- City of Fresno, non-profit organization
- activity does not generate a profit for the organization other than for fundraising for operational costs
Operator retains authority of determining appropriate rate based on objective criteria including the number of attendees, risks of damage to the Theatre, clean-up costs and insurance requirements, subject to approval of the City Manager
- local, community-based, non-profit cultural arts organization - activity relevant to the organization's mission/purpose - derive 90 percent benefit from the activity

GENERAL GOVERNMENT FEES
* Rates and overtime uses of the Tower Theatre, except as otherwise provided for, shall be at the discretion of the Operator based on objective criteria including the number of attendees, risks of damage to the Theatre, clean-up costs and insurance requirements. Rates shall be either: (1) the Basic Rates; (2) 10 percent fo gross receipts; or (3) square footage rate, whichever is greater.
Overtime shall be: (1) the rate identified as overtime; or (2) applicable rate set forth in Basic or Special Rates for the whole of shortest period in which overtime occurs.
