RESOLUTION NO. 2026-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FREMONT
AUTHORIZING THE CITY MANAGER TO ENTER INTO A PURCHASE
AND SALE AGREEMENT FOR THE PURCHASE OF PROPERTY
WHEREAS, in 2022, the City of Fremont (“City”) completed a comprehensive Parks and Recreation Master Plan including a Parkland Acquisition Manual (“Manual”) that described key attributes and necessities to meet the needs of the residents, including park size, 10-minute walk to park access for all, connection to trails, and equity areas; and WHEREAS, 501 Crystalline Drive, APN 519-1410-011-00 (“Property”), was identified as a target site for a future potential park as the location could provide 2,492 residents access to a park within a 10-minute walking distance from their homes and new park access for approximately 1,763 residents; and
WHEREAS, the Property has a General Plan Land Use designation of General Open Space and permitted uses include public facilities and recreation facilities; and WHEREAS, California Government Code Section 65402 requires the planning agency to render a report as to whether the property to be purchased by the local agency is in conformity with the adopted general plan; and
WHEREAS, the Property is currently owned by the Haiying Tao Living Trust (“Owner”).
NOW, THEREFORE, based on the information set forth in the report to City Council dated September 15, 2026, as well as any information submitted to the City Council during the meeting, or considered by the City Council during its deliberations on this matter, the City Council of the City of Fremont hereby resolves as follows:
SECTION 1. The City Council finds that the purchase of the Property is categorically exempt from the California Environmental Quality Act (CEQA), without limitation, pursuant to CEQA Guidelines Section 15183, Projects Consistent with a Community Plan, General Plan, or Zoning.
The General Plan designation of General Open Space and zoning of Open Space - General supports public uses such as parks and the project is consistent with the vision established in the existing zoning and general plan for which an EIR was certified. On a separate and independent basis, the proposed acquisition does not consider immediate park development nor are any park development plans currently contemplated, and any future development is too speculative at this time for reasoned analysis. Any future park uses would be subject to environmental review when the plans are available, therefore the project is exempt from CEQA per CEQA Guidelines Section 15004, Time of Preparation. Lastly, per CEQA Guidelines Section 15061(b)(3), the activity to acquire the Property is covered by the “common sense exemption” in that CEQA

applies only to projects which have the potential for causing a significant effect on the environment. This action is also exempt from the California Environmental Quality Act under CEQA Guidelines Section 15378, not a project.
SECTION 2. The City Council finds that in accordance with California Government Code Section 65402, the Property is in conformity with the General Plan of the City of Fremont.
SECTION 3. The City Council finds that the Property meets the criteria set forth in the Parks and Recreation Master Plan, Parkland Acquisition Manual of the City of Fremont for parkland.
SECTION 4. The City Council authorizes the City Manager or designee to execute a Purchase and Sale Agreement for the Property, APN 519-1410-011-00, at 501 Crystalline Drive, in the amount of $4,500,000 and all other documents necessary to complete the acquisition of the Property, in form approved by the City Attorney.
