Executive Summary: The purpose of this report is to approve Final Tract Map 8596 and improvement agreements for public and private infrastructure associated with a 13-unit development (12 residential units and one commercial unit), commonly known as Ellsworth Mixed Use.

Background: On October 13, 2022, the City Council approved Vesting Tentative Tract Map 8596 for the 1.12 acre property at 43401 Ellsworth Street in the Mission San Jose Community Plan Area. The developer is Robson Homes, LLC. The Final Map creates 16 parcels to allow for 1 commercial unit, and 12 residential units consisting of six duet units in three buildings and six detached townhomes. The Project’s site plan is attached to this report for reference.

Discussion/Analysis: The Final Map is in conformance with the Vesting Tentative Map and the developer has complied with all Tentative Map Conditions of Approval. The Final Map and Improvement Plans have been reviewed and are now ready for City Council approval.

The developer has signed the Public Improvement Agreement and has posted performance and labor and material bonds each in the amount of $688,000.00 to guarantee construction of the public improvements (Ellsworth Street, Grove Avenue, and Bryant Street). Public improvements include curb, gutter, sidewalk, driveway, pavement, landscaping, signing and striping, utilities including storm drain, water, sanitary sewer, joint trench, and other miscellaneous items of work as identified on the approved improvement plans.

The developer has signed the Private Improvement Agreement and has posted performance and labor and material bonds each in the amount of Council Staff Report (ID # 5746) Meeting of June 9, 2026 Updated: 6/5/2026 9:31 AM by Alberto Quintanilla Page 2 $1,270,000.00 to guarantee construction of the private and common area improvements (Festas Common and Velas Common). Private improvements include the construction of private streets, installation of stormwater facilities, vehicular parking to serve the residents, and other miscellaneous items of work as identified on the approved improvement plans.

The developer anticipates starting construction immediately following approval of the Final Map and Improvement Agreements and finishing construction approximately late 2027.

Fiscal Impact: None.

Environmental Review: Approval of final subdivision maps is statutorily exempt from the California Environmental Quality Act (CEQA), Statutory Exemptions, Title 14 of the California Code of Regulations Section 15268(b)(3) Ministerial projects. The Final Map and Improvement Plans are consistent with the General Plan and Zoning Ordinance, original project description, and scope of work. No further environmental review is required.
