RESOLUTION NO. 2026-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FREMONT
SUMMARILY VACATING A PORTION OF SUTTON LOOP AT
3366 PERALTA BOULEVARD , LOCATED IN THE CENTERVILLE
COMMUNITY PLAN AREA
WHEREAS, Section 8334 of the California Streets and Highways Code authorizes the legislative body of a local agency to summarily vacate a street or highway for any of the following conditions: (a) An excess right-of-way of a street or highway not required for street or highway purposes, and (b) A portion of a street or highway that lies within property under one ownership and that does not continue through such ownership or end touching property of another; and
WHEREAS, the Applicant/Developer of the property located at 3366 Peralta Boulevard has requested approval of a summary vacation of a portion of Sutton Loop that is located at the rear of 3366 Peralta Boulevard as described and dep icted in Exhibits A and B, attached and incorporated herein by this reference; and
WHEREAS, the Department of Public Works supports the summary vacation of the excess right -of-way and has determined that said right -of-way is not required for public road purposes or for future circulation needs of the public. Furthermore, there are no public utility facilities in place that are in use and would be affected by the vacation , and all concerned utility companies have been notified and consent to the proposed vacation; and
WHEREAS, the Community Development Department has evaluated the proposed summary vacation and has determined that it is exempted from CEQA and consistent with the City of Fremont General Plan as required by Section 8313 (a) of the Streets and Highways Code, Section 65402 of the Government Code, and Section 2.20.310 (b) of the Fremont Municipal Code.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT RESOLVES AS FOLLOWS:
SECTION 1. Based on the foregoing recitals, t he Fremont City Council approves the summary vacation of a portion of Sutton Loop that is located at the rear of 3366 Peralta Boulevard as described and depicted in Exhibits A and B pursuant to Section 8334 of the California Streets and Highways Code, conditioned upon concurrent recording of the following grant deeds:
A. Grant deed related to the street vacation (1,235 square feet) to transfer title of the area on Sutton Loop to the property owner of 3366 Peralta Boulevard.
B. Grant deed to dedicate a 29-foot roadway easement (1,885 square feet of right-of- way) and 5-foot pedestrian access and sidewalk easement (325 square feet) along Peralta Boulevard.

SECTION 2 . The proposed vacation is categorically exempt from environmental review, pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15305, because the action is considered a minor alteration to land use limitations that does not result in any land use or density changes. The vacation is consistent with the land use envisioned for the site as established by the General Plan and for which an Environmental Impact Report (SCH#2010082060) was previously prepared and certified, and none of the conditions that would require the preparation of a supplement to an EIR are present.
SECTION 3. The City Clerk shall cause a certified copy of this Resolution attested under seal, including Exhibit s A and B, to be recorded in the office of the County Recorder of Alameda County and return one copy each to the Planning Division of the Community Development Department and the Engineering Division of the Public Works Department for their resp ective files.
