FRESNO CITY PLANNING COMMISSION
RESOLUTION NO. 13764
The Fresno City Planning Commission at its regular meeting on September 7 , 20 22, adopted the following resolution relating to Environmental Assessment No. EA -18-004 and the proposed adoption of Official Pl an Lines (OPL). The proposed OPL is for the alignment of a planned major street (Arterial) segment which will accommodate two travel lanes in each direction, bike lanes and sidewalks. The proposed segment begins at the intersection of the South Elm Avenue and West North Avenue and extends west along North Avenue to South Marks Avenue.
WHEREAS, the Director of the City of Fresno Department of Public Works has initiated a recommendation for the adoption of an Official Plan Line (OPL) for the planned major street segment of W est North Avenue between South Elm Avenue and South Marks Avenue; and,
WHEREAS, on September 7, 2022, the Fresno City Planning Commission conducted a public hearing to review the proposed Official Plan Line, received public testimony and considered the Development and Resource Management Department and Department of Public Works report recommending approval of the proposed Official Plan Line; and,
WHEREAS, the Fresno City Planning Commission has reviewed the related environmental assessment prepared for this official plan line, Environmental Assessment No. EA-18-004, resulting in a Mitigated Negative Declaration dated May 18, 2018;
NOW, THEREFORE, BE IT RESOLVED t hat Fresno City Planning Commission finds in accordance with its own independent judgment that with the project mitigation proposed, there is no substantial evidence in the record that the adoption of the proposed Official Plan Lines may have additional si gnificant effects on the environment that were not identified in the Fresno General Plan Master Environmental Impact Report (MEIR No. 2012111015) and that no new or additional mitigation measures or alternatives may be required. In addition, pursuant to Public Resources Code, Section 21157.6(b)(1), the Commission finds that no substantial changes have occurred with respect to the circumstances under which the MEIR was certified and that no new information, which was not known and could not have been known at the time that the MEIR were certified as complete, has become available. Accordingly, the Commission recommends Council adopt the Mitigated Negative Declaration dated May 18, 201 8, for purposes of the proposed official plan lines.
