88 Urban-Rural Interface
Adapted from West Area Community Plan Policy W-1-e.

LUH 5.1 Consider updating the Development Code so that when land proposed for urban development abuts active farmland, planned farmland, or rural residential, the new project shall include and provide for the maintenance of one of the following design features to provide a rural/urban buffer:
• Provide landscaping and setbacks to fully obscure the new development’s bui
ldings and fences.
• Do not include fencing, or provide only see-thr ough fencing no greater than four feet in height between the new development and the existing property. • Provide open space such as edible gardens, landscaped walkways, trails or ra
ingardens to be no less than 30 feet in width.

94 Key Court Cases
BIA of Central California v. County of Stanislaus et al. (2010) • Upheld a 1:1 mitigation measure and determined a reasonable r
elationship between the adverse impacts and required mitigation.

Masonite Corporation v. County of Mendocino (2013)
• Invalidated an EIR claiming no feasible mitigation measures to f
armland loss. Determined easements at a 1:1 scale can offset loss.

King & Gardiner Farms, LLC v. County of Kern (2020)
• 1:1 mitigation alone is not enough to compensate the loss of far
mland to a less than significant impact.

96 9. District Committee &
Planning Commission Recommendations
97 Recommendations Received
District 1, 2, & 3 Project Review Committees | April & May 2022 • Voted to recommend approval
• D1 with modification to Policy LUH 1.4
Planning Commission | July 20, 2022
• Voted to recommend approval (5-0)
• With addition of late land use change request “L-2” to the follow- up Plan Amendment list
98 10. Findings & Staff Recommendations
99 Findings
- Fresno Municipal Code
- Housing Element
- SB 330
100
Fresno Municipal Code
• Consistency with the General Plan goals and policies
• A concurrent Plan Amendment to the General Plan Figure LU-1 e nsures land use consistency between the General Plan and Specific Plan • The Plan helps implement Objectives in the following Elements: Economic De
velopment; Urban Form, Land Use, and Design; Mobility and Transportation; Parks, Open Space, and Schools; Public Utilities and Services; Resource Conservation and Resilience; Historic and Cultural Resources; and Healthy Communities
• Consistency with the Development Code
• The Plan relies on the Development Code for implementation. • The Plan does not modify the Development Code.
101
Housing Element – Gov. Code 65863
Adoption of the Plan would impact dwelling unit capacities on Housing Element sites as follows:
0-12 du/ac: net loss of 53 units of capacity
12-16 du/ac: net gain of 1,625 units of capacity
16-30 du/ac: net loss of 5,119 units of capacity
Surplus capacity exists to accommodate the reduction in affected categories.
102
Housing Element – Gov. Code 65863
Therefore:

1. The reduction is consistent with the adopted General Plan; and

2. The remaining sites identified in the Housing Element are adequate to ac
commodate the jurisdiction’s share of the Regional Housing Need Allocation (RHNA).
103
Housing Crisis Act of 2019 (SB 330)
• Adoption of the Plan by itself would result in the loss of ca
pacity for 12,227 housing units.
• Staff proposes concurrent adoption of P22-02413 (M ixed Use Text Amendment) to provide additional capacity.
• Concurrent adoption of the Plan and Text Amendment will res
ult in an overall gain of 7,169 units in the West Area, thereby allowing the Plan to comply with SB 330.
104
Staff Recommendations
105
Errata
• Correction of the Rezone map to fix zoning on certain parcels and
to remove certain parcels where the current dual
designation is to remain.
106
Staff Recommendations

1. RECOMMEND APPROVAL of the findings set forth in the Final En
vironmental Impact Report (EIR SCH No. 2019069117) (see Exhibits I, J, and K).
a. RECOMMEND ADOPTION of an appropriate Mitigation Monitoring and Rep
orting Program (MMRP) as required by Public Resources Code Section 21081.6 and California Environmental Quality Act (CEQA) Guidelines Section 15097; and,
b. RECOMMEND ADOPTION of findings based upon testimony presented by st
aff that there are significant, unavoidable, environmental impacts which have not been mitigated to a level below significant. Therefore, the City Council should adopt the findings of fact and consider an appropriate statement of overriding considerations.
107
Staff Recommendations

P22-0
1353 which proposes to update the Planned Land Use
Map (Figure LU-1) of the Fresno General Plan to incorporate the land use changes proposed in the West Area

110
Staff Recommendations

5. RECOMMEND APPROVAL of Rezone Application P22-
01353 wh
ich proposes to rezone approximately 1,078 acres
of property within the West Area Neighborhoods Specific Plan area to be consistent with the planned land uses
proposed in the Plan (see Exhibit V).
111
Staff Recommendations

6. RECOMMEND APPROVAL au thorizing the Planning
Department Director or her designee to update the text, policies, maps, tables, and figures contained in the West Area Neighborhoods Specific Plan document to reflect the final action taken by City Council, to the extent that such updates are necessary to maintain consistency (See Exhibit W).
