3.NeighborhoodCompatibilityPlan
3.1. Proactiveresponsetocomplaintsrelatedtonoise, light, odor, vehicle, andpedestriantraffic.
WerecognizethattheCityofFresnoisavibrantcommunitywithaprecisevisionforasocially,environmentally, andeconomicallyresponsiblestrongfuture.WiththeintroductionoftheproposedYumaretaildispensary, weendeavortocontributetothatvisionbydevelopingavigorousgoodneighborpolicywiththemaintenanceofasafe,secure,sustainableandaestheticallyappealingfacility, coupledwithastrictprocedureforaddressingcommunityconcerns,includingthoserelatedtonoise,light,odor, andvehicleorpedestriantraffic.
NoiseComplaints: WeanticipatethatthenoiselevelatthelocationwillbewellbelowtherequisiteexteriorsoundstandardswithaCommunityNoiseEquivalentLevel(“CNEL”)ofnomorethan65dBAduringbusinesshoursasrequiredbyFresnoMunicipalCode§10-102.Wewillensurethatwecommunicatewithourneighborsandencouragethemtosubmitevenminornoisecomplaintsthatwillbeenteredintotheincidentlogandresolvedwithin24hoursorescalatedtotheCEO.Thisreinforcesourcommitmenttoexcellencebypartneringwithcommunitymembersandensuringissuesraisedareresolvedinatimelymanner.
Anyloiteringinoraroundpremiseswillbemonitoredandstrictlyprohibited.Restroomswillbelockedandundermanagementcontrol.Duringtheconstructionphase,wewilllimitnoise-generatingconstructionactivitiestobusinesshours.Anymusicplayedinourstorewillalsobeofasoft,ambient,andinoffensivequality, andwillbekeptatlowlevels(under50dBA)soasnottodisturbneighboringbusinesses.
LightComplaints:Weunderstandthatexcessivelightingisadisruptivenuisancetotheneighborhood,soourlightingdesignisparticularlydesignedtointegratewithoursurroundingsinanaestheticallypleasingwaywhileadequatelyaddressingoursecurityneeds.Factorsweconsiderinourdesignincludethepropensityforcrimeinanarea,attentiontotheinconspicuousfacade,andtheimportanceofanunobstructedparkinglotandentrancewhichisfreeofvegetation.BecausetherateofviolentcrimeinFresnoissubstantiallyhigherthantheStateofCaliforniaasawhole,with5.77incidentsofviolentcrimeper1,000residents,comparedto4.47forCalifornia[source:neighborhoodscout.com],wewillensureoursecurityanddesignplansmeetthestricteststandardswithregularupdatestoaddressparticularconcerns.
Mostneighboringbusinessesinourshoppingcenterhaveaddedmotion-activatedsupplementalshielded,downward-angledLEDlightsintheirfrontentrance.FortheexteriorofourFresnostore,wewillutilizewhitelight-emittingLEDlampswithfullcutoff fixturestolimitglareandlighttrespass.Colortemperaturewillbebetween2700Kand4100Kwithacolorrenderingindex CONFIDENTIAL:PROPRIETARYAND/ORTRADESECRETINFORMATION 2
of80orhigherandalightlossfactorof.95orbetter. Theselightswillmatchtheexistingonesusedbyneighbors.Brokenordamagedexteriorlightingwillberepairedorreplacedwithin48hoursofbeingreported.
Yumawillpromptlyrespondtolightcomplaints.Aswithothertypesofcomplaints,everylightcomplaintwillbeloggedintheIncidentLogandresolvedperIncidentLogprocedureswithappropriateescalationsandwithatargetresponsewithin24hours.
Yumawillprovidetoallbusinessesandresidenceslocatedwithinonehundred(100)feetoftheproposedlocationthename,telephonenumber, andemailaddressofacommunityrelationscontacttowhomnoticeofproblemsassociatedwiththebusiness.
OdorComplaints:Yumaunderstandsthatcannabisodorcanbeanoffensivenuisance,andweproactivelyaddresspotentialodorconcernsthroughourrigorousodormitigationpracticesoutlinedbelowinSection3.3. Weexpectourdispensarytogeneratenoodorintheprocessofitsoperation.However, intheunlikelyeventofpotentialodordetection,everycomplaintfromlocalcommunitymemberswillbelogged,reportedtomanagement,andpromptlyaddressedassoonaspossible.Wewillutilizethebestavailableodorcontroltechnology.
VehicleandPedestrianTrafficComplaints:Yumawillnotdisturbtheexistingrightofwaynorpedestrianaccessandwillnotcauseahazardtovehicleorpedestriantraffic.Wewillalsonotrequiretheadditionofanynewparkingorloadingspaces.Trafficgeneratedandpatternsofaccessandegresswillnotcausecongestions,hazardorasubstantialchangeintheneighborhoodcharacter. Yumaanticipatesthatapproximately20-30%ofcustomerswhocomeintothestorewilltravelbypublictransit,privaterideshareservice,byfootorbicycle;andtheremainingcustomerswillarrivebyprivatevehicle.Wehaveampleparkingonoursite..
Aspartofourgreeninitiative,Yumaincentivizescustomerstoarrivebypublictransport,bicycle,andridesharingservicesbyofferingadiscountof5%offinalticketpricetocustomerswhopresenttheirbuspass,ridesharereceipt,orbicyclehelmetatcheckout.BasedonState’ssocialdistancesguidance,Yumawillalsoofferprivatebusingfromretirementhomesandadultdaycarestomakeourstoreaccessibletoelderlyclientele.
EmployeeswillbeencouragedtoarrivebypublictransportandbybicyclebyreceivingsubsidizingFresnoAreaExpressandCaltransTransitpasses,arrangingemployeepickupfromParkn’Ridelocations,andreimbursingemployeesforbicyclemaintenance,repair, andstoragecosts.Infact,adecidingfactorinselectingourlocationwasthefactthattheFresnoAreaExpresshasabusstopjustminutesfromourstore.

Yumaisasophisticatedcannabisoperatorandassuchwehaveacomprehensiveclientserviceplantoavoidlengthywaittimesandfurthercausebuild-upsofvehicleandpedestriantraffic.Includedinourserviceplanis:● 4PointofSale(“POS”)locationsthroughoutthestorewithanaverageservicetimefromadmittancetocheckoutof6-8minutes;● Encourageduseofonlineorderingwithfastercheck-outtimeswitha4minuteserviceaverage;● Encourageduseofdeliverytofurtherminimizevehicleandpedestriantrafficinourareabyapproximately20-25%;and● Installationofadditionalbicycleracksinfrontofourstorebasedondemand Yumahasproactivelyapproachedourneighboringbusinessestodeterminehowtobestfacilitateahealthyandexpeditiousflowoftrafficfromourstore.Weareconfidentthattheplanpresentedwilleffectivelyabateanypotentialbuildupofvehicleandpedestriantrafficcausedbyouroperations,butintherareeventthatincidentsdoarise,wewillproceedwithentryandresolutionoftheincidentpertheIncidentLogprotocol.OurmanagementteamhasalsocommittedtoquarterlyreviewoftheIncidentLogtofurtheridentifyopportunitiesforenhancements.
COVID-19andSocialDistancing:InlightoftheongoingissueswithmanagementofCOVID-19intheUnitedStatesandanticipatedhealthriskstoretailstaff andcustomers,Yumaisfullypreparedtoenactstrictmeasurestoensurethesafetyofthosepresentonpremisesbyfollowingthestrictestgovernment-dictatedmeasuresandbeyond.Wearepreparedtoimmediatelyimplementproactivemeasures,includingsocialdistancing,sneezeguards,facemasks,additionalcleaningandsanitizationofthefacility, encouragingonlineordering,andothermeasuresthatmayberecommended.WehavesuccessfullyimplementedthesemeasuresacrossouraffiliatedColorado-basedfacilitiesandhaveshownthatwecanbeadaptabletoever-changingbusiness,economicandsocietalneeds.
3.2. Avoidingbecominganuisanceor havinganimpact onneighborsandthesurroundingcommunity.
Yuma’scommitmenttobeingagoodneighborandfriendtoitslocalcommunitygoesbeyondmerecompliancewithmunicipalandstateregulation.Wehaveacomprehensivemulti-componentprogramdetailedbelowwhichpreventsanypotentialcomplaintbeforeitarises,andwewillre-visitedthisprogramannually. Intheeventthatacomplaintisreceived,itwillbeloggedandaddressedimmediately, andcompany’spracticeswillbere-evaluated.

suggestions.Yumaisalwaysanactivememberofourlocaldistricts.AsapartofthisoutreachwehavereachedouttotheofficesofcouncilmenLouisChavez,ofDistrict5andtoMiguelAriasof District3toallowforcommunitydiscussionregardingouroperations.JessicaReuven,publicrelationsrepresentative,willattendmeetingswiththeCityManagerorhis/herdesigneeduringringthefirstyearofoperations,andbeavailabletomeetandattendmeetingswiththeCityManagerorhis/herdesigneeandotherinterestedpartiesgoingforwardasdeemedappropriatetotheCityManagerorrequested,todiscusscosts,benefits,andothercommunityissues.
SpatialConstraints:Whilestrictcompliancewithmunicipalandstatelocationrestrictions–includingzoningcodes,distancerequirementsandbufferzones–isimperative,wehavegoneevenfurtherbycarefullyevaluatingtheproposedlocationofthedispensarywiththegoaloffurtherminimizingpotentialnegativeimpactsonitsvicinity. YumahaspursuedaCrimePreventionThroughEnvironmentalDesign(“CPTED”)approachtothelocation,designandoperationalaspectsofthefacility, asshowninoursecurityplanandaccesscontrol(Measure1above).Statistically, implementationofaCPTEDhasbeenshowntoresultin30%to84%reductionsinrobberies,comparedtonon-interventionlocations(Casteel&Peek-Asa,2000;Cozens,Saville,&Hillier, 2005;Mair&Mair, 2003).
InconspicuousFaçade:Thebuildingimprovementsarefocusedonconstructionandtechnicalsecurityfeatures,butalsouponminimizingthevisualimpactofthedispensary. Thus,thefaçadewillappearverysimilartothatoftheothertenantsattheshoppingcenterandwillincludenomentionorallusiontocannabis,andwillbearonlythepermittedname.Furthermore,wehavedesignedthelayouttoaccommodatetheexpectedcustomercapacity, therebyreducingthepotentialforunwantedexteriorcongestion.Finally, theexteriorareawillbemonitoredbytrainedsecuritypersonnel.
EnvironmentalPartners:Aspartofourongoingcommitmenttosafeguardingtheenvironment,wewillestablishcollaborativerelationshipswithCaliforniakeyenvironmentalorganizations,includingtheCaliforniaEnvironmentalAgencyCommision,CaliforniaSolarandStorageAssociation,andtheCaliforniaEnergyCommision.Ourgoalistobeadrivingforcebehindadvancingenvironmentaleducationandresearch.
CommunityInvolvement:Weplantoplayacooperativeandleadingroleincommunityeducationinordertoraiseenvironmentalawarenessataneighborhoodandcommunitylevel.Wewillworkcloselywithlocalcommunityorganizationstoconnectourenvironmentalpartnerorganizationswithlocalcommunities.Wewillsponsoreducationaleventsandseminars,providingavenueforotherbusinessesandorganizationstoparticipateinenvironmentaleducationforresidentsoflocalneighborhoods.

DistributorsandSuppliers:Environmentalcomplianceisakeycriterioninourcontractor/distributor/supplierselectionprocess.PreferencewillbegiventolocalFresnobusinessesthatshareourenvironmentalvalues,andpractices,minimizecarbonfootprint,implementenergyconservationplans,utilizeandsellgreentechnologies,andobtainorganiccertification.Wewillconveythisinformationtocustomersandsupportenvironmentaleffortswithourmarketingstrategies.
Cleanliness:Yumawillmakesurethattheinteriorandexteriorofthestorewillbekeptcleanandpresentable.ThesedetailsareaddressedbelowinSection3.7.
Qualitybuildout:Thedispensarybuildoutwillbecompletedincompliancewithcurrentbuildingcodestandardsandwillutilizegreentechnologyconstructionpracticeswherepossible.Allinteriorelementsshallbeupgradedusingmodernenvironmentally-safematerialsthatwillallowforeffectivecleaninganddisinfection.Therewillbenocracksonwalls,floors,ceilings,orothersurfaces.Allinteriorandexteriorwallsshallbefreshlypainted.
MerchandisingPlan:Thedispensarywillfurtherreducetheenergyconsumptionbyoptimizationofproductassortmentandspaceutilization.Themerchandiseplanwillthusreducerequiredshelfspace,whileimprovingthecustomerflowanduseofenergy(lighting,climatecontrols,surveillanceandsecuritypowerdraw, etc.) BuildingEnvelope:Duringtheinitialbuild-outphase,weplantoapproachallconstructionfromanenergyefficiencystandpoint.Wehavedesignedthefacilitytominimizetheheat-lossfactor, andhavethemostcontroloftheenclosedenvironmentbysurroundingtheconditionedlivingspaceandseparatingitfromanyunconditionedspace.Energyefficiencyisfurtherincreasedbytheadditionofinsulation(madefromrecycledmaterialswherepossible).
HVACSystem:Weutilizehigh-efficiencycoolingandheatingunitsthroughoutourfacilities.Furthermore,energy-starthermostatsareutilizedtoexploreadditionalfine-tuning,thususinglessenergy. Hot/coldairrecirculationcontrolsareimplementedinsuchawaythattheairisbalancedthroughoutthebuilding,dependingonthetemperaturedemand.Hardwarein-ductcontrolsdirectcirculationofalready-preconditionedair, henceusinglessenergybynothavingtoconditionairagain.Thisreducestheelectricloadonthesystem.Carbonfilterswillbereplacedonscheduleanddocumentedinlogs.
LightingSystem:AllexistinglightfixturesatourretaillocationwillutilizeLEDlighting,whichyieldsapproximately75%energysavingscomparedwithstandardbulbs,andhasincreasedlifespanofover20,000hours.Lightswillbedesignedinconformancewithneighboringbusinesses,andtomitigatelightnuisance,andwillbekeptinagoodworkingorder.

WaterManagement:Ahighly-efficientwatermanagementsystemwillbeinstalledatourretailstore.Itwillincludearefillablewater-bottlestation,reducingtheuseofplasticbottles,andcontrollingwaste.Reduced-flowwaterfaucetsandmulti-flowtoiletswillbeinstalledthroughoutthefacility. Ifpossible,thecontractorwillinstallwater-freeurinalsinwaterclosetstofurtherminimizethewaterusage.
PackagingMaterialsandOfficeSupplies:Wewillattempttosourceallofficesupplies,suchaspaper, pencils,packingsupplies,packagingbags,trays,cleaningsupplies,etc.fromgreen-certified,reputable,diverse,andpreferablylocalsuppliersthatcarryafulllineofrecycledproducts.
AutomationofElectricalControls:Givenrecentadvancementsinenergy-useautomation,Yumawillbeutilizingsomeofthemostadvancedautomatedcontrolstomaximizeenergyefficiencyinourdispensary. Accordingtorecentstudiesonsuchsystems,automationreducesenergyconsumptionandenergyleaks RenewableEnergy:Weintendtoexploretheoptionofusingrenewableenergygenerationinourdispensaryoperations.WehopetotakeadvantageofCalifornia’sleadingsolarenergyprogramandinstallsolarpoweronoursite,iffeasible.WearecurrentlycollaboratingwiththepropertylandlordtoemploysolarenergysuppliersinevaluatingthefeasibilityandfinancialimplicationsofconvertingouroperationstorenewableenergysourcesshouldwereceiveallnecessaryapprovalsfromtheStateofCalifornia.
EnvironmentalCommittee:YumawillcreateanEnvironmentalCommitteethatwillreviewtheIncidentLog,DailyandMonthlyWalk-throughandMaintenancelogs,andrevisittheNeighborhoodCompatibilityPlaninitiativesatleastquarterly. TheCommitteewillincludetheGeneralManager, ChiefComplianceOfficer, SecurityandSafetyContractors,representativesfromtheWasteManagementcompany, atleastoneoftheneighboringbusinesses,andtheLandlord.TheCommitteewillforwardtheirreportandrecommendationstotheCEO.
Yumaisproudofouraffiliates’reputationforexcellence- withzeroviolationsorcomplaintsagainstouroperations- andpositiverelationshipswithinourcommunity. Wehavechosentoimplementtheabovestrategiesastheyhaveproventobeeffectivemeasuresinmitigatingthenegativeenvironmentalimpact.Additionally, webelievethathavingapositiveimpactonthesurroundingcommunities,adjacentbusinessesandneighboringorganizationsisofequalimportance.Wearecommittedtocarefullymonitoringandmanagingtheimpactthedispensaryshallhaveonallaspectsofsocietyaroundusandwilloperateourbusinessinasafeandresponsibleway.

3.3. Odor MitigationPractices
Yuma’sfounderspossessextensiveexperienceoperatingcannabisbusinessesfromseedtosale,whichgivesourcompanyacompetitiveadvantagewithrespecttobothtechnicalknowledgeanditsfunctionalapplicationasitrelatestoodormitigationcontrols,equipmentandprocedures.
Yumawillusethebestavailableodorcontroltechnologyanddevicesavailableonthemarkettoensurethatodorsfromcannabisarenotdetectableoff-siteandwillreviewfornewproductsandtechnologyatleastquarterlytoinsurethehigheststandards.Asufficientodorabsorbingventilationandexhaustsystemwillbeprovidedsothatodorgeneratedinsidethepremisesthatisdistinctivetoitsoperationisnotdetectedoutsideofthefacility, anywhereonadjacentpropertyorpublicrights-of-way, onorabouttheexteriororinteriorcommonareawalkways,hallways,breezeways,foyers,lobbyareas,oranyotherareasavailableforusebycommontenantsorthevisitingpublic,orwithinanyotherunitlocatedinsidethesamebuildingasourcannabisretailbusiness.
TheCompanyanticipatesalowlevelofrisksurroundingodoremanatingfromourfacility.Cannabisgoodswillonlybesoldinpre-packagedformwhichwillsignificantlyreducethepotentialforodorpresence.Inadditiontosellingpre-packagedgoods,wewillutilizephysicalcontrols,aswellassophisticatedengineeringcontrolswithHVACsystemcomponentswhichareaimedateffectivelymitigatingodorsandmaintainingairquality. Thesearediscussedingreaterdetailthroughoutthissection.
3.4. Potential Sourcesof Odor.
InJulyof2018,theCaliforniaBureauofCannabisControlimplementednewregulations,codifiedunderCCR§5405whichhavegreatlyreducedanypotentialfordetectableodorinsideandoutsideofcannabisdispensaries.Thisregulationrequiresthatallcannabisgoodsbepre-packaged.Assuch,mostmanufacturersanddistributorsnowutilizenitrogensealingoftheirproductstopreventodoremissions.
Theprimarysourcesofodoremissionarethedisplayproductsandcustomerinspectionofdisplayproductspriortopurchase.Theserequestswillbesatisfiedonlyuponrequestinordertofurthermitigateanypotentialsourcesofodor. Additionally, theVendorLobbymaybringodorsfromoutside.Forexample,acouriercomingdirectlyfromacultivationorprocessingfacilitywhereodorsarenotadequatelymitigated,maypotentiallycauseodorstobedetectedwithinourlocation.Wemitigatethistypeofscenarioviaengineeringandaccesscontrols.

3.5. Odor control devicesandtechniquesemployedtoensureodorsarenotdetectablebeyondpremises.
OdorMitigationTechniquesOverview:TheOdorMitigationPlanshallbedevelopedanddocumentedasapartofourenvironmentalprotectionplanandwillbereviewed/modifiedonaquarterlybasis.Thekeyelementsofthatplanshallinclude:
● On-premisesretentionofonlytheamountofcannabisproductnecessaryfortheday-to-dayoperationofthefacilityperFresnoCityCode§9-3310(a)(5);● Storageofallcannabisproductsinsealedtamperproof,childresistantcontainersinfullypackagedform,inaccordwith16CCR§5413;● Sealingofallexteriorwalls,doors,andwindowopeningstopreventairleakage;● Installationofanairfiltration,circulation,andexhaustsystemthatisrecommendedanddesignedbyanenvironmentalengineer;● Maintenanceoftheairfiltration,circulation,andexhaustsystemonascheduledbasisthatincludesadocumentedrecordofcarbonfilterreplacement;● Mandatorytrainingofallemployeesontheodor-controlprocedures,includingtheimportanceofclosingdoors,andensuringfiltrationsystemsarerunningasrequired;and● InstallationofUltravioletGermicidalIrradiation,proventobeeffectiveinthepreventionofmold,bacteriaandviruses.
Giventherigorofthemitigationplanoutlinedabove,weexpectourdispensarytogeneratenoodorintheprocessofitsoperation.However, intheunlikelyeventofleakage,everycomplaintfromlocalcommunitymemberswillbelogged,reportedtomanagement,andpromptlyaddressedwithina24hourperiod.
VentilationandNegativeAirPressureSystem
Yumautilizesaventilationsystemtofilterandexchangetheairintheareasonitspremiseswherecannabisodorsmaypresentandtomaintainnegativeairpressureinthoseareassothatpossibleodordoesnotescapethefacility. Negativeairpressureoccurswhentheairbeingbroughtintoaroomislessthantheairbeingexhaustedfromit.Precisecontrolofaroom’sairpressurecanessentiallyallowforthecontrolofwheretheairintheroom-andthustheodor- cantravel.Roomswherecannabisodorsmaybepresentwillbemaintainedunderanegativeairpressurebyensuring(viafans)thatairexhaustedfromtheroomthroughthecarbonfiltersisalwaysgreaterthantheairbeingbroughtintotheroom.
Prefilters Inordertoensurethattheventilationsystemisnotcloggedbydustanddebris,wewilluseaprefiltertomaximizethetotallifespanofour CONFIDENTIAL:PROPRIETARYAND/ORTRADESECRETINFORMATION 9
filters.Thepleatedcarbonfilterswillbereplacedatleastquarterly, andmaybechangedmorefrequentlydependentonthesizeoftheroom.
PleatedCarbonFilters Carbonfiltrationiscurrentlythemosteffectivemethodofcontrollingcannabisodor. Airexhaustedthroughtheventilationsystemwillbecleanedbyinlinecarbonfiltersattachedtotheducting.Pleatedcarbonfiltersattachedtopackageunitairconditionersontheroofofthebuildingwillcleantheairenteringthepremises.Thisventilationsystemwillallowformultipleairchangesperhour, ensuringtheairinourstoreandoutsidethepremisesiscompletelyremovedofanycannabisodor.
In-LineFans Wewillalsoinstallin-linefanswithintheductingofthebuildingwhichwillallowuscontrolovertheamountofairbeingventilatedfromaspecificlocation.Forroomsinwhichcannabisodorscouldbepresent,wemaintainnegativeairpressurebycontrollingthefanspeedoralteringthefansizesothattheairexhaustedfromtheroomthroughcarbonfilterssurpassestheamountofairbeingbroughtintotheroom.

RoomAirSanitizersaregermicidalultravioletfixturesthateffectivelydestroyairbornemicrobesincludingbacteria,mold,andvirusinenclosedoccupiedspacesandareavailableinanumberofdifferentconfigurationstoadapttoanysetting.RoomAirSanitizersprotectpersonnel,customersandvisitorsfrominfectionduetoairbornemicrobes.Thedesignhasbeencarefullyconceivedtoprovideadequategermicidalultravioletexposureforeffectiveairdisinfectioninoccupiedareas.YumawillhireHVACprofessionalswithpreviousexperienceinstallingodorcontrolsystemsforcannabisbusinesses.ThesesameexperiencedHVACprofessionalswillbehiredtoconductmaintenanceontheventilationandairfiltrationsystem.
3.6. Describeall proposedstaff training, andsystemmaintenanceplans.
InordertoensurethatourbestpracticesarestrictlyadheredtoaShiftManagerwillbeonpremisesduringallhoursofoperation.Havingleadershiponsitetomanageemployees,ensureoperationalcomplianceandmodelourexceedinglyhighstandardsofcustomerservicearekeyfactorstoourcompany’ssuccess.Duringthemobilizationphase,allmanagerswillgothroughanintensivethirty(30)days’trainingcourseatouraffiliateheadquarterssiteinColorado,followedbyfurthertrainingoutlinedbelowandwewillcooperatewiththeFresnoPoliceDepartment(“FPD”)andlawmakerstoensurethatbestpracticesarefollowedatalltimes.
InspectionandMaintenanceProcedures:TheShiftManagerwillconductabrief,visualinspectionoftheinteriorandexteriorofthefacilityeachmorningbeforeopening.AllitemsthatrequireattentionwillbeenteredintoIncidentorMaintenancelogs.Ifcannabisodorisdetected,adesignatedHVACprofessionalwithcannabisexperiencewillvisitthefacilityimmediatelyandinspectthesystemandwillalsobehiredformaintenance.TogetherthemanagementteaminconsultationwiththeHVACprofessionalwilldeterminethelifespanofallequipmentusedinourventilationandnegativeairpressuresystems.ShiftManagerwillobservethelightsdailyandmakesuretheyarefunctional.
StaffTrainingProcedures:Allnewemployeeswillbefully-trainedbyaShiftManageronmaintenanceinitiativesandlogsincludingtheodor-controlsystem.Thistrainingwillbeconductedaspartofthenewhireorientationandrequiresapproximatelyone(1)hourto CONFIDENTIAL:PROPRIETARYAND/ORTRADESECRETINFORMATION 11
complete.Additionally, allemployeeswillreceiveongoingcontinuingeducationatleasteverysix(6)monthsonodormitigationincludingrefreshertrainingontheimportanceofclosingdoorsandwindowsandensuringthefiltrationsystemsarerunningoptimally.
RecordKeepingSystems,MaintenanceandForms:TheGeneralManagerwillberesponsibleformaintainingcomprehensiverecordsofcarbonfilterchangesandpurchases,equipmentmaintenancerecords,andtrainingrecordssothatourenvironmentalprogramissuccessfullyimplementedinitsentirety.
IncidentLogTraining:TheIncidentLogisakeypieceofdocumentationwithinourorganizationanditisimperativethatemployeesaretrainedtoidentifyandaccuratelyrecordincidentsthatarereported.Theseincidents,eventhosewhichappeartobeminor, arereviewedbyCompanyleadershipandusedtorefinepoliciesandprocesses,wherepossible.Yumawillensurethatallemployeesarefullytrainedonhowtorecordandreportallneighborhoodcomplaints.
3.7. Describethewastemanagement plan. Theplanshall includewastedisposallocations, securitymeasures, andmethodsof renderingall wasteunusableandunrecognizable.
ThescrupulouswastemanagementsystemdevelopedbyYumainvolvesthesystematiccollection,storing,handling,andproperdestructionofallcannabisproductsfordisposal.Oursystemnotonlypreventsdiversion,butreflectsourcompany'scommitmenttorecyclingandredevelopment.
CannabisProductDisposal:Yumaretainedprivatewastehauler, EcoWastetopickupallofourcannabiswaste.Perouragreement,EcoWastewillprovideuswith20galloncontainmentbins,eachwithitsownuniqueserialnumberandsecurelock.Yumawilldisposeofallcannabisproductsinthebinsprovided,inputverificationofdisposedofproductsintoBioTrackTHC(oursystemofrecord)andEcoWastewillprovideuswithadigitalmanifestconfirmingpickup.
WasteProcessingCenter:Thedispensaryfacilityshallcontainadesignatedwasteholdingandprocessingareawithinoursecurevault.Theentirewasteprocessingcentershallberecordedonhighdefinitionvideoandremainlockedatalltimes.Theprocessingcentershallcontainashredder/grindingmachine,multiplecontainmentbins,atleasttwo(2)mixingcontainers,andadditionalprocessing/medium/substrates.Preparationofwasteshallbecontainedwithinthesecuredprocessingcenterinordertopreventanycross-contaminationwithanydispensaryareasorproductprocessingareas,andavoidanypossibilityofproductdiversion.
SecureWasteCollection:Per17CCR§40290(b), allcannabisgoodsfordisposalshallbeheldinalockedbinwithinoursecurevaultcontainedintheLimitedAccessArea.Suchbinswillbe CONFIDENTIAL:PROPRIETARYAND/ORTRADESECRETINFORMATION 12 closelymonitoredatalltimesbyourvideosurveillancesystemwithsuchfootagereviewedbyourin-housesecuritymanager. Allgoodscontainedinthebinwillbeinputintoourelectronictrackingsystemasnotedbelow, andonlyourmanagementteamshallbeinpossessionofthekeyforthebin.Furthermore,attheendofeachday, theon-siteShiftManageralongwithoneoftheDispensaryAssociateswillcollectallthewasteandweighitoutonvideo.Thewastewillthenbestoredinthewasteprocessingroomuntilsuchtimeasthecannabisproductcanberenderedunusablepriortodisposal.
RecalledProductsAdditionalDestructionProcedures:Allrecalledcannabisproductsthatthecompanyintendstorenderintocannabiswaste,whethervoluntarilyordirectedbytheCity, shallbeheldonthepremisesinquarantineforaminimumof72hours,duringwhichtimetheCitymayaudittheproduct.SuchquarantinedproductswillbestoredinadesignatedbinprovidedbyEcoWasteandstoredinthewasteprocessingcenterarea.
WasteInventoryDocumentation:AsdiscussedinmoredetailintheBusinessPlan, YumaintendstoutilizeBioTrackTHC(“TheSystem”,“System”)asourcompliantelectronictrackingsystem;thisisfullyintegratedwithMETRC.AlldatapertainingtothedisposalofcannabisproductsshallbetrackedinTheSystem,asrequiredby17CCR§40512including:● Adescriptionofandreasonforthecannabisbeingdisposed● Thedateofdisposal;● ThenameandemployeeIDcardnumberoftheemployeeresponsibleforthedisposal;and● Thesignatureoftheemployeeresponsibleforthedisposal; “Expired”or“Unsold”Products:AllproductsthataredisposedofshallbeenteredintoTheSystemaswaste,withaproductnoteof “Expired”or“Unsold”basedontheirstatus.Aspertherequirementsof16CCR§5410itemsawaitingreturntothelicenseddistributororawaitingdestructionwillbemaintainedinaseparatevaultwithintheLimitedAccessArea.Thisareawillonlybeaccessiblebycredentialedstaff utilizingtheirpersonalaccesscodetoallowmanagementtomonitoraccess.
ProcessforRenderingCannabisUnusable:Expiredoils,edibles,andotherproductsrequiringdisposalwillbeinventoriedandrecordedinTheSystemandaccountedforaswaste,ascompliantwith16CCR§5054. Theywillthenbedestroyedpastthepointofrecognitionbythefollowingprocess:Materialswillbegroundintopieceswhicharesmallerthan0.5centimetersinlength;thismixturewillbeplacedinabagofsoilsothattheproductisabsorbedandtheresultingmixturewillbeaminimumof50%non-cannabiswaste;thiswastewillthenbedisposedofinalockedandsecuredbin.

AllweightsshallberecordedintheSystemandaccountedforaswaste.Allbatchesofcannabiswastewillalsobekeptseparateandundernocircumstanceswillbecommingled.
DisposalProgramforCustomers:Yumawillcreateacannabisdisposalprogramforourcustomersinaccordancewith16CCR§5410. Customersareeligibletoreturncannabisproductsincludingexcesscannabisandcannabisresiduefromapprovedcannabisdevicestobedisposedofatoursite.
DisposalProgramitemswouldbeenteredintoTheSysteminthesamewayasoutlinedintheprevioussectionProcessforRenderingCannabisUnusable. Theseitemswouldbeplacedinsidealockedcontainerclearlylabeled“NotforSaleorUse”andstoredinthesafewithintheLimitedAccessAreaforsuchitemsuntilsuchtimeastheycouldbedestroyedasoutlinedinearliersections,accordingtotheproducttype.
Cleanliness:Boththeinteriorandexteriorofthedispensarywillbecleanedpursuanttoawrittenscheduleandmaintainedingoodorder. Inadditiontodailyinspectionsbyfacilitystaff,membersofthecorporateleadershipteamwillconductmonthlywalkthroughsandcoordinateadditionalinitiativesasneeded.Thiswillincludeeitheradeepcleaningorpaintingoftheinterior, powerwashingorpaintingoftheexterior, cleaningexteriorlightsandsecuritycameras,landscapingmaintenance,pestcontrolactivities,monitoringoftrash,andrecycling.Floors,wallsandceilingswillbekeptingoodconditionasarequirementofMAUCRSA.
Thepremiseswillbestrictlymaintainedsoastobevisuallyattractiveandfreefromdangerforthehealth,safetyandgeneralwelfareofemployees,patrons,surroundingproperties,andthegeneralpublic,andshallnotbemaintainedinamannerthatcausesapublicorprivatenuisance.Wewillmakesurethatalllitterwillberemoveddailyfromthepremises,includingadjacentpublicsidewalksandallparkinglotsunderthecontrolofYuma,andtheseareaswillbesweptorcleaned,eithermechanicallyormanually, onaweeklybasistocontroldebris;upkeepandoperatingcharacteristicsmustbecompatiblewithabuttingpropertiesandthesurroundingneighborhood.
RecyclingandReuseofMaterials:Employeeswillbetrainedandencouragedtorecycletheirpersonalwasteandtousebiodegradablematerials.Sincereusegeneratesfarlessairandwaterpollutionthanmostotherenvironmentalwastemanagementprocesses(includingrecycling),employeeswillbetrainedandencouragedtoreusevariousmaterialsutilizedinthedispensaryoperations.
Allplastic,paper, andaluminumproductswhicharenotreusedwillberecycled.Yumawillencouragerecyclingbymakingbinsavailableforeachtypeofwaste:paper, plastic,aluminum, CONFIDENTIAL:PROPRIETARYAND/ORTRADESECRETINFORMATION 14 andlandfill.Therecyclingbinswillbeplacedinwaitingareasandinemployeeareas,suchasbreakrooms.Dispensaryassociateswillalsobetrainedoncompostingandallfoodandothercompostablewastewillbeplacedincompostbins.
TrashDisposal:Trashfromthefacilitywillbedisposedofonaregularbasis.Thetrashenclosureandcontainerswillbekeptcleanandneat.Thedispensaryisnotexpectedtoproduceanyhazardouswaste,butifanywasteisdeterminedtobehazardous,itwillbedisposedofappropriatelyinaccordancewithfederalandstatelawsandregulationsrelatedtohazardouswaste,includingsections3001-3024oftheResourceConservationandRecoveryActof1976(42U.S.C.§6921-6939g)andsubsequentregulations.Anysignsofpestissueswillbeaddressedandthenmonitoredbyacertifiedpestmanagementcompany. Alltrash,recyclingandcompostofnon-cannabisgoodswillbemadeavailableforpickupfortheCityofFresnoWasteService.
PestControl:Adequateprotectionagainstpestswillbeprovidedthroughtheuseofintegratedpestmanagementpracticesandtechniquesthatidentifyandmanagepestproblems.Asdiscussedinthesectionabove,theregulardisposaloftrashisnecessarytopreventinfestationsandemployeeswillbetrainedviacomprehensivepoliciesandprocedurestoensurethisismanagedcompliantly. Anysignsofpestissueswillbeaddressedandthenmonitoredbyacertifiedpestmanagementcompany.
SanitaryConcerns:Whilewemakeeveryefforttoavoidutilizingtoxiccleaningcompounds,sanitizingagents,solventsand/orpesticidechemicalsinourbusiness,Yumawillensuretheyarelabeledandstoredinamannerthatpreventscontaminationofmedicalcannabisandinamannerwhichcomplieswithallotherapplicablelawsandrules.Employeeswillalsobetrainedonsafeuseandstorageofcleaningagents.
Employeeswillberequiredtoconformtosanitarypracticeswhileondutyincluding,butnotlimitedto:● Maintainingadequatepersonalhygiene;● Thoroughcleaningofthework-andcustomerspace;● Washinghandsregularlywearingglovesasneeded;● Maintainequipmentandsuppliesingoodworkingorderbyfollowingmaintenanceprotocols; Yumawillensurethatouremployeesandvisitorshaveadequateandconvenienthandwashingandlavatoryfacilitiesfurnishedwithrunningwateratatemperaturesuitableforsanitizinghands.Thesewillbelocatedwheregoodsanitarypracticesrequireemployeestowashandsanitizetheirhands,non-waterbasedandnon-toxicsanitizersmaybeprovidedalongwithasuitablehanddryingdeviceortowelservice.
