings, as shown in the Engineer’s Report.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT RESOLVES AS FOLLOWS:

SECTION 1. Incorporation of Recitals. The foregoing recitals are incorporated herein by this reference.

SECTION 2. The City Council declares its intent to levy and collect assessments within the City of Fremont ’s Landscaping Assessment District 88 in fiscal year 2026/2 027, based on the Engineer’s Report prepared by Harris and Associates, Inc.

SECTION 3. The City Council approves the Engineer’s Report and finds that the report complies with the requirements of the Act.

SECTION 5. The City Clerk is directed to give notice of the public hearing as required by law.

The preparation of this Annual Engineer’s Report (“Report”) is in conformance with the obligation of the City Council for the Landscaping Assessment District of the City of Fremont to provide landscaping services upon each lot or parcel of land in the district in proportion to the estimated benefit to be received by each such lot or parcel of land for Fiscal Year 2026–2027.

Pursuant to the Landscaping and Lighting Act of 1972 (Part 2 Division 15 of the Streets and Highways Code of the State of California, commencing with Section 22500) (“Act”), Article XIIID, Section 4(a) of the State of California Constitution, and in accordance with the City of Fremont’s Resolution adopted by the City Council for the Fremont Landscaping Assessment District, this Report has been ordered for:

District Diagram: This part incorporates a Diagram of the District showing the external boundaries of the District and Zones. The lines and dimensions of each lot or parcel within the District are those lines and dimensions shown on the maps of the Alameda County Assessor for the year in which this Report was prepared and are incorporated by reference herein and made part of this Report. The District Diagram is filed under separate cover with the office of the City Clerk

PART IV
Method of Apportionment of the Assessments: This part describes the method of apportionment of assessments, based upon parcel classification of land within the District in proportion to the estimated special benefits to be received. The costs and expenses of the District have been assessed upon the parcels of land within the boundaries of District pursuant to the initial methodology established by Resolution No. 7495 approved on the 20th day of December, 1988. For particulars as to the identification of parcels, reference is made to the District Diagram. In June of 1997, the property owners in the District were balloted and approved a Maximum Assessment within each Zone, bringing the District into compliance with the provisions of Proposition 218.

3 PART I – PLANS AND SPECIFICATIONS
Plans and Specifications
The District was formed for the purpose of ensuring the ongoing operation, maintenance and servicing of certain landscaping improvements within the boundaries of the District. Said improvements are detailed below under “Improvements and Services Provided”.

The District is within the boundaries of the City and consists of 47 individual Zones of benefit located throughout the City of Fremont.

The District was originally established in December 1988 as a citywide district that allows for the formation of individual landscape maintenance zones in conjunction with the approval of subdivision maps.

On June 24, 1997, following the adoption of Article XIII D of the California Constitution (Proposition 218), property owners within Zones 1 through 37 (with the exception of Zones 18 and 22) approved the establishment of maximum annual assessment amounts in accordance with Proposition 218 requirements. In subsequent years, property owners similarly approved the formation of Zones 38 through 47 and authorized corresponding maximum assessment amounts through Proposition 218-compliant proceedings.

The District currently includes Zones 1 through 17, 19 through 21, and 23 through 47. Zones 18 and 22 are not included, as property owners submitted majority protests for those zones in 1997.

Accordingly, the assessments levied within the District are based on maximum assessment amounts that were duly authorized through Proposition 218 proceedings and are not subject to the limitations applicable to pre -Proposition 218 assessments that were not subsequently approved by property owners.

Improvements and Services Provided

The District provides landscaping improvements (“Improvements”) and services, including trees, shrubs, turf, etc., for medians and streetscapes within the public right -of-way. The Improvements also include irrigation systems to keep the landscaping Improvements in a healthy, vigorous condition. The location of the Improvements within each Zone is shown on the individual Zone maps located in Appendix B. The Zone maps also show the boundaries of each Zone. The Zone number and the assessable parcel count within each Zone are shown in the Estimate of Cost tables on the following pages.

The Zones shown below (Zones, 2, 6 , 12 and 16) are currently inactive. Additionally, Zones 18 and 22 are not being assessed due to a majority protest in June of 1997.

Zone 2 – The property owners within Zone 2 have elected to maintain the landscaping on Las Palmas Avenue at their own expense. The City Council approved the proposal on July 10, 1990. The City requires this Zone to remain in -tact, within the District with no annual assessment to the properties, so long as the landscaping is maintained to the satisfaction of the City. The City reserves the right to begin assessing the properties if the landscaping is not maintained properly.

4 Zone 6 – The property owners within Zone 6 have elected to maintain the landscaping on Peralta Boulevard at their own expense. The City Council approved the proposal on July 13, 1993. The City requires this Zone to remain in -tact, within the District with no annual assessment to the properties, so long as the landscaping is maintained to the satisfaction of the City. The City reserves the right to begin assessing the properties if the landscaping is not maintained properly.

Zone 12 – The property owners within Zone 12 have elected to maintain the landscaping on Overacker Avenue and Mowry Avenue at their own expense. The City Council approved the proposal on July 2, 1991. The City requires this Zone to remain in-tact, within the District with no annual assessment to the properties, so long as the landscaping is maintained to the satisfaction of the City. The City reserves the right to begin assessing the properties if t he landscaping is not maintained properly.

Zone 16 – The property owners within Zone 16 have elected to maintain the landscaping on Pickering Avenue at their own expense. The City requires this Zone to remain intact, within the District with no annual assessment to the properties, so long as the landscap ing is maintained to the satisfaction of the City. The City reserves the right to begin assessing the properties if the landscaping is not maintained properly.

Reference is made to the plans and specifications for the improvements within each Zone which are on file with the City and are incorporated herein by reference.

Estimate of Costs
Estimated costs for Fiscal Year 2026-2027 for the construction, operation, servicing and maintenance of the landscaping and lighting facilities described in Part 1 are shown in the tables on the following pages.

Section 22569 (a) of the 1972 Act allows the District assessments to “…include a reserve which shall not exceed the estimated costs of maintenance and servicing to December 10 of the fiscal year, or whenever the city expects to receive its apportionment of special assessments and tax collections from the county, whichever is later.” The reserve balance includes an operating reserve described above and a capital reserve for the future replacement of District improvements
