RESOLUTION NO. 2026-XX

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FREMONT AUTHORIZING AND RESTATING THE CITY’S

CONTRIBUTIONS TO HEALTH AND WEFLARE BENEFITS

FOR ACTIVE MEMBERS OF THE CITY COUNCIL

WHEREAS, California Government Code sections 36516(d) and 53201 authorize the City Council to determine retirement, health, and welfare benefits for its members; and

WHEREAS, California Government Code section 36516(d) provides that any amounts paid by the City for retirement, health and welfare benefits for City Councilmembers shall not be included for purposes of determining salary, provided that the same benefits are available and paid by the City for its employees; and

WHEREAS, California Government Code section 53208.5(b) states that the health and welfare benefits of City Councilmembers shall be no greater than the most generous received by nonsafety employees of the City; and

WHEREAS, in order to remove barriers to serving on the City Council, it is the intent of the City Council to provide health and welfare benefits through premium contributions for active City Councilmembers in the same amount as received by part-time unrepresented management employees of the City, including any future increases approved in subsequent years as permitted by State law.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FREMONT RESOLVES AS FOLLOWS:

SECTION 1. The City Council hereby reauthorizes and restates the health and welfare benefits available to active members of the City Council, as set forth in Exhibit A to this Resolution and incorporated herein by this reference. The health and welfare benefits shall be commensurate with those provided to part-time unrepresented management employees of the City, including any future increases approved in subsequent years as permitted by State law.

SECTION 2. Any premium costs for the medical insurance plan selected by a City Councilmember in excess of the benefit shall be paid by that Councilmember.

SECTION 3. Councilmembers shall not be entitled to receive cash in-lieu for any unused portion of the City’s benefit contributions.

SECTION 4. All health and welfare benefits shall terminate upon expiration of the term of a Councilmember with the exception of retirement benefits.
