Executive Summary: The purpose of this report is to facilitate vacating a portion of Sutton Loop, which is located at the rear of 3366 Peralta Boulevard.
Background: Hasmukh Patel, property owner of 3366 Peralta Boulevard has submitted an application for a street right-of-way vacation for a portion of Sutton Loop. The applicant currently accesses the property from Peralta Boulevard and seeks to increase buildable area at the rear of the property along Sutton Loop. No formal application for redevelopment of the property is proposed at this time; however, any future development would be subject to the standard City permitting requirements and procedures. Concurrently with the application for the street vacation, the property owner has signed grant deeds to dedicate a 29-foot roadway easement and a 5-foot pedestrian access and sidewalk easement along Peralta Boulevard for future roadway improvements.
Sutton Loop was dedicated to the City as part of the requirement for construction of public street improvements associated with the approval of Tract Map 2447, recorded September 13, 1963. The subject property was not included within Tract 2447 which resulted in an excess of 19 feet of street right-of-way at the rear of 3366 Peralta Boulevard along Sutton Loop.
Discussion/Analysis: California Streets and Highways Code Section 8334 allows the City to summarily vacate excess right-of-way when it is “not required for street or highway purposes.” The area to be vacated is currently unimproved and is not required for street purposes as the remaining right- of-way is sufficient to accommodate the roadway. City staff have determined that the unused street right-of-way is no longer needed for present or prospective roadway use.
Council Staff Report (ID # 5802) Meeting of September 1, 2026 Updated: 8/27/2026 11:06 AM by Alberto Quintanilla Page 2 Notification to Utility Companies: All concerned utility companies have been notified and consented to the proposed vacation of the street right-of-way.
General Plan Finding: On July 9, 2026, the Planning Manager found that vacating the subject street portion conforms with the General Plan as required by Streets and Highways Code Section 8313 (a) of the State of California, Section 65402 of the Government Code, and Section 2.20.310 (b) of the Fremont Municipal Code.
The property owner has signed grant deeds to dedicate a 29-foot roadway easement (1,885 square feet of right-of-way) and 5-foot pedestrian access and sidewalk easement (325 square feet) along Peralta Boulevard to allow for future roadway improvements on Peralta Boulevard. A grant deed related to the street vacation (1,235 square feet) will be recorded concurrently with those grant deeds to transfer title of the area on Sutton Loop to the property owner of 3366 Peralta Boulevard.
Fiscal Impact: None.
Environmental Review: The vacation of the roadway easement is exempt from environmental review, pursuant to California Environmental Quality Act (CEQA) Guidelines, Section 15305, because the action is considered a minor alteration to land use limitations which does not result in any land use or density changes.
