RESOLUTION NO. 2026-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FREMONT
DECLARING ITS INTENT TO LEVY AND COLLECT ASSESSMENTS
WITHIN LANDSCAPING ASSESSMENT DISTRICT 88 IN FISCAL YEAR 2026/27, APPROVING THE ENGINEER’S REPORT , AND SETTING THE
PUBLIC HEARING
WHEREAS, the City Council intends to levy annual assessments within the Landscaping Assessment District 88 for fiscal year 2026/2 027 (the “District”) under the Landscaping and Lighting Act of 1972 (the “Act”); and
WHEREAS, an Engineer’s Report supporting the levy of assessments in the District in fiscal year 2026/2027, has been prepared by Harris and Associates, Inc., and the City Council has reviewed the report; and
WHEREAS, the Engineer’s Report includes a full description of the improvements, plans and specifications for the improvements, estimate of costs, assessment district diagram, boundaries of the District and the zones therein, and method of apportionment upon assessable lots and parcels of land, as required by the Act; and
WHEREAS, the improvements in the District are generally described as the maintenance of public landscaped areas in or adjacent to the District; monitoring and removal of litter and weeds; mowing lawns and pruning plants; installing and operating irrigation systems; and providing prompt response to broken water lines, damaged plants, and other maintenance concerns; and
WHEREAS, the proposed assessments levied within the District will not exceed the maximum amounts that were duly authorized in 1997 and subsequent years by property owners through Proposition 218 proceedings, as shown in the Engineer’s Report.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT RESOLVES AS FOLLOWS:
SECTION 1. Incorporation of Recitals. The foregoing recitals are incorporated herein by this reference.
SECTION 2. The City Council declares its intent to levy and collect assessments within the City of Fremont ’s Landscaping Assessment District 88 in fiscal year 2026/2 027, based on the Engineer’s Report prepared by Harris and Associates, Inc.

SECTION 3. The City Council approves the Engineer’s Report and finds that the report complies with the requirements of the Act.
SECTION 4. The City Council will hold a public hearing on this matter on Tuesday, June 16, 2026, at 7:00 p.m. in the City Council Chambers, 3300 Capitol Avenue, Fremont.
SECTION 5. The City Clerk is directed to give notice of the public hearing as required by law.
