Executive Summary: The purpose of this report is to facilitate vacating a remnant portion of Warm Springs Court, reserving a public service easement over the entire area.
Background: 101 Realty Investment LLC, property owner and developer of the 1.10-acre site located at 2066 Warm Springs Court, has submitted an application for a street right-of-way vacation for a portion of Warm Springs Court. The applicant seeks to use the area to expand the commercial viability of 2066 Warm Springs Court by taking an unused and underdeveloped area of land and adding site amenities such as parking to support the businesses on site. No formal application for redevelopment of the subject area is proposed at this time; however, any future development projects would be subject to the standard City permitting requirements and procedures.
On April 1, 2026, the Planning Manager found that vacating the subject street portion conforms with the General Plan as required by Streets and Highways Code Section 8313 (a) of the State of California, Section 65402 of the Government Code, and Section 2.20.310 (b) of the Fremont Municipal Code.
On July 21, 2026, the City Council approved an action to initiate the street vacation process and set a public hearing for September 1, 2026.
Discussion/Analysis: The City Council may initiate the proceedings to vacate these portions of excess right -of-way in accordance with Section 8320 of the Streets and Highways Code of the State of California.

Council Staff Report (ID # 5801) Meeting of September 1, 2026 Updated: 8/27/2026 9:14 AM by Alberto Quintanilla Page 2 The proposed vacation pertains to Warm Springs Court which was a portion of the historic Irvington–Warm Springs Road, one of the primary late-19th and early-20th-century routes connecting the former townships of Irvington and Warm Springs prior to Fremont’s 1956 incorporation. The corridor also overlapped with early alignments associated with pre-1964 State Highway No. 17, which once passed through the Warm Springs area before being replaced by the modern interstate system. The general area was previously reserved for a widening effort of Warm Springs Boulevard (PWC8498). The street widening has since been completed and an underdeveloped section of public right-of-way adjacent to Warm Springs Boulevard was left remaining.
Staff has determined this portion of Warm Springs Court is no longer needed as a public street.
All concerned utility companies have been notified and consent to the proposed vacation subject to reservation of a Public Service Easement (PSE) across the entire area. The PSE will benefit the City of Fremont, Union Sanitary District (USD), Alameda County Water District (ACWD), and Pacific Gas and Electric (PG&E) for the construction and maintenance of existing utilities, ingress and egress, and for the area to be kept open and free of buildings, structures, wells or other obstructions.
The title report indicates that the City of Fremont owns the underlying fee interest of the area proposed to be vacated. The developer has agreed to acquire the vacated right-of-way for $112,000 which is the fair market value as determined by an independent third-party appraiser.
Notice of the City Council public hearing to consider vacating a remnant portion of Warm Springs Court was published in the Tri-City Voice for two consecutive weeks prior to the hearing, and signs notifying the public of the public hearing were posted along the street right-of-way to be vacated at least two consecutive weeks prior to the hearing in conformance with Streets and Highways Code Sections 8320, 8322, and 8323. No new information regarding this proposed vacation has been received since the July 21st Council meeting.
Fiscal Impact: Disposition of City-owned land would result in proceeds of $112,000 to the City. California Streets and Highways Code Section 8357 specifies that the purchase price shall be credited to any fund available for the same purposes for which the property being vacated was used.
Proceeds from the sale will be credited to the General Fund.

Council Staff Report (ID # 5801) Meeting of September 1, 2026 Updated: 8/27/2026 9:14 AM by Alberto Quintanilla Page 3 Environmental Review: The proposed vacation is categorically exempt from environmental review, pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15305, because the action is considered a minor alteration to land use limitations that does not result in any land use or density changes. The vacation is consistent with the land use envisioned for the site as established by the General Plan and for which an Environmental Impact Report (SCH#2010082060) was previously prepared and certified, and none of the conditions that would require the preparation of a supplement to an EIR are present.

2. Adopt a resolution that:
a. Orders the vacation of a portion of Warm Springs Court, reserving an easement over the entire area as depicted and described in the plat and legal description, and conditioned upon the City’s receipt of $112,000 payment for the fair market value of the area to be vacated;
b. Authorize the sale of the land and appropriate the sale proceeds of $112,000 into the General Fund;
c. Authorize the City Manager or designee to execute a grant deed conveying the area to be vacated as shown in the plat and legal description to 101 Realty Investment LLC, a California Limited Liability Company, or its successor(s) in interest at the fair market value of $112,000; and
d. Make findings, including findings of CEQA exemption.

RESOLUTION NO. 2026-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FREMONT
APPROVING A GENERAL VACATION OF A SURPLUS PORTION OF
WARM SPRINGS COURT IN THE SOUTH FREMONT COMMUNITY
PLAN AREA
WHEREAS, California Streets and Highways Code Sections 8320 et seq., establish the procedure for the general vacation of streets and street easements that are no longer needed for present or prospective public use; and
WHEREAS, pursuant to Section 8324 of the Streets and Highways Code, the City Council is authorized to approve a general vacation of a road or highway (or portion thereof), if the roadway is unnecessary for present or prospective public use; and
WHEREAS, the City of Fremont (“City”) is considering a general vacation of remnant portion of Warm Springs Court right-of-way (“Roadway”) as depicted on Exhibits “A and B” (Legal Description and Plat), attached and incorporated herein by reference; and
WHEREAS, Warm Springs Court is a remnant of the historic Irvington–Warm Springs Road, one of the primary late -19th and early -20th-century routes connecting the former townships of Irvington and Warm Springs prior to Fremont’s 1956 incorporation; and
WHEREAS, on July 21, 2026, the City Council held a public meeting at which the general vacation was scheduled for public hearing on September 1, 2026. Notice of the public hearing was published for two consecutive weeks in the Tri-City Voice, and signs were posted along the area to be vacated and reserved at least two consecutive weeks prior to the hearing in conformance with Streets and Highways Code Sections 8320, 8322, and 8323; and
WHEREAS, the Department of Public Works supports the general vacation of the excess right-of-way and has determined that said right -of-way constitutes surplus right-of-way and is no longer needed for present or prospective public use. The portion of Warm Springs Court proposed for vacation would not be useful as a non -motorized transportation facility because Warm Springs Court was previously realigned and sidewalks exist along the new realignment; and
WHEREAS, all concerned public utilities have been notified and consent to the proposed vacation, subject to certain conditions; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT RESOLVES AS FOLLOWS:
SECTION 1. Based on the foregoing recitals, incorporated herein by reference, the City Council approves the general vacation of the Roadway as described and depicted in Exhibits A and B

Executive Summary: At a special meeting on July 28, 2026, the City Council opted to defer consideration of a City charter to a future election. As part of that decision, the City Council directed City staff to return with a list of items from the draft City charter that can be considered and/or adopted through existing legislative and administrative authority under the City’s current general law structure. This report is responsive to that direction and presented for the City Council’s review and direction.
Background: In February 2026, the City Council adopted then-Vice Mayor Yajing Zhang’s referral to explore transitioning the City of Fremont from a general law city to a charter city. Subsequently, the City Council developed and adopted a charter work plan and approved the Mayor’s appointments to a Charter Advisory Committee (“Committee”). The Committee convened six meetings in the months of March and April 2026 to develop recommendations responsive to the City Council-approved charter work plan.
On June 2, 2026, and July 7, 2026, the City Council held two public hearings as required by State law to consider the Committee’s recommendations and provide feedback on the draft City charter. The City Council initially approved the Committee’s recommendations and during the public hearings, Council suggested additional amendments to the draft Charter. Subsequent to each public hearing, City staff amended the draft City charter to incorporate the City Council’s feedback and direction.
On July 28, 2026, the City Council decided to defer consideration of a City charter to a future election and directed City staff to return with a list of items from the draft City charter that can be considered and/or adopted through existing legislative and administrative authority under the City’s current general law structure.

Mayor Salwan Referral: Designation of League of California Cities Annual Conference Voting Delegate and up to two Alternates.
Consistent with the League bylaws, a City’s voting delegate must be designated by the City Council. The City Council may also appoint up to two alternate voting delegates, one of whom may vote if the designated voting delegate is unable to serve in that capacity. The League’s bylaws now require that designating the voting delegate and alternates must be done by City Council action and cannot be accomplished by individual action of the mayor or city manager alone.
The League’s 2026 Annual Conference is scheduled for September 23-25, 2026, and an important part of the Annual Conference is the Annual Business Meeting, scheduled for Friday, September 25. At this meeting, the League membership considers and takes action on resolutions that establish League policy. To remain consistent with League bylaws, I am recommending appointing Councilmember Shao as the City’s voting delegate and Councilmember Campbell as the voting alternate.
Recommendation: By motion, appoint Councilmember Shao as the City’s voting delegate for the League of California Cities Annual Conference and Councilmember Campbell as the voting alternate.

Applications for Boards, Commissions, & Committees
The City Clerk’s Office welcomes applications for all Boards, Commission and Committees year round.
Each year, the City Clerk keeps a current list of applicants. Applications are public records.
You may submit an application at any time between January 1 and December 31. The City may consider your application for any vacancy that comes up during that year.
On December 31, all unselected applications expire. If you would like to be considered again, you must submit a new application.
This process allows the Mayor to review applications already on file if a vacancy comes up. A vacancy may occur if someone resigns, is no longer eligible to serve, or their term ends.
The Citizens Advisory Committee typically meets about six times per year, at 6:00 p.m. during the months of December through March. Special meetings, if warranted, are scheduled on an as-needed basis.

* Why do you wish to serve as member of this Advisory Body? I have a strong background in education, combined with my academic training (Master’s, B.Ed., and PhD), has equipped me with strong communication, cultural competence, analytical thinking, and collaborative problem‑solving skills. I believe that meaningful change happens when all voices are heard, especially those who are often overlooked. My wish to serve on the Human Relations Commission because I am deeply committed to promoting equity, inclusion, and community well‑being in Fremont. I have been in the teaching profession since 2000, including 15 years as a lecturer, and I currently work as a Resource Specialist in an elementary school. Through these roles, I have worked closely with students and families from diverse cultural, linguistic, and socioeconomic backgrounds. Many of the individuals I support facing challenges, related to language barriers, disability, mental health needs, and limited access to essential services. These experiences have given me a strong understanding of the issues that impact underserved communities and the importance of creating systems that are fair, accessible, and supportive. I believe that serving on this Advisory Body would allow me to contribute my professional experience and advocate for policies that strengthen community connections and improve the quality of life for all residents. I am particularly passionate about improving access to services, supporting mental health initiatives, strengthening community engagement, and promoting inclusive programs that reflect Fremont’s diversity. I believe that meaningful change happens when all voices are heard, especially those who are often overlooked. I hope to bring strengths and create a positive environment to the Commission and work alongside others who are dedicated to building a more equitable, welcoming, and connected Fremont.

My field provided me deep understanding of the challenges faced by multilingual families, students with disabilities, and individuals navigating mental health and socioeconomic barriers. These experiences give me a grounded, real ‑world perspective on
the needs of underserved groups in our community. Teaching work work requires strong communication skills, cultural competence, empathy, and the ability to collaborate with families from many backgrounds. I regularly support individuals who face obstacles related to language access, disability services, and limited awareness of available resources. This has strengthened my ability to listen carefully, identify gaps in support systems, and advocate for solutions that promote fairness and inclusion. I will bring a strong academic foundation that includes my Master's degree, B.Ed., and PhD, which have strengthened my analytical thinking, research skills, and ability to understand complex social issues. Fremont’s civic process and want to contribute at a higher level of impact. I regularly attend City Council and board meetings, give public comment, and stay involved in local discussions that shape policy decisions. Through this consistent participation, I have seen how decisions made at the city level directly affect community trust, access to resources, and the everyday experiences of residents, especially youth. My involvement is not occasional or symbolic. I show up, follow issues over time, and work with the city to improve outcomes for young people. Whether through organizing civic initiatives, engaging with elected officials, or advocating for policies that expand participation, I have focused on making local government more responsive and inclusive. Serving on the Commission would allow me to move from public comment to structured, ongoing contribution, where I can help shape recommendations that address discrimination, representation, and equity in a sustained way. Fremont has a large and diverse youth population whose perspectives are often underrepresented in formal decision-making spaces. Many of the issues the Commission addresses, including bias, inclusion, and community relations, directly affect youth in schools and public environments. I want to ensure those experiences are reflected in the Commission’s work and that policies are designed with long-term community impact in mind.
*
I bring a consistent, demonstrated record of civic engagement and youth advocacy. I regularly give public comments, attend meetings, and engage directly with city officials, which has given me a clear understanding of how local government operates and where gaps in representation exist. I have worked on initiatives focused on increasing civic participation, including organizing voter outreach and developing policy proposals aimed at expanding youth engagement in government. This experience has required coalition-building, communication, and the ability to translate community concerns into actionable policy ideas. I understand both the formal structures of decision-making and the informal barriers that prevent many residents, especially young people, from participating. As a result, I can contribute a perspective that is grounded in real community interaction, not just theory. I would bring a perspective that emphasizes accessibility, accountability, and inclusion. I am accustomed to showing up, following through, and working collaboratively with institutions to improve outcomes. My focus would be on ensuring that the Commission’s work reflects the full diversity of Fremont and that its recommendations lead to measurable improvements in how residents experience the city.
