Background: Fremont has a long-standing history of commitment to equity and inclusion ensuring access to essential services, and public safety for all residents regardless of immigration status. To further this commitment in 2017 Fremont declared itself a Compassionate Sanctuary City.
Numerous neighboring jurisdictions including the cities of San Jose, Oakland, Richmond, Santa Clara, Sunnyvale and Pinole, and the counties of Alameda, Santa Clara and San Francisco have implemented restrictions on the use of City/County owned, leased, controlled, or operated property for federal civil immigration enforcement known as ICE-Free Zones. Cities and counties are taking this action to preserve trust and safety in the community and to foster a positive supportive relationship between agencies providing services and the people using them.
Direction: This referral would direct staff within 30 days to develop a draft ordinance and implementation plan which would prohibit the use of city-owned, city-leased, city-controlled and city-operated properties for federal civil immigration enforcement activity including but not limited to as a staging area, processing location, detention location, or operations base.
The draft implementation plan shall inventory and identify City of Fremont owned leased, controlled, or operated properties that could be used for federal civil immigration enforcement. The plan shall identify signage, training, internal and external communications plans, and any other actions necessary to prohibit the use of city-owned, city-leased, city-controlled, and city-operated properties federal for civil immigration enforcement activities, along with any potential costs.
