Executive Summary: The California Public Employees’ Retirement System (CalPERS) requires that the pay rates used to calculate retirement benefits be listed in a publicly available salary schedule that is formally approved and adopted by the City Council at a public meeting. To comply with CalPERS’ requirements and formalize recent changes in employee compensation, staff seeks Council approval and adoption of revised Citywide Salary Schedules.

Background: Under Fremont Municipal Code Section 2.25.210 (Salary Entitlement), the rates of compensation for all employee classifications are set in accordance with the salary ranges established through negotiated Memorandums of Understanding (MOUs) or by the City Manager and are compiled in Citywide Salary Schedules. The California Public Employees' Retirement System (CalPERS) uses pay rates to determine retirement benefits and requires pay rates be set out in a publicly available salary schedule approved by the City Council. The current Citywide Salary Schedules are published on the City’s publicly accessible website and will be revised following Council approval and adoption.

Discussion/Analysis: CalPERS retirement benefits are based on compensation earnable for classic members, as defined under Government Code Section 20636, and pensionable compensation for new members, as defined under Government Code Section 7522.34. To qualify as compensation earnable or pensionable compensation for purposes of retirement benefits, the pay rates must be identified in a publicly available pay schedule.

Title 2, Section 570.5 of the California Code of Regulations provides that to be considered a publicly available pay schedule, a pay schedule meet the following eight criteria:

Council Staff Report (ID # 5697) Meeting of April 21, 2026 Updated: 4/17/2026 11:28 AM by Dina Lewis Page 2
(1) Has been duly approved and adopted by the employer’s governing body in accordance with requirements of applicable public meeting laws.
(2) Identifies the position title for every employee position. (3) Shows the pay rate for each identified position, which may be stated as a single amount or as multiple amounts within a range. (4) Indicates the time base, including, but not limited to, whether the time base is hourly, daily, bi-weekly, monthly, bi-monthly, or annually.
(5) Is posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer’s internet website. (6) Indicates an effective date and date of any revisions. (7) Is retained by the employer and available for public inspection for not less than five years.
(8) Does not reference another document in lieu of disclosing the pay rate.

The City’s Human Resources Department is responsible for ongoing compliance with the requirements above and has prepared updated Citywide Salary Schedules to reflect recent compensation changes, resulting from negotiated MOUs or consistency with the City Manager’s authorities and responsibilities in Municipal Code Section 2.25.210 and Article VI of the Personnel Rules. The attached Citywide Salary Schedules incorporate the following changes:
1) Implementation of salary increases associated with successor Memorandums of Understanding (MOUs) approved in 2025
and 2026;
2) Implementation of salary increases for Unrepresented Fremont Officials (UFO), Unrepresented Management Employees (UME), and Confidential Employees;
3) Classification and compensation changes resulting from organizational and/or market studies.

Fiscal Impact: The approval of updated Citywide Salary Schedules for City employment classifications will not result in any changes to the current compensation of any employee as such changes have already been implemented and previously reflected in budgetary allocations.

Environmental Review: The proposed action is exempt from and not subject to review under the California Environmental Quality Act (CEQA) Council Staff Report (ID # 5697) Meeting of April 21, 2026 Updated: 4/17/2026 11:28 AM by Dina Lewis Page 3
either because it is not a “project” as defined in CEQA Guidelines Section 15378(b), or because it can be seen with certainty that there is no possibility that the action may have a significant effect on the environment as specified in CEQA Guidelines Section 15061(b)(3), each as a separate and independent basis for CEQA compliance.

ATTACHMENTS:
• Draft Resolution 4-2026
• Salary Schedule for Regular Full Time and Part Time Employees 4-6-2026 • Temp Salary Schedule 7825

Recommendation: Adopt a resolution approving and adopting the revised City of Fremont Citywide Salary Schedules.
