Executive Summary: The purpose of this report is to approve Final Tract Map 8752 and improvement agreements for public and private infrastructure associated with a six-unit single-family residential development.

Background: On January 22, 2026, the Planning Commission approved Tentative Tract Map 8752 for the 1.01 acre property at 2057 Olive Avenue in the Mission San Jose Community Plan Area. The developer is Lunara Homes LLC. The Final Map creates 6 residential parcels and 1 common area parcel to allow for a six-unit single-family home development.

Discussion/Analysis: The Final Map is in conformance with the Tentative Map and the developer has complied with all Tentative Map Conditions of Approval. The Final Map and Improvement Plans have been reviewed and are now ready for City Council approval.

The developer has signed the Public Improvement Agreement and has posted performance and labor and material bonds each in the amount of $219,000 to guarantee construction of the public improvements (Olive Avenue). Public improvements include curb, gutter, sidewalk, driveway, pavement, landscaping, signing and striping, utilities including storm drain, water, sanitary sewer, joint trench, and other miscellaneous items of work as identified on the approved improvement plans. The bonds will be held by the City until the improvements are accepted by the City Engineer.

The developer has signed the Private Improvement Agreement and has posted performance and labor and material bonds each in the amount of $797,000 to guarantee construction of the private and common area improvements (Lunara Common). Private improvements include the construction of private streets, installation of stormwater facilities, and other Council Staff Report (ID # 5826) Meeting of October 6, 2026 Updated: 10/1/2026 10:28 AM by Alberto Quintanilla Page 2 miscellaneous items of work as identified on the approved improvement plans.

The developer obtained an early grading permit (GRA2026-00021) for site grading of the building pads and private street prior to Final Map approval in July 2026. The developer anticipates starting construction of the site improvements immediately following approval of the Final Map and Improvement Agreements and finishing construction approximately late 2027.

Fiscal Impact: None.

Environmental Review: Approval of final subdivision maps is statutorily exempt from the California Environmental Quality Act (CEQA), Statutory Exemptions, Title 14 of the California Code of Regulations Section 15268(b)(3) Ministerial Projects. Moreover, on January 22, 2026, the Planning Commission made findings that the project is categorically exempt from CEQA review per CEQA Guidelines Sections 15183, Projects Consistent with a Community Plan, General Plan, or Zoning, and CEQA Guidelines Sections 15163, as the project is consistent with the land use envisioned for the site as established by the General Plan. The Final Map and Improvement Plans are consistent with the General Plan and Zoning Ordinance, original project description, and scope of work. No further environmental review is required.
