A RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO, CALIFORNIA, INITIATING A GENERAL PLAN
AMENDMENT AND REZONE OF REAL PROPERTY
LOCATED ON NORTH EMERSON AVENUE BETWEEN
NORTH MARKS AVENUE AND NORTH WEST AVENUE
PURSUANT TO FRESNO MUNICIPAL CODE SECTIONS
15-4902(B), 15-5803(B) AND 15-5803(C)
WHEREAS, on December 18, 2014, by Resolution No. 2014 -226, the Council of the City of Fresno (Council) adopted the Fresno General Plan; and WHEREAS, the Fresno Genera l Plan includes general goals, policies, and objectives that apply for the City of Fresno as a whole; and WHEREAS, on December 3, 2015, Council voted to adopt Ordinance Bill No. B - 43, adding Chapter 15 to the Fresno Municipal Code, which is a comprehensive update to the City’s Zoning Ordinance and is referred to as the “Citywide Development Code” ; and
WHEREAS, Fresno Municipal Code section 15 -5803(B) and (C) authorizes the Council to initiate an amendment to the General Plan and Zoning Map by a dopting a Resolution of Initiation; and
WHEREAS, the Council desires to initiate a General Plan amendment and rezone, for the purposes of establishing linear parks, for real property located on North Emerson Avenue between North Marks Avenue and North West Avenue, as de picted in the attached Exhibit “A”.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fresno as follows:

1. Pursuant to Fresno Municipal Code section 15-5803(B) and (C), the Council initiates the necessary proceedings to amend the General Plan and rezone the real property located at North Emerson Avenue between North Marks Avenue and North West Avenue.
2. Prior to returning to council for consideration and final approval, i f the current zoning and planned land use does not allow for the development of linear parks, a General Plan amendment and rezone will be prepared to reflect the necessary land use designation and zoning that would allow for the development of linear parks, any environmental assessment pursuant to the requirements of the California Environmental Quality Act (CEQA) will be conducted, and the General Plan amendment and r ezone will be presented to the Planning Commission for consideration.
