ORDINANCE NO. XX-2026

AN ORDINANCE OF THE CITY OF FREMONT AUTHORIZING

AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY

OF FREMONT AND THE BOARD OF ADMINISTRATION OF THE
PULBIC EMPLOYEES’ RETIREMENT SYSTEM
WHEREAS, the City of Fremont (“City”) entered into a contract with the California Public Employees’ Retirement System (“CalPERS”) in 1958 and numerous amendments since that date; and
WHEREAS, the City and its bargaining units that represent employees in Safety positions (Police and Fire) have agreed that Safety employees classified as “New Members” under the Public Employees’ Pension Reform Act of 2013 (“PEPRA”) will contribute a total combined maximum of 12% towards employee retirement costs, consisting of the required statutory employee contribution and an additional employee cost share; and WHEREAS, effective July 1, 2025, CalPERS increased the required employee contribution for Safety New Members, which has resulted in the City’s Safety New Members contributing a total of 12.5% towards employee retirement costs; and

WHEREAS, to implement and maintain the negotiated cost-sharing terms for Safety New Members, an amendment to the City’s contract with CalPERS contract is required.
